<br /> that notice of said order was given as ordered by thls Court.
<br /> THIRD.
<br /> The Court further finde that Herbert F. Mayer named in said petition-, was, upon hig givin�
<br /> bond in the sum of ��,000.00 as ordered by this Court, appointed Administrator as prayed; the
<br /> Court further finds that the deceased at the time of her death, was a widow, and that she left
<br /> the Pollowin� heira-at-law; Orlando L. Henaley, her son, over the age of 21 years, and that he
<br /> was her only heir-at-�aw, she having had no other children.
<br /> .FOUHTH.
<br /> That on the 2sth day of February, 19�8, an order was made herein allowing creditors three
<br /> months from and after the 24th day of March, 1948, in which to file their elaims against said
<br /> estate and said Administrator one year in which to settle said estate, and fizrther ordering that
<br />� a notice to creditors be published in the Grand Island Independent, a le�al newapaper published
<br /> and circulating in Hall County, Nebraska, for three successive weeks prior to said 2�th day of
<br /> March, 19�8, and that a hearing on claims f iled against said estate would be held at the office
<br /> of the County Judge of Hall County, Nebraska, on June 26, 19�8, at 9 o� clock A.M. , and it appears
<br /> by proof on file that noticE of said or.der r�as published as ordered by this Court.
<br /> � ' FIFTH.
<br /> The Court further finds that on the 9th day of April, 19�8, said Herbert F. Mayer as Ad.minis-
<br /> trator, filed in Court his Inventory with a copy thereof for the County Assessor of Aall County,
<br /> Nebraska, of the property of said estate, and that according to said Invent4ry, the deceased
<br /> died seised and posaessed of the following described property, to-wit :
<br /> REAL ESTATE:
<br /> Lot Three (3) and the Southerly Four (�) feet of Lot Four (�) in Block Eight (8) in Packer &
<br /> Barr� s Addition to the City �of Grand I81and, Nebraska.
<br /> CHATTEL PROPERTY:
<br /> Contract of sale dated November 28, 19�7, made by Ira R. Kirkpatrick and Clara Kirkpatrick, his
<br /> wif e, as �oint tenants, for the purchase from said decedent of Lot 5 of section 8 in Township 9
<br /> North,Range 11, West of the 6th P.M., for �3,000.00 of which �600.00 was paid upon making eaid
<br /> contract and the remaining �21�00.00 wa� paid with interest at 5� per annum at the rate of �25.00
<br /> per month commencing January l, 19�8, interest to be paid semi-annually on June lst and December
<br /> lst, on which eontract all payments due had been made u� to the time of decedent � s death.

<br /> SIX`rH.
<br /> The Court further finda that according to the laws of descent and diatrubution of the State
<br /> of Nebraska, said property, descend� entirely unto Orlando L. Hensley, he being the sole and
<br /> only heir-at-law of said decedent.
<br /> SEVENTH.
<br /> The Court further finds that the total gross value of said estate was lese than �10,000.00
<br /> and therefore sub,�ect ta no inheritance tax or Federal Estate tax whatsoever.
<br /> EIGHTH
<br /> The Court further finda that on the 26th day of June, 1948, an order of this Court was made
<br /> barring a11 claims not f iled against said estate and allowing certain el aims f iled prior thereto;
<br /> the Court further f inds that all debts and claims against said estate, including the expenses of
<br /> the last illness and burial of s�.id decedent and coats of administration in said estate, have
<br /> been fully paid and that there remains in the hands of said Ad.ministrator for distribution, the
<br /> sum of �1914.95 in cash, which sum said Administrator has paid to said Orland.o L. Hensley and
<br /> has filed his receipt thereof with this Court herein.
<br /> NINTH
<br /> The Court further finda that after deducting from the assets of said estate, all debts, clalms,
<br /> c�ata of aclminiatration and other proper expenditures and the statutory exemp�ians a1l.owed said
<br /> k�ir-at-law in said estate, there is due and payable to the County Treasurer of Hall County,
<br /> Nebraska, no inheritance tax whatsoever.
<br /> �'ENTH.
<br /> The Court further finds that the only remaining asset in the handa of said Administrator is
<br /> the contract of sale dated Rtov�mber 26, 19�7, made by xra R. Kirkpatrick and Clara Kirkpatrick,
<br /> his wife, as �oint tenante for the purchase fr�m said decedent of Lot 5 of Section 8 in Township
<br /> 9 North,Range lI, West of the 6th P.M. , more partieularly described in said Adminiatrator� $
<br /> Inventary herein filed, and that 9aid contract ahould be asgigned by said Administrator �o said
<br /> Orlando L. Hensley.
<br /> IT IS THEREFORE ORDERED, ADJUDGFD AND DECREED BY THE COURT that the final report of Herbert
<br /> � F. Mayer, Administrator herein, be and the same hereby is approved and allowed as such; that
<br /> Orlando L. Hensley is the sole and only heir-at-law of said Margaxetha Hensley, deceased, and
<br /> that the property described in paragraph Fifth hereof descends according to the laws of descent ..::..
<br /> and dietribution of the State of Nebraska as found in paragraph Sixth of this Decree; that the
<br /> contract for sale of real estate last hereinbefore described, ma.de by said Margaxetha Hensley
<br /> with Ira R. Kirkpatrick and Clara Kirkpatrick, hia wife, as ,�oint tenants, be and the same is
<br /> hereby transferred and assigned to said Orlando .L. Henaley, and �aid Herbert F. Mayer as Adminis-
<br /> trator, is hereby ordered and directed to make, execute, asaign and deliver an assignment there-
<br /> of to said �rlando L. Hensley and upon his so doing, that he be discharged as Adminiatrator, his
<br /> bond released and said eatate fully settled and closed.
