<br /> Present : Charles Bossert, County Judge.
<br /> BE IT REMEMBERED; That on the 12th day of November, 1948, Harry Bennetsen, Executor under
<br /> the L�st Will and Teatament of Christina Bennetsen, dec�ased, filed in this Court his final account
<br /> .as sueh Executor and a petition praying that said account be allowed, for a decree of heirship,
<br /> an order of diatribution, a final settlement thereon and discharge.
<br /> For these purposes, the 8th day of December, 194�8, at 10 o' clock A.M. at the County Court
<br /> Room in said County was assigned as the time and place f or hearing said netition, examining and
<br /> al.lowing said aceount; and it was ordered that notice of the pendency of aaid petition be given
<br /> to all per5ons interested in said estate by publishing such notice in the "�rand Island Independent,
<br /> a legal newspaper printed in said County, f or three �reeks prior to said day of hearing; and it
<br /> appears by proof on file that said notice was given as ordered by Court and that no ob�ectiona
<br /> to said fi.nal. account hav� been made or filed.
<br /> Upon examination of �he record and the evidenee in this mat�er and being duly advised in the
<br /> premiges, the Court finds as follows:
<br /> , FIRST
<br /> That Christ�.na Bennetsen, also known as Kyerstine Bennetsen, der�,rted this life on the 7th
<br /> day of June, 1948, in Grand Isl�.nd, Ha.11 C�unty, Nebraska, testate, and at t_he time of her death
<br /> she was a resident of Hall County, Nebraska.
<br /> SECON D
<br /> That on �he lOth day of June, 1g4�8, Harry Bennetsen filed in this Court an instrument purpor�-
<br /> ing to be the Last Will and Testament of said Christina Bennetsen, deceased, wherein sa.id petitioner
<br /> 2 wa.s named Executar, and a petition offering said Wi11 f or probate alleging that said Christina
<br /> Bennetsen departed this 11fe on June 7 , 19�8, in Hall County, Nebraska, and on the lOth day of June,
<br /> 1948, an order of this Court was made therein assi�ning the 7th day of July, 19�8, a� 10 o' c1oc�
<br /> A.M, in the County Cour� Room in said County, as the time and plaee for hearing said peti�io�},
<br /> proving said Will and admitting �he same to �robate and ordering that notice of the pendency of
<br /> said petition and hearing thereon be �iven to all persona interested in said matter by x�ublishing
<br /> said notice in the Grand Island Independent, a legal newspaper printed in said County, for three
<br /> successive weeks prior to �aid day of hearing, and it appeara by proof on file that notice oP said
<br /> order �ras so given.
<br /> THIRD
<br /> The Court further finds �ha,t on the 7th day of July, 1948, said instrument was proven, allowed
<br /> and admitted �o �robate as the Last W3.11 and Testament of the said Chris�ina Hennetsen, deceased,_
<br /> which Last Will and Testament, is, in words as folyo��s: .
<br /> THE LAST WILL OF KYERSTSTVE BENNETSEN
<br /> I, Kyers�ine Benne�sen, hereby make this my Last Will, hereby revoking all former Willa by me
<br /> mad�.
<br /> I.
<br /> I hereby appoint my son Harry Benne�sen executor of this Will and provide that he need give
<br /> no �ur'e�y� on his bond.
<br /> II.
<br /> I provide that all my �ust debtg, expenses of last illness and burial aa well as, expense of
<br /> probate of this Wi11 and administering my estate, be paid out of my personal property.
<br /> III.
<br /> My son Harry has made his home with me and I ti�rish to favor him to some extent and therefore
<br /> give, devise and bequeath unto him my home known as 61� South Elm Street in the City of Grand Island,
<br /> Nebraaka, more var�icularly described as the Northerly Thirty-three t33) feet of Lot Seven (7)
<br /> and Eight (8) in Block Nine (9) of Wiebe' s Addition to the City of Grand Island, Nebraska. Tho�e
<br /> premises are mortgaged �Go the Trustees of my husband� s estate and 3.n order to assist my said son
<br /> Harry in liquidating tha� mortgage, I further give him $1,000.00 out of my monies and investments.
<br /> 3 I further bequeath .unto him all personal property contained in said home such as furniture,
<br /> kitchen utenails, save and excepting my linen, also excepting any money or its equivalent or stocks,
<br /> bonds and other evidenee of indebtedness.
<br /> IV.
<br /> My linen which has been excepted in the preceding paragraph, I bequeath to my daughters Myrtle,
<br /> Hazel and Frieda, to be by them selected and divided as they see fit.
<br /> V.
<br /> To my daughter Hazel Runge, now living in Gunnerson Colorado, as trustee f or my grandgon Da1e
<br /> t be held b her for him until
<br /> Mason Runge, I give and bequeath Three Hundred Dollars (�300. 00) , o y
<br /> he reaches the ag� of 23 years, at which time she shall then settle and turn said money wi�h earn�d
<br /> incremen�, over to my said grandson.
<br /> VI.
<br /> As to the pr�mises known as 620 South Elm Street in the City of Gra�d Island, Nebraska, a .�art
<br /> of �he ee�ate of my deceased husband, I wigh that_ my children would sell the same to my daughter
<br /> Frieda f or Two Thousand Dollars (�2,000.00) . I realize that I do not have the pow�r to dispos� of
<br /> those premises, but hope that my children will �ake my wishes into consideration.
<br /> VII.
<br /> All the res�, residue and remainder of my estate, be �he same real�y or personal property, I
<br /> give, devise and bequeath to my daughters Myrtle Fowler, Hazel Runge and Frieda Linderl�a,mp and �qy
<br /> son Eddie Bennetsen, share and share alike and to their heirs and assign� forever.
