<br /> Now on this 27th day of May, 1950, this cause ca,me on Por hearing upon the pet3.tion of
<br /> Mar�aret Morton of Hall County, Nebraska, prayin� for a settlement of the estates of Simon Hoberg,
<br /> Alma Hoberg Russow, Julia Ho'perg, Louis Hoberg, Catherine Hoberg Russaw and ti�T�.11iam Hoberg, all
<br /> deceased, and praying for a determination of the heir�-at-law of the said Simon Hoberg, Alma
<br /> Hoberg Russow, Ju1�.a Hoberg, Louis Hoberg, Catherine Hoberg Corbin and William Hober�, deceased,
<br /> and for a decree settling the aforegoing estat�es. And it appearing to the Court from the proofs
<br /> on file that due and regular notice has been given by �ublication for three successive weeks, as
<br /> prov�.ded by law and the order of this Court, in the Wood River Sur�beam, a legal newspaper cir-
<br /> culated in Ha11 County, Nebraska, to a1.1 heirs-at-law and to all other persons interested:;in
<br /> the estate of Simon Hoberg, deceased, Alma Hoberg Russow, deceased, Julia Hoberg, deceased, Louis
<br /> Hoberg, deceased, Catherine Hoberg Corbin, deceased, and VJilliam Hoberg, deceased, of the filing
<br /> of said peti'�ion by the said Margaret Morton and o�' the time and place fixed for hearing on said
<br /> petition.
<br /> There being no ob,�ections filed or made thereto, this cause was duly submitted to the Court
<br /> upon the petitian of the said Margaret Morton and ev3.dence �.n support thereof and the Court being
<br /> duly adv�.sed in the premises, finds that the allega�ions contained in said petition are true,
<br /> that Max gax et Morton, tn.e petitioner herein, is and was at the date of filing her peti'Cion the
<br /> owner of the Southeast Quarter o� Section Twenty-seven, Township Ten North, Range Nine West oP
<br /> �Ghe 6tn P. M. , in Hall County, Nebraska and that she is a competent and proper person to prosecute
<br /> said nroceedings and that the prayer of said �tition should be granted.
<br /> The Court finds that Simon �iober�, late of Streator, I1linois, depaxted this li�e intestate,
<br /> in Streator, La Salle County, Illinois on the 10th day of March, 190�, that at tne time of his

<br /> Twenty-seven in Township Ten North, Range Nine, 'r�est of the 6th P. M. , in Hall County Nebraska
<br /> and tnat said r.�roperty did not exeeed in value, at the date of his death, the sum of ;�6,000.
<br /> The Court finds that at '�he time of his death the said Simon Hoberg lef't surviving him as
<br /> his he3.rs-at-law and only heirs-at-law his daughters, A1ma Hoberg, �atherine Hoberg Corbin,
<br /> Julia Hoberg, August� Hoberg and his sons, Louis Hoberg, t�Tilliam Hoberg, Herman Hoberg and
<br /> Arthur Hoberg, and that upon his death t:ne above-described property did pass and descend as
<br /> follows to: --Alma Hoberg Russow, 1�/�th interest thereof, C�.t�erine Hoberg Corbin, 1/�th interest
<br /> thereof, Julia Hoberg, 1/�th interest thareof, Au usta Hoberg, i/�th interst thereof, Louis
<br /> Hoberg, i/�th interest thereof, William Hoberg, i��th interest thereof, Herman Hoberg, i��th int-
<br /> erest thereaf and Artnur Hoberg, � 1/�th interest thereof.
<br /> The Court finds that more than forty years have elapsed sinc� the death of the said Simon
<br /> that no a � lication f'or the �robate of' �is estate has been filed and that no etition has

<br /> been filed for the administration of his es�ate ln the State of Nebraska, that his funeral bills
<br /> and other deb#�s have been paid and if there are any outstanding claims against sai d estate, the
<br /> same are �orever barred.
<br /> The Court finds that Alma Hoberg Russow, late of Blackstone, Illinois, a dau�hter of Simon
<br /> Hober�, deceased, departed tnis life �ntestate, in Blackstone, Livingston� County, I1linois, on
<br /> October 3, 93o and that, at t�ie time af her death, she was marrie�. and was the owner of an
<br /> undivided l��th interest in and to the �ou�heast �,uarter of Section Twenty-seven in Township Ten,
<br /> North, R�,n�;e Nine, west of the 6th P. M. , in Hall County, Nebraska, and that the value of::her
<br /> share in the es�ate did not exceed the sum o f ��00.00.
<br /> The Court finds that at the date of her death the said Alma Hoberg Russow left survivin g her
<br /> heirs-at-law and only heirs-at-�_aw, Charleg Rusaow, her husband, Jennie Hunsicker, her dau�hter
<br /> and Elmer Russour, iler son, �.nd that the interest of the said Alma Hoberg Ruasow in the Southeast
<br /> Quarter of Section T�•��enty-seven, passed and descended a5 followg: --Qharles Russow, her husband
<br /> an undivided 1�2�+th interest, Jennie Hunsicker, her daugh�er, an undiv3.ded 1/2�th interest and
<br /> Elmer Russow, her son, an undivided 1/2�-th �ntere5t in and to the Southeast Quarter of Section
<br /> Twenty-seven, abave-described.
<br /> The Court finds tnat mr�re than ten years have elapsed since the death of the said AZma Hoberg
<br /> Russaw and th�,t no ax.�plication for �he probate of her estate has been filed, that no pe tition for
<br /> administration of said estate has been filed in the State of Nebraska, that all funeral bills
<br /> and other debts of t:�e deceased have been paid and, if there axe any outstanding claims, the same
<br /> are forever barred.
<br /> The Court finds that Julia Hoberg, late of Living�ton County, Illinois, a dau�hter o�' Bimon
<br /> Hoberg, deceased, departed this life intestate, in Livingston County, Illino3�, on June 22, 193�
<br /> and that, at the time of her death, she was unmarried and wa� '�he owner of an undivided 1/�th
<br /> interest in and to the Southeast Quarter of Section Twenty-seven in Township Ten, North, Range
<br /> Nine, 'rJest of tile 6th P. M. , in Ha11 County, Nebraska, and that the value of her share in the
<br /> estate did not exceed t�e sum of ��00.00.
<br />' The Court finds that at t'��,e time of her dea�h the said Julia Hoberg left surviuing her as
<br /> her heirs-at-law and only heirs-at-law her brothers, Willi�.m Hoberg, Herman Hoberg, Louis Hoberg
<br /> and Arthur Hoberg, anc� her sisters Catherine Hob�rg Corbin and Au�usta Hoberg, her niece Jennie
<br /> Hunsicker and her neph��w, Elmer Russow, and, upon her death her interest in and to The Southeast
<br /> Quarter of said Section Twenty-seven passed and descended as follows:--Cathering Hoberg Corbin,
<br /> a sister, 1/56th interes'� therein, Herman Hoberg, a brother, i/56th interest therein, Louis
<br /> Hoberg, a brotner, l/56tn interest therein, Augusta Hoberg, a sister, 1/56th interest �nerein,
<br /> Arthur Hoberg, a brother, 1/56th interest therein, Jennie Hunsicker, a niece I/112th interest
