<br /> NOW, on �his 2�th day of September, 19�+9, this cause came on for hearing upon the final aceount
<br /> and petition for decree of dis�ribution and diacharge of administrators with will annexed and was
<br /> submitted to the Court. Upon due consideration whereof, �he Cour� finds from proo� on Yile that
<br /> due and legal notice of said hearing has been duly given as required by law, and the Court having
<br /> examined the records and files her�in, including said final report, heard the evidence in support
<br /> thereof, and being fully advised in the premises and from prooP on fi1e, finds thatt
<br /> l, No�ice of said hearing has been duly given to a11 persons interested in this estate, as
<br /> required by law.
<br /> 2. Th� final report is �rue and eorree'� in all resp�ets, and is hereby approved and allowed
<br /> as the final account of the administrators w�.th will annexed.
<br /> 3. Due nvtice was given to all creditors and persons having claims against said e5tat� of the
<br /> time and plaae fixed for a hearing thereon by publication in the Grand Island Daily Tndependent for
<br /> thres suceessive weeks, as provided by law, and a decres forever barring and excluding claims
<br /> against the est�.'�e was duly entered herein on the 29th day of Ju1y, 1949.
<br /> 4. No claims have been filed against �aid eatate, except only the claim of Bert 0. Ra�.nforth,
<br /> fo�r money advanced personally for funeral, doctor and hospital bills, and taxes, which elaim �ras
<br /> duly allowed and has been paid in full; all e�enses connected with the Puneral and last illness
<br /> of the said William H. Rainforth, deceased, have been paid in full; and all other expenses hav�
<br /> been paid in full, exeep'� for Cour� costs, adminiatrators � fees, and reasonable a�torneys ' Pees
<br />-1- to Paine & Paine, attorneys, and the receipts are in proper order.
<br /> 5. William H. Rainforth passed away testate on the 19th da.y o�' June, ig4�, be�.ng at that time
<br /> a citizen and a resident of Hall County, Nebraska, and possessing property in said Coun�y and leaving
<br /> surviving him as his heirs-at-law and sole and only heirs-a.t-law, the following, . a11 of wh�m are over
<br /> twenty-one years oP age, namely:
<br /> Mrs. Elfleda I• Rainforth, widow, of
<br /> Prosser, Nebraska;
<br /> Mrs. Pauline Hurat, a daughter, of �
<br /> Doniphan, Nebraska;
<br /> Arthur W. RainPorth, a son, o�' Greeley,
<br /> Colorado;
<br /> Ber� 0. Rainforth, a son, of Prosser,
<br /> Nebraska;
<br /> wesley M. RainPorth, a son, o�' Prosser,
<br />� Nebraska;
<br /> that the said Elfleda S. Rainforth, widow, was named as execut'rix in the Last Will and Testament of
<br /> I her husband, William H. Rainforth, deceased, but tha'� by writing heretof'ore filed in this es'Gate
<br />''�I proceedings, she declined to serve a� such executrix; and tha� two of the heirs herein, bo'Gh sons
<br /> I of the said William H. Rainforth, deceased, were duly appointed, qualiPied �nd have acted as
<br /> adminiatrators with the will annexed of the estate of' William H. Rainforth, deceased, said two
<br /> administrators be3.ng Bert 0. Rainforth and Wesley M. Rainforth.
<br /> 6. At the time of his death, the said William H. Rainforth died seized and possessed as the

<br /> (1) The Southw�st Quarter (SW�) of 9ect3.on Thirty (30) , Township Nine (9) ,
<br /> North, Range Ten (10) , Wes t of the 6th P.M. , in Ha,ll County, Nebraska; and, .
<br /> (2) The South Half of the Sou�heast Quarter (S�SE�) of Section Twenty-lfive
<br /> (2 5) , Towns�hip Nine (9), North, Range El even (11) , Wes t o� the 6th P.M. ,
<br /> in Hall County, Nebraska..
<br /> 7. The said William H. Rainforth died leaving a La�t Will and Testament dated October 24, 1g19,
<br /> which wil.l has been adm�.tted �o probate in the Probate Court, and under the terms of said will, the
<br /> said testatQr devised said above '�wo traets of real estate, both oP which are located in Ha11 County,
<br /> -2-Nebraska, to his wiPe, El�leda I. Rainforth, ��during her life, a nd af ter her dea'�h equally to my �
<br /> children and �he lawful issue of any deceased child, by right of representation. " As heretofore
<br /> f'ound, said wife, E1Pleda I. Rainforth, and all of the said sons and da.ughter of Wi111am H. Rain-
<br /> fortn, deceased, were living at th� date of his death.
<br /> �. The will of the said Williaxn H. Rainforth, deceased, furth�r provided that he bequeath�d
<br /> unto his wife, Elfleda I. Rainforth, all of h�.s personal property of every kind and description.
<br /> The Court f inds that all of the interest of said deceased in and to the partnership, which existed
<br /> between William H. Rainforth, and his son, Bert 0. RainPorth, constituted per�onal property and
<br /> passed to his surviving wife, Elfleda I. Rainforth, upon the death of �Wi�lliam H. Rainforth; that the
<br /> interest of the said William H. Rainforth, deceased, in said partnership and the accounting a.s to '�he
<br /> value of' said property, as set forth �.n th� final account, is '�rue and correet and is hereby duly
<br /> approved.
<br /> 9. Bert 0. Rain�'orth and Wesley M. Rainforth are entitled �o �. Pee in -this case for their
<br /> services as administra�c�rs with will annexed of the estate of W111iam H. Rainforth, deceased, which '
<br /> fee ahall be paid one-half to each administrator. .
<br /> 10. The said William H. Rainforth, deceased, was also known a,s W. H. Ra,inforth and the said
<br /> names refer to one and the same individual, notwithstanding the discrepancy in names. Further,
<br /> the said Hert 0. Rainforth, one of the administrators herain, is also known as Ber� RainPorth, and
<br /> the said names refer �o one and the same individual, notwithstanding the discrepancy 3.n names.
<br /> 11. �aid eatate of William H. Ra.3.nforth, deceased, is not sub�eat to Federal Estate or State
<br /> Tnheritance taxes, in aecordance with the report of the appraiser, eretofore appoin'Ged herein,
