<br /> all respects �ust, true, and correct; due notice has heretofore been given to creditors of all
<br /> claims allowed against such estate and the court costs have been paid, to�ether with the com-
<br /> mission of the executors named in the will; .all claims not filed against such estate are barred
<br /> by lati�; a fa3.r and reasonable compensation for the administrator c.t.a. is �125.00; a fair and
<br /> reason�.bl� fee f or the attorneys f or the administrator c.t.a. is ��20.00; the devisee Otto
<br /> Falldorf has aecepted the devise of real property to him and has filed in this court proof of
<br /> payment of the chargea thereon; Lot 6, �Iock 127, in Koenig & Wiebe' s Addition to Grand Island,
<br /> Nebraska, has been partitioned and so�d in a proceeding in the District Court of Hall County,
<br /> Nebraska.
<br /> The court further finds that: all of the residuary devisees and legatees, naiaely, Henry
<br /> Falldorf, John Falldorf, Otto Falldorf, Anna Heesch, and Emma Schuller, survived the testator
<br /> Friedrien Falldorf; the life tenant Dora Fa�ldorf died Ju1y 12, i948; such Henry Falldorf died,
<br /> inte�tate , September 18, 1937, and his heirs-at-law were duly determined on March 9, 1g�9, in
<br /> tne County Court of Hamilton County, Nebraska, to be Dora Falldorf, hi$ widow, Fred Falldorf,
<br /> Harry Falldorf, Vesta Falldorf Ros�nkotter, Mabel Bartelt, Lucille Braithwaite, and Doris
<br /> Anderson, sons and daughters of such Henry Falldorf and auch Dora Falldorf; such Emma Schuller
<br /> died in�estate on Au�;ust 8, 1937, and tne administrator of her estate, now in probate in this
<br /> court, is John Schuller; such Anna Heescn died ini��state on Februar�= 23, 194�8, and the adminis-
<br /> tratrix of her estate, now in probate in this court, is Olga Reher.
<br /> The court further finds that eacn of the aaove nam�d devisees and legatees of Friedrich
<br /> Falldorf, deceased, by reason of their survival of the testator and the terms of his .will, took
<br /> an undivided one-fifth vested in�erest in the personal property belonging to such testator and
<br /> that thP word "he�rs" as used in such t,rill and the bequests to such five legatees was not used
<br /> by 'the testator in a technical sense to reatrict descent of such legacies in case of dea�h of
<br /> a,ny such legatee during the lifetime of the life tenant.
<br /> Tn.e Court further finds: that according to tile will of such dece�.e.nt the balance of monie$
<br /> remaining for distribution after payment of tne administrator� s commission and attorneys' fees,
<br /> shall 'ae distributed as follows: To John Falldorf - a one-fif.th; to Otto Falldorf - a one-fifth;
<br /> to Jonn Schu��er, adminis�rator of the estate of Emma Schuller, deeeased, - a one-fifth; to
<br /> Olga Rener, admini��ratri�r of the estate of Anna Heeseh, deceased - a one-fifth; and, to Dora
<br /> Falldorf (widow of '�enry Falldorf) - a one-�'ifteenth and to Fred Falldorf, Harry Falldorf,
<br /> Vesta Fa�ldorf Rosenkotter, Mabel Bartelt , Lucille Braitnwaite, and Doris Anderson - a one-
<br /> � forty-fifth each; that such est�.te and the interests of the heirs, devisees and legatees therein,
<br /> are not sub,�ect to inheritance tax under the laws of Nebraska.
<br /> Tne court furtner finds ttlat tne sole and only heirs-at-law of sucn Friedricn Fa3ldorf,
<br /> deceased, were: Henry Falldorf, Jon n Falldorf, Otto Falldorf, Anna Heesch, and Emma Schuller,
<br /> nis sons and daughters, and Dora Falldorf, nis widow, and the mother of all such children*
<br /> IT IS TriER�FORE, CONSTDERED, ORDERED AND DECREED B'% THE COURT that: sucn estate and the
<br /> enares of the heirs-�.t-law, devisees and legatees, is and are not sub,�ect to inheritance tax
<br /> under the laVrs of Nebraska; the final accou��c of suen administrator, c.t.a. is hereby approved
<br /> and confirmed and allowed; tne administrator with the will annexed is allowed compensatic:n for
<br /> its servicea tne surn of �l?5.00; the attorneys f'or the esta�e and ad:rninistrator are allowed the
<br /> sum of ��20.00 for their services in securing accounting from the life tenant and closing this
<br /> estate; the" sole and only heirs-at-law of such decedent were Dora Falldorf, his widow, and
<br /> Henry Falldorf, John Falldorf, Otto Falldorf, Emma Schuller, and Anna Heesch, the children of
