<br /> This cau�e came on for hearing th�.s 14th da;� of January, Zg4g, upon the final report of
<br /> Rudolpn N. Kuester and The First National Bank of Gr�nd 2sland, Nebraska, executors, filed herein,
<br /> on �Tay 5, 1g4�, and upon their application for sPttlement and discharge and appointment of Truste�s
<br /> as provided in tne last ��ill and testament of said Richard M. Kuester, c�ec�a.sed.
<br /> The Court, ha.ving examined the final report, '�he records and files and being fully advised in
<br />'� the premises, finds th��t due no�ice h�.s been given to all bersons inter°ested in said estate of
<br /> the �ir�ie and �l.ace fixed for hearing upon said final report, as ordered by the cour'G, and no one
<br /> appeaxing to ob�ject to said renort, the court examined the same, together with the claims, vouchers,
<br /> and testimony in support thereof, finds , tMa� s�,id report is true and correct in a11 things.
<br /> The Court further finds tt��,t said executors on December 2�, 19��, file�I an annual report which
<br /> was �pproved by the court on December 2�, 194�, and said report is true and correct in all things
<br /> and said reports ought to be allowed and �.pproved as and for the final report of said executors.
<br /> The Court further finds th�.t said executors have filed ann�aal repor�s herein under the erroneous
<br /> assumption that they were duly appoin'�ed herein as trustees.
<br /> That the exec�.ztors and truytees are in f�.ct one and the same persons.
<br /> Trie Court �'inczs tn�t sai�� Rich�rd M. Kueater departed �his life on '�he 6th day of November,
<br /> 1940, and at the time of his dea�h was a resident and inhabitant of Hall County, Nebraska.
<br /> The Court finds that said Ricnard M. Kuester left surviving him, as his sole and only heirs
<br /> at law, the follot�ing:
<br /> Elsie Kuester, his wic�.o;a, and
<br /> Rudolph N. Kuester, a son,
<br /> both of legal �ge. .
<br /> The Court fjnds an instrument purportin� to be the last will and �estament of Richard M.
<br /> Kuester w�s filed herein, the Court fixed thP llth day of December, 19�-0, as the date f'or makin�;
<br /> proof thereon, and due notice w�,s given of the filin; of such petition and of �he time and place
<br /> fixed for hearing thereon, by the Court, as by law provided, and on said date, December 11, 1940,
<br /> said instrument was duly proven and allowed and admitted to probate as and f'or the last wi11 and
<br /> testament of s�.id Richard M. Kuester, deeeased, a,nd. letters testamentary were duly issued to
<br /> Rudolph N. Kuester and The F�.rst I�ration�,l Bank of Grand Island, Nebraska, as executors, �,nd they
<br /> thereupon quali�'ied as such.

<br /> The Court finds th�,t due and legal notice has been given as by laU� provided to all persons of
<br /> the time and place fixed by the court for the filing of claims a�ainst said estate and the time so
<br /> fixed has fully expired. �
<br /> IT TS, THEF.EF'OR�', ORDERED BY THE COURT that all persons havin� claims against said estate,
<br /> and not filed herein, i� any such there be, are forever barred and exl�luded from setting up or
<br /> assertin� a.ny such claiMS a�ainst said estate.
<br /> The Court finds that �here was no Federal Estate Tax, �hat the estate was duly appraised and
<br /> the findin s of the appraiser are izereby approved and allowed, and that the inheri'�ance tax in the
<br /> arnount of �25.�9 a,ssessed against Rudqilph N. Kuester has been paid.
<br /> The Court finds that said Richard M. KuesZer was at the 'Gime of his death the owner in fee
<br /> simple of the following described real estate:
<br /> The eas� half of tne westerly two-thirds of Lot Three (3) , in Block Sixty-f�.ve (65) of
<br /> the Original Tot�n, now City, of Grand Island, in Hall County, s�ate of Nebraska,
<br /> Lots Seven ( 7) and Eight (�;) in B1ock Eighty-seven (�7) , of the Original Town, now City,
<br /> of Grand Island, in Ha11 County, s�ate of Pdebraska,
<br /> The east half of the 3outhwest �uarter of Sectipn Thirteen (13) , in Townshlp Eleven (11)
<br /> North, Range idine (9) �Jest of the 6th P.Nt. , in ��,11 County, state oi TJebraska.
<br /> The Court finds th�t tne executors have been paid their fees in fu11 for all services herein,
<br /> �hat a reasonable attorneys � fee for closing said estate is �100.00, and tha.t exeeutors �re directed
<br /> to pa� the same.
