<br /> BE IT REMEP�iBEF�ED, th�t on. the 23rd day of Februaxy, 19�+9, E. G. Kroger, executor under the
<br /> Last Will and Testament o� ��ilhelmina Ueckert, deceased, filed in this Court, Final Account as
<br /> such executor an d a petition praying that said account be allowed, for a decree of heirship, an
<br /> order oP distribution, a finr�l settlement and discharge.
<br /> For these purposes, the 2jrd day of March, 1949, at 10 o ' clock a.m. , at the County Courtroom
<br /> in said County was assigned as the time and pZace for hearing said petition, examinin� and allow-
<br /> in� said acaount; and it was ordered that notice of the pendency of said petition be g�ven to all
<br /> persons interested in said estate by publishing such notice in the Grand Island Independent, a
<br /> legal newspaper printed in said County, for three weeks prior to said day of hearing; and it ap-
<br /> pears by proof on file that s�id notice was given as ordered by Court and that no ob,jections to
<br /> said Yinal account have been made or filed. �
<br /> Upon examination of the record and the evidenee in this matter and being duly advised in the
<br /> premises, the Court finds as follows:
<br /> FIRST
<br /> That Wilhelmina Ueekert departed this life on the lst day of August, 19�0, while temporarily
<br /> staying in the State of Wisconsin, th�.t she died testate and at the time of her death was a
<br /> resident of Hall County, Nebraska.
<br /> SECOND
<br /> That on the 6th day of October, 1940, E. G. Kroger filed in this Court an instrument purport-
<br /> ing to be the Last Will and Testament of said �rliYhelmina Ueckert, deceased, wherein said petitioner
<br /> was named executor, and a petition offering said Will for probate, and on the 6th day of August, (2)
<br /> 1940, an order of this Court was made therein assi�ning the 2�th day of August, 1940, at 10 o' clock
<br /> a.m. in thp County Courtroom in said County as the time and place for hearing said petition, proving
<br /> said Will and admitting the sarne to probate and ordering that notice c�P the pendency of said peti-
<br /> tion and hearing thereon be given to all persons ': .lnteres�ed in said ma.tter by publishing said
<br /> notice in the Grand Island Independent, a legal newspaper printed in said County, for three s�ac-
<br /> cessive weeks prior to said day of he��,ring, and it appears by proof' on file that notice of said
<br /> order was so given.
<br /> THIRD
<br /> The Court further Pinds that on the 2�th day of August, 1940, said instrument was proven,
<br /> allowed �,nd admitted to probate as the Last Wi11 and Testament of said Z�Tilhelmina Ueckert, de-
<br /> ceased, tahich Last W111 and Testament is in words as follows :
<br /> "IN THE NAME OF GOD ,AZdEN:
<br /> I, Wilh�lmina, Ueckert, being of sound m�.nd and memory, and considering the uncertainties
<br /> of this mortal liPe, do hereby make, publish and declare this my last will and testamen'�
<br /> in words and figures following:
<br /> 1. I direct that my executor pay all of my ,�ust debts, including the expenses of my
<br /> las'G sickness, death and burial, and the expense of probating my estate, as soon as can
<br /> conven3ently be done after my de�.th.
<br /> 2. I give and devise to my adopted son, Roy P�1llard Prott Ueckert, my undivided one-
<br /> half interest in my residenee property in Grand Island, Nebraska, being Lot Nine (9) in
<br /> Block Five ( 5) of Russell-��Theeler ' s Addition to the Clty of Grand Island, Nebraska, other_
<br /> wise known as 20� '�est ��h Street. A$ I have not heard from said son for several years, I
<br /> am not sure that he is living, and should he have preceded me in death, then it is my will
<br /> that my executor sell my interest in said property and reduce the same to cash, on such
<br /> terms and conditions as he sees fit, and such cash is to become a part of my residuary
<br /> est�te and pass as hereinafter provided.
<br /> 3. Unto Gustav Driewer, of Hampton, Nebraska, I give and bequeath the sum of Qne
<br /> Thousand (�1000.00) ----Dollars, to be Yiis absolute.
<br /> 4. Unto Verla Bredehoff, I give and bequeath the sum of One Thousand (�1000.00) ----
<br /> Do1l.ars, the sarne to be hers abaolute.
<br /> 5. Unto the trustees of Trinity Evangelical Lutheran Church, of Grand Island, Nebraska,
<br /> I give a,�d bequeath the sum of �1500.00, and it is my will tha.t ;�1000.00 oP this sum be
