<br /> This proceeding came on for hea..ring the 7th day oP April, 19��, upon th e report of the
<br /> executor, the ob,�ectiona of Lenore Livingston, mother and next friend oP Elizabeth Ann Livingston,
<br /> a minor, and one of the legatees and devisees herein, and determination of heirship and inheritance
<br /> tax, if any.
<br /> The matter was continued by the court and this matter now on this 2�th day of July, 19�+�, comes
<br /> on further to be heard.
<br /> The Court finds that Joseph A. Livingston died, testate, on the lst day of August, 193�, and
<br /> at the time of his death was a resident and inhabitant of Ha,ll County, Nebraska.
<br /> Tl�a.t on Augua't 5, 193�, a petition was filed herein for the probate of an instrument purporting
<br /> to be the last will and testament of said Joseph A. Livingston, deceased, the Court thereupon fixed
<br /> the 27th day of August, 193�, as the date for making proof of said last will and testa.ment, and due
<br /> and legal notice of the filing of said petition and oP the time t�nd place fixed for the hearing
<br /> thereon was given by the Court in the manner provided by law, and on said date said instrument was
<br /> duly proven, allot�ed, and admitted to probate in this Court as and for the last will and testament
<br /> of Joseph A. Livingston, deceased, and letters testamentary were thereupon issued to Jamea D.
<br /> Livingston, the executor named in said will, and h e thereupon duly qualiPied as such .
<br /> T#�e Court finds that due and legal notice tlas been given to all persons of the time and place
<br /> fi�ed by the Court for filing claims a�ainat aaid estate, and that all claims �iled have 'been paid
<br /> and settled., the costs oP administration, executor� s fees and attorney� s fees have all been paid
<br /> except as may hereafter be determined.
<br /> IT IS THEREFORE ORDEftED AND ADJUDGED that all claims not filed ag�.l.nst said estate are barred
<br /> by the Statute of Non-Claim.
<br /> The Court finds that said Joseph A. Livingston left surviving him, as his sole and only heirs -2_
<br /> at law: Anna J. Livingston, surviving wi dow, a.lso named herein as Anna M. Livingston) , Peter A.
<br /> Livingston, a son, Anna Mary Livingston, a daughter, James D. Livingston, a son, Agnes Marian Living-
<br /> ston, a daughter, and Joseph L. Livingston, a son, all of whom, including Eli�abeth Ann Livingston,
<br /> a grand-daughter, are devisees and legatees.
<br /> The Court Pinds that such estate was appraised for inheritance taa as by atatute provided, and
<br /> report of the ap�raiser is filed herein and the same is approved.
<br /> IT IS ORDERED AND ADJUDGED that said estate. and the interests of the legatees and devisees
<br /> are not sub,ject to inheritance tax under th e laws of Nebraska, and no estate tax is due the United
<br /> States of America.
<br /> The Court finds that the deceased at the time of his death was the owner in fee simple title
