<br /> on the 2nd day of January 194�, the instrument purporting to be the last will and testament of
<br /> Martha Knuth deceased, was filed for probate in this Court. Tha.t on the 2�th day oP January 19�1$,
<br /> said instrument to which this eertificate is attached was duly proved, probated and allowed as th�
<br /> last will and testament of the real �.nd personal estate of said r��artha Knuth deceased, and the same
<br /> was ordered to be recorded in the records of the Court aforesaid.

<br /> Now on this 12th day of August, 19�+�, this cause car�e on far hearing upo� the final report oP
<br /> Rudolph Knuth, executor of the estate of t4artha Knuth, deceased, a.nd upon his petition �or the
<br /> allow�nce and approval of said re�ort, settlement of said estate and his discharge herein, and the
<br /> Cour� having examined the records and files and being fully advised in the premises finds that due '
<br /> and legal notice has been given to all persons of the time and place fixed by the Court for the �,
<br /> hearing upon said report, and finds th�.t said report is true and correct in all things and tha.t the
<br /> same should be approved and allowed as and for the final report of said executor, said estate set- �
<br /> tled and closed and the executor disch�,rged.
<br /> The Court further f3.nds that the said Martha Knuth departed this life December 26, 1947, and I
<br /> tha.t at the time of her death she was a resident and inhabitant of Hall County, Nebraska; that she
<br /> left survivin�; as her heirs-at-law, and only heirs-at-law, Pive children, they being Rudolph Knuth,
<br /> Emil Knuth, r�4arie Criser, Emma Schwieger and Ella Wegner; that her husband had preceded her in
<br /> death; that she left a Last Will and Testament, which was, upon the consideration of thia Court,
<br /> duly proven, allowed and admitted to probate on the 2�th day of Januar�, �94�, and letters testa-
<br /> mentary were duly issued by this Court to the said Rudolph Knuth.
<br /> The Court further finds that due and legal notice has been given to all persons of the time
<br /> and place Yixed by the Court for filing claima against the estate of the said deceased and that
<br /> the time so fixed has ful�� expired, a,nd that a11 persons having claims against the said estate and
<br /> not filed within the time limited by the Court are forever barred and excluded from setting up or
<br /> asserting any such cl�.ims against the estate.
<br /> The Court further finds that the executor has paid the ft.ineral expenses and all debts against
<br /> the estate and the costs oP these proceedings and has made distribution of the residue of the per-
<br /> son�l property of the said e�tate as under the ti�ill of the deceased provided, and nothing further
<br /> remains in his hands as execu�or belonging to said estate.
<br /> The Court further finds that the deceased was possessed at the time of her deatn as the owner
<br /> by fee simple title of the followin�-described real esta,te, to-t�rit; Lot Three (3) , Block Ten (10) ,
<br /> Kernohan and Decker' s Addition to the City of Grand Island, Hall County, Nebraska.
<br /> The Court fur�her finds that said real estate was sold by Rudolph Knuth, executor, as pro-
<br /> vided for and directed in the Last Will and Testament of the said Martha Knuth, deceased, and tha'�
<br /> the proceeds thereof have been a.ccounted for hy him.
<br /> • The Court further finc�s that said estate is not sub,ject to any inheritance tax under the laws
<br /> of the State of Nebraska or federal estate tax under the laws of the United S'tates.
<br /> IT IS, �HEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT �hat the final report of the sair�!
<br /> Rudolph Knuth, executor of the estate of T�Iartha Knuth, deceased, be, and the same hereby is, in all
<br /> things approved and allowed as and for the fin�.l report of said executor and that said estate is
<br /> hereby settled and elosed and said executor discharged.
<br /> IT IS FURTHFR ORDFRED, ADJUDGED AND DECREED BY 'P�?E COURT that all persona having claims a�ainst
<br /> said estate, if any such there--b�, are forever barred, en,�oined and excluded from settin�; up or
<br /> asserting any such claim against said estate.
<br /> IT IS FURTHER ORDERED, ADJtTDGED AND DECREED BY TuE COURT '�hat sub,ject to payment of the specia2
<br /> bequests that all of the personal property consisting of moneys in the possession of the executor
<br /> and after payment of al1 taxes, claims and administrative expenses is assigned and set over to Emil
<br /> Knuth, Rudolph Knuth, Marie Criser, Etnma Schwieger and Ella Wegner, they being the sold and only '
<br /> heirg-a.t-law of T�Iartha Knuth, deceased, in equa]. shares, to have and to hold th,e same forever.
