<br /> BE IT REP4EMBERED that on the 29th day oP March, l9�-�,HEr'oert F.Mayer, Executor under the Last Will
<br /> and Testament of Mathilda Barth, deceased, filed in this Court his Pinal account as such Executor
<br /> and a petition praying that said account be allowed, for a decree of heirship, a determination of
<br /> inheritance taxes, fees and commissions, an order oP distribution, a final �ettlernent thereon and
<br /> discharge. -
<br /> For these purposea the 21st day of April, l94�, at 10 o 'clock A.M. a'� the County Court Room in said
<br /> County was assigned as the time and place Por hearing said petition, examining and allowing said
<br /> account; and it was ordered that notice oP the pendency of said petition be given to all persons
<br /> interested in said estate by publishing such notice in the Grand Island Independent, a legal news-
<br /> paper printed in said County, for three weeka prior to said day oP hearing;and it appears by proof
<br /> on file that said notice was given as ordered by this Court and that no ob,�ections to said final
<br /> account have heen made or Yiled.
<br /> tJpon examination of the record and the evidence in this matter and being duly advised in the
<br /> premises, the Court finds as Pollows:

<br /> That Mathilda Bar�h departed tY�is life on the 21st day of October, 19�+7, in Grand Island in Hall
<br /> County, Nebraska, testat�, and that at the time oP her death she was a resident of Hall County,
<br /> Nebraska.
<br /> SECOND
<br /> That on the 24th day of Oetober, 19�+7,Herbert F.Mayer Piled in this Court an instrument purporting
<br /> to be the La,st Will and Testament oP said Marthilda Barth, deceased,wherein said petitioner was
<br /> named F�ecutor, and a petition oPfering said�iill2for probate, and on the 24th day oP October, l947,
<br /> an order of this Court was made therein a8signing the 26th day of November, 1947, at 10 o ' clock
<br /> A, M. in the County Court Room in said County as the time and place Por hearin� said petition,proving said
<br /> Will and admitting the same to probate and ordering that notiee oP the pendency of said petition
<br /> and hearing thereon be given to all persona interested in said matter by publisY�ing said no'�ice
<br /> in the arand jsland Independent, a legal newepaper printed in said County, for tht�ee s cessive

<br /> The Court further finds that on the 26th da,y oP November, 19�+7, said instrument was proven, allowed and

<br /> LAST WILL AND TESTAMENT
<br /> I, Mathilda Barth, of Grand Island, Nebraska, bein� of sound mind and disposing memory, but realizing
<br /> the uncertainty of this life, do hereby revoke all Wi115and inst8uments of a testamentax y nature
<br /> heretofore made by me, and �o hereby make,publish and declare this to be my Last Will and Testa,ment
<br /> in manner and form �ollowing:
<br /> 1.
<br /> I hereby appoint Herbert F.�iayer Execut.a.r � of this Will an� direct him to pay out of my estate all
<br /> my �ust debta and funeral ex�enaes, as well as the costs and expensea of the adminiatration of my
<br /> estate, as soon after my death as it ahall be practical.
<br /> 2.
<br /> All of my chinaware, silverware, linens and bedding, I hereby bequeath unto my nieces Martl�a��Weeks
<br /> and Alma Lassen, and it is my wish that 'Ghey give oP those things such as they may choose to each
<br /> oP my nephews and nieces as a rememberance from me, In the event that said Ma.r�ha Weeks and Alma
<br /> Lassen, choose not to keep some of it and do not ehoose to give it or any of it to said nephews
<br /> and nieces, then I euggest that they dispose thereoY by giving the same to the Salvation Army or
<br /> selling the same to a second-hand Purniture dea].er.
<br /> 3•
<br /> I hereby expressly provide that no public auetion shall be held as my home:�by said Executor,but
<br /> that all the remain��lr of my household goods and furniture be sold by him to � second-hand dealer
<br /> and �he proceeds thereoP become a part oP my eatate to be distributed as hereinafter provided.

<br /> I hereby authorize and direct my said Executor Herbert F.�ia,yer and hereby give him full poBer to
