<br /> 6. The Court f3.nds that the mother, Clara Frances Gibson and Marie Garries of Lexington,
<br /> Nebraska, she being the s�.me and identica.l person mentioned in the petition as Marie Gibson, widow.
<br /> entered into an agreement, a signed copy of which a.ppea,rs in the files in this estate, wherein
<br /> said Marie Garries was to receive a,ll personal pro�er�y ot�med by said deceased after the paymen�
<br /> of debts and claims filed, together �rith the real esta.te in Lexington, Dawson County, Nebraska.
<br /> That the real estate has been deeded to said Marie Garries, and there remains on hand the sum of
<br /> �202.20 in cash. That out of said sum, �3�.�2 should be ��aid to the County Court of Davrson County,
<br /> Nebraska, represen�ing the bala.nce of Court costs due in said egtate, and tha,t �00.00 should be
<br /> paid to D. D. Ernat, Adminiatrator, f or his servlces herein, and the balance of �1Q6.38 should be
<br /> paid to Marie Garries and same i"s hereby assigned and set over unto her.
<br /> 7 . The Court finds that a,11 claims filed in this estate have been paid and that if any claims
<br /> now exist ti�rhich have not been filed, the sar,le should be now and forever barred. That ob,jections
<br /> were f�.led to the claim of Truppis Body and Fender Shop of Hastings, Nebraska, and said matter
<br /> s�t for hearing on Augus� 20, 1g�8, and no apr,earance was made by said clair�Ant, and therefor sa3.d
<br /> claim is disallowed.
<br /> 8. The Court finds there iq no Federal Estate tax due from said estate and there is no Sta�e
<br /> Tnheritance tax due from said estate. That notice thereof has been duly �served upon '�he County
<br /> Attorney of Dawson County, Nebrask_a, and his acknowledgement thereof is on file herein.
<br /> 9. The Court finds that an affidavit as to military service has been filed herein and �hat
<br /> none of �he persons interested in said estate are 3.n �he military service of the United States.
<br /> IT IS TF?EREFORE, CONSIDERED ADJUDGED AND DECREED BY THE COURT that the f inal report filed
<br /> herein be and the sar�e is hereby approved and a17.owed; the residence of the deceased, his death
<br /> and the time thereof; �he heirs at law of the deceased; the real estate owned by said deceased

<br /> which I may own at the time of my death, sub,�ect to the followin� conditions : that my said wife,
<br /> Elsie Kuester, shall riave the use for life of the residence property in which we now reside and
<br /> shall be paid a sum of not less tl:an eighty dolla.rs ( ��0.00) per month durir.g her lifetime for
<br />` her support, and in the event of necessity or an emergency, a larger sum than ��0.00 per month is
<br /> required for her necess�ties and comfor�, then my executors and trustees shall so provide for her, ,
