<br /> 7. In accordance witn. the terms of the Last Will and Testament of Emma Dekla Koehler, deceased,
<br /> �he net balance remainin� in the hands of the executor, after the payment of the above �,dministra�iv�
<br /> coets, executor 's fee and a'ttorneys fees, should be paid out �o the seven survivinr� ch3ldren,namely,
<br /> Anna Fle'�eher, Marie E. Wo1P, Bernhardt Koehler, Albert Koehler, Arnhold 0. Koehler, Robert Koehler
<br /> and Amanda D. Schmidt, share and' share alike.
<br /> �. Amon� the assets of the estate now held by thE executor is a, mort�a�re p�iven to deeeased by
<br /> Amanda Schmidt and Richard Schmidt, wife and husband, on certain real estate of the principal value
<br /> of �3,000.00, less certain sums pa�.d on principal and �nterest. This mortr�a�e is held by the
<br /> exeeutor as personal property of the estate, but on his oral application in order to more
<br /> effectively make distribution o� this estate, it is desirable that the executor should, if possible,
<br /> without diseour�.�, sell, assi�n and trangfer said mort�;age fbr the purpose oP makin� distribution oP
<br /> the proceeds thereof in cash, to the beneficiaries of the estate as desi�nated in the preced3.n�
<br /> para�raph hereof, a1on� with the other assets of the eetate.
<br /> �. The said Emrna Dekla. Koehler was also known as Emma D. Koehler and as Emma Koehler; the
<br /> said Arnhold 0. Koehler, executor herein, is also known as Arnold Koehler; and the said Bernhardt
<br /> -4- Koehler, one of the heirs herein, is also known as BernY�art Koehler; and the respec'�ive names in
<br /> each of the above instances r�fer to one and the same respective individuals, notwiths'�a.ndin� �he
<br /> discrepancy in names. -
<br /> 10. This estate is not sub,j�ct to the payment of either Federal Ea'�ate or Nebraska Stat�
<br /> Inheritanc� taxes.
<br /> IT IS, THEREFORE, ORDERED, ADJtJDGED AND DECREED BY THE COURT �hat the aforesaid f inal repor'�,
<br /> filed herein by Arnhold 0. Koehler, executor of the estate of Emma D�kla Roehler, deceased, be and
<br /> the same is hereby in a11 thin�s approved, confirmed and allowed as and for the said executor's
<br /> final report.
<br /> IT IS FURTHER ORDERED, ADJU�C+ED AND DECREED BY THE COURT tYiat only one claim has been filed
<br /> a�;ainst said estate, wh�.ch has been duly allowed and pai�l in ful1, that alI expenses for the
<br /> last i7.lness and funeral of said deceased have been paid in fu11, that the bequest of �100.00 to
<br /> Edward Koehler and �he beques� of �1�0.00 to the three children of deceased's �randson, Robert
<br /> Koehler, namely, Joyce Caroline Koehler, Jeannine Irene Koehler and Robert Joshwa Koehler, minore,
<br /> have both been pa3.d in full, that �he lien in favor of Hernhardt Koehler in the sum of �150.00, set
<br /> out in said last Wi11, has been paid in ful1, that there should be paid to Charles Bossert, Gounty
<br /> Jud�e of Hall County, Nebraska, the sum of �71. 60, as probate Court cogts herein, includin�; pub- -
<br /> 1�cation fees, that there should be paid to Arnhold 0. Koehler the sum of �150.00; as executor �s
<br /> Pee herein, and that there should be paid to Paine & 'Paine, a�torneys, the sum of �432.00, as
<br /> attorney �ees herein. A11 per�on� havin�; claims as�ainst said estate, no� filed within the time
<br /> Pixed by the Court, if any such 'Chere be, are hereby forever barred, excluded and en�joined from
<br /> se�tinr� up or ascertin� any claims whatever a�ains� said estate.

<br /> IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that the said Emma Dekla Koehler,
<br /> deceased, passed away testate on the 24�h day of November, Z9�+9, and at the time oP her death, she
<br /> was seized and possessed, by fee simple title absolute, of the Pollowin�; described real eatate,
<br /> to-wit:
<br /> (a) Lots One (1) Two (2) , Three (3 ), Four (�+) , Five �5) , Seven ( 7) and E��ht (�) in
<br /> B1ock Two (2� , in South Grand Island, an Addition '�o the City of Grand Island,

<br /> (b) Lot Three (3 ) , in Block 5even ( 7) , in South Grand Island, an Addition to the Ci�y of

<br /> and that, at the time af' the dea'�h of said deceased, in accordance with the terms of the Last Will.

<br /> descend and pass, by fee simple title absolute, to the seven survivin� children of the said Emma
<br /> Dekla Koehler, deceased, namely, Anna Fletcher, Marie E. Wolf, Bernhardt Koehler, Albert Koehl�r,
<br /> Arnhold 0. Koehler , Robert Koehler and Amanda D. Schmidt, share and share alik�, that the said
<br /> seven survivin� children are all of le�al a�e, that they were all livin� at the date of the death
