<br /> BE IT REMEMBERED that on the 9th day of December, 19�9, Ida Buchf inck, administratrix of
<br /> the estate of Mar�3,n Witzke, deceased, f iled in tnis Cou�� her f inal accaun� as such administratri�
<br /> and a peti�ion nr�ying that said account be alloti,red, f or a decree of heirship, a determination of
<br /> inheri�ance tax, an order of distribution, a final settlement �hereon and discharge.
<br /> For these �urpo�es tne �tn day of January, 1950, at 10 o� clock a.m. , at the County Court
<br /> Room in said County was assigned a.s the time and place for hearing said petition, examining and
<br /> a,llowing said accoun'�; and it was ordered that notice of the pendency of said petition be given
<br /> to all persons intere�t�d in said estate by publishing such notice in the Grand Island Independent,
<br /> a legal newspap�r printed in sa3.d County, for three ti�reeks prior �o said date of hearing, and i�
<br /> appears by proof on file that said notice �Tas given as ordered by Court and that no ob�ections to
<br /> sa3.d final account have been made or filed; but f'rom the proof offered at said hear3.ng, a chan�e
<br /> from the faets s�t forth in said �e�ition is found as hereinafter set forth.
<br /> Upon Examination of '�he record and the evidence in this matter and being duly advised in the
<br /> premis�s, the Court finds �,s follows:

<br /> That Martin t�litzke depar�Ged this life at his home in Orange County, California �n the 21st
<br /> day of Apri1, 19�9, in'testate, and a� th� time of his dea�h trras a resident of Orange County,
<br /> California, but was se�.zed and possessed of real est�.�e situated in Hall County, Nebraska, and
<br /> in Thayer County, N�braska.
<br /> SE COND Z
<br /> That on the 27th day of M�.y, Zg�9, Ida Buchfinck, a cousin of said Martin Witzke, dec�ased,
<br /> filed in this Court a petition prayin� for the appointment of said Ida Buchf inek as ad.ministratrix
<br /> of the estate of said d�ceased in Nebraska, and an the 27th day of May, 19�9, an order of �his
<br /> Court t�ras made therein, assign�ng the 22nd day of June, 1g�9, at 10 o�clock a.m. at the County
<br /> Cour'G Room in said County as the time a,nd pla.ce for hearing said petition, and ordering that '
<br /> not3.ce of trle pendeney of said petit3.on and hearing thereon be giv�n to al�. persons interested
<br /> in said mat��r by �ubli�hing said notice in the Grand Island Independent, a legal newspaper
<br /> printed 3.n said County, for three successive t�reeks prior to said day of hearing, �,nd it appeaxs
<br /> by proof on file that notice of said order was given as ordered by this Cou.rt.

<br /> The Cour� further finds that Ida Buchfinck named in said petition was, upon her giving bond
<br /> � in the sum of �2,000.00, as ordered by this Court, ap�ointed administratrix as pray�d; the Court
<br /> further find� that the deceased a� the time of his death, was an unmarried man, having never
<br /> married, nor having been the fa�her of any ch�.ldren, triat his parents both preced�d him in dea�h
<br /> and tha� he left him surviving no issue, spouse, parent, uncle, aunt, brother, sister or deacendan�
<br /> of a deceas�d brother or �ister, and that he lef� the following h�irs�at-lati,t, aIl of whom are
