<br /> Now on thls 2nd day of November, 1949, this matter eRme on to be heard on the first and final
<br /> report and petition for final settlement of Donald L. Kutsehkau, adminis'�rator oP said estate and
<br /> for distribution of' the personal proper'�,� vf said e�tate, the assignment of real estate of said
<br /> e8tate and the evidence, and was submitted �o the oourt on consideration wh�reof, the court finds
<br /> that due and legal notice of the time and place of hearing on said final report and petition for
<br /> I'I final settlement haa been giv�n to al1 persons interested in said esta'�e, as provided by law.
<br /> Thereupon, the eourt being fully advised in the premises t'inds as follows:
<br /> 1. Tha� 4ustave A. Ku�schkau died intestate on Mareh 16, �9�+g, a resident of Hall Coun�y,
<br /> Nebraska; that he le�'t surviving him as his next of kin and heirs at law, hls widow, Cora L.
<br /> Kutschkau, oP 4rand Tsland, Nebraska, a son, LeRoy t�. B. Kutschka'�, 2119 N. Park, Grand Island,
<br /> Nebraska, a son, W31bur V. Ru�sahkau, �3i5 rt. Lafaye'��e, C#rand Ialand, Nebraska, a son, Dona].d L.
<br /> Kutschkau, �11 W. l�+th Street, Grand Ialand, Nebraska, a son, Orvls Daniel Kutschkau, Ritzville,
<br /> Washin��on, a daughter, Eloise L. Sherry, 212 E. 3rd Ave., Denver, Colorado, all oP legal a�e, and
<br /> a daughter, Betty M. Rutsahka,u, born February 23, 1g29, and a son, Melvin D. Kutschk�.u, born
<br /> Januiary 6, 1g33; that he left no other living ehildren, or the living issue oY any deceased
<br />' ehildren, and �hat the above-named per$ons are his sole and only heirs at law.
<br /> �. Tb:at on May �-, 1949, Donald L. Ku�seh�cau was app4lnted administrator of said estate,
<br /> qualified as su�h and has been acting in said aapacity ever•: sincs.
<br /> 3. Tha� due notice was given to creditors oP the time limited in which ta file clalma
<br /> against said estate, that such t3me has duly expir�d; and that all ela3ms have been paid� �Ghat
<br /> the further presentation of claima against said esta�e has been barr�d by the former order oP this
<br /> court; that there iB no inheritance ta,x due the State of Nebraska and no Pederal es�ate tax due the
<br /> United States of America.
<br /> 4. Th�t the first and final report of the ad.ministra'��r, filed herein, 1s true and correct
<br /> and should be approved and allowed as his final report; that there now remains 1n hia hands for
<br /> dis�ribution the sum of �5�0.�4; that DQnald L. Ku�schkau, administra�or her�in, is enti�led to
<br /> commission in payment of his servicea as administrator in �he amount of 25.00 doll�,rs, as provlded
<br /> by law, and Donald H. Weaver, attorney for �aid es�ate, is entitled to the sum of �175.00 dollars,
<br /> as a fee Por his services r�ndered in thia court; that the eour� aoats herein are �3.00 dollars,
<br /> leaving no cash in the hands of the adm3n3stra�or for dls�ributlon. af'�er payment o� claims.
<br /> 5. That the said Gus�ave A. Kutschkau died seized and possessed o� Lot Five (5) Block Eleven
<br /> (11) H. (�. Clark�s Addition to the city of Grarid Ieland, Hall County, Nebraska, which accordin to
<br /> Iaw desaend� and is assigned as Pollows, to-wit: Cora L. Kutschka,u, his widow, an undivided l�3
<br /> interest, and to LeRoy G. B. Kutachkau, Wilbur V. Ku�schkau, Donald L. Ku�schka,u, Or�ris Daniel
<br /> Kutschkau, Eloise L. Sherry, Betty M. Kutsehkau, and Melvin D. Kutschkau each an undivided 2/21
<br /> interest, sub,�ect to the homestead righ'Gs of the wldow, Cora L. T{utsehkau.
<br /> IT IS THEREFORE CONSIDERED, ORDERED, ADJUDQED AND DEGF�EED BY THE COURT:

<br /> in all things appr�oved and allow�d as and for his Pinal accoun� and ln Pull settlemen'� oP his trust,
<br /> and that upon Pilin� re�eipts for said amounts that said administra�or be dlscharged, and he and hls
<br /> surety released t'rom all further liabil�ty on �heir official bond.
