<br /> LAST �rIILL AND TESTAMENT OF PATRICK HOYE OF WOOD RIVER, NEDRASKA.
<br /> I, Patrick Hoye of Wood River, Nebraska, being of sound and disposing mind and memory and not �
<br /> under restraint, do hereby make, publish and declare this my last will and testament, and I hereby '
<br /> revoke all former wills made by me.
<br /> First:
<br /> I give �nd bequea.th to my two grandchildren, Paul Raymond Hoye and Helen Hoye to sum of One .�
<br /> Thousand Dollars each. �
<br /> Second: �
<br /> I give, bequeath and devised to my daughter, Gertrude M. Hoye, My residence property situated
<br /> in the Village of taood River in Hal1 County, Nebraska, to-wit : Lot 12 and the Weat 35 feet of
<br /> Lot II in Block 7 in the Original Town of Wood �River to be hers absolutely and forever. �
<br /> Third:
<br /> T direct that my executor, hereinafter named, sell all real estate owned by me at the time of
<br /> my death and not herein other wise disposed of, said land to be sold not less thRn three years or
<br /> more than five yea.rs after my death, and I direct that the proceeds of gaid sale shall be equally
<br /> divided among my eh�.ldren, Daniel J. Hoye, John E. Hoye, Thomas P. Hoye, Bernard J. Boye, Anna
<br /> Hoye Mullen and Gertrude M. Hoye, the s�'iares going to Thomas P. Hoye and Bernard J. �foye to be pald
<br /> and held by Daniel J. Ho�e, Anna Hoye Mullen and Gertrude M. Hoye as Trustees however for Thomas P.
<br /> Hoye and Bernard J. Hoye �.nd to be paid by said trustees to the said Thomas P. Hoye and s�.id
<br /> Bernard J. Hoye at the rate oP not exceeding Fifty Dollars to each per month.
<br /> Fourth:
<br /> I appoint Gertrude M. Hoye guardian of above named Grandchildten.
<br /> I give and bequeath to my executor hereinafter named the sum of Five Hundred Dollars to invest
<br /> and the income there from to be ueed for the care and upkeep of my lot in the Cemetery.
<br /> Fifth:
<br /> I give and beaueath to Reverend T. D. Sullivan of Wood Riverr to sum of One hundred Dollaxs as
<br /> an ofPering for masses for the repose of my soul and the sou�o�` my wife. -
<br /> Sixth:
<br /> I give and bequeath to Reverend Father P�IcLaughlin of Shelton, Nebraska, the sum of Fifty
<br /> Dollars as an offering Por the repose of my soul and for the soul of my wife.
<br /> Seventh:
<br /> I hereby appoint my son Daniel J. Hoye as executor of this my last will and testament and ask
<br /> that he be not eequired to fur nish securety on hia bond as such.

<br /> I, Patrick Hoye hereby m�.ke the following codicil to my foregoing ��ill, to-wit:
<br /> S direct that if my son D�,niel J. Hoye should die before me T�uithout issue, tha.t his sha,re of my
<br /> estate shall revert to my est�.te and be divided equally between my other children, or their surviving
<br /> heirs : that in the event of the death of my daughter Anna or my sons John E. or Bernard J. during
<br /> my life time that the shares bequeathed to them sha.l 1 pass to their children, in equal ahares to
<br /> each; that the share bequeathed to my son Thomas P. shall pass to his children in equal shares; that
<br /> in the event of the deatY� of my daughter Gertrude M. Hoye before me that one-halP of the share
<br /> bequeathed to her shall then pass and descend to my daughter Ann and the other one-half shall pass
<br /> and deseend to my surviving children or in the event of th�ir death, to their issue, in equal sharea
<br /> to ea.ch. I revoke the first x�aragraph of my within .will.
