<br /> Now on this 7th da.y of November, 1947, at 10 0 ' clock A.M. , this matter came on to be Purther
<br /> he�rd upon the r�etitic�n for final settlement herein filed Octo'Qer 15, 19�7, upon the report and
<br /> account embra.ced tt�erein, uuon the recor�s, file5 and the evidence, �nd the court, being fully
<br /> advised in the premises, does find:
<br /> (1) That Lorett� P�ae Kosch; a resident and inhabitant of Butler County, Nebraska, died
<br /> intestate thnrein on December �7, 1g46, and that she left surviving her as her sole a.nd only heir�
<br /> at law her husband, Herm�n J. Kosch, and their six children, Paul A. Kosch, Arthur J. Kosch, Mary
<br /> Alice Kosch (nota knozn�n as Si�ter Clothaire) , Imogene R. Perkina, John J. Kosch and Cat�ierine M.
<br /> Kosch, all of whom are residents of Butler County, Nebraska, except Ma,ry Alice Kosch who resides �
<br /> in T�iil�,raukee, <<disconsin, and Imogene R. Perkins, ?tiTho is a residen'G of Palos - Park, Illinois, and
<br /> th�t all of said children �re of age exce?�t John J. Kosch and Catherine M. Kosch, both of ti�,rhom were
<br /> born Pgay 29, 1�2�.
<br /> (2) That Arthur J. Kosch was duly appointed and duly qualified as the �.dministrator of said
<br /> estate on February 13, 19�+7, and has been the duly aeting a.nd qualified administrator at all
<br /> time since. That there ca�e into tne hands of said administrator as the personal property of the
<br /> deceden�, Loretta i��ae Kosch, the aggregate sum of �9136. 73.
<br /> (3) That the time for fiZing claims ag�.inst. s�id esta.t� has expired, that no claims have been
<br /> filed a.�;ainst said estate, and that all claims not filed �gainst -s�aid estate have been duly baxred
<br /> hy the orders of this court ar�d by operatiQn of law.
<br /> (�+) The court further �inds that Loretta i�ae Kosch died seized of an undivided one-�ourth
<br /> intere�t in and to the following described real estate, to-wit :
<br /> The West 7� acres of th� North Half of the Northwest Quarter (N2Nt��) of Section Two �2) ,
<br /> To��rnshi Nine �9), North, Ra.nge Twelve �12) , and the Southeast Quarter of the �outhwest Quarter
<br /> �SE4SW4� of section Thirty-five t35), Township Ten (10) , North, Range Twel�re �12) , �.11 Zaest of the
<br /> Sixth Princip�l Meridi�n in Hall County, i�ebraska; tne Southeast Quar'ter (SE�) of Seetion Four (4)
<br /> the NorthTaest Qua.rter (Nt�) of section Ten (10) , the West Half of the Southwest Quaxter (��2SW�)
<br /> the ?^lest Half of the �orthe�st Quarter (?�T2NE�) , the East Ha1P of the Northwest Quarter (E2NW4�, a.nd
<br /> the So�ath�rest Qua.rter of the N„rthwest Quarter (SW4N"�l�) of Section Three � 3), all in Township
<br /> Fifteen (15), North, Ra.nge One �1) , East of the Sixth Princi � Meridian in Butler County, Nebraska;
<br /> and the entire interest in and to the Northwest Quarter (NW�� of Section Twenty-one �21) , Township
<br /> Sixteen (16) , North, Range Fifty-three ( 53) in Kimba.11 County, Nebraska.
<br /> (5) That there remain unpaid and unsatisfied only the expense of administr�,tion, being the
<br /> fees of the administrator taxed at �$191. 35, the Pees of tne County- Court ta.�ed at ���. 75, and the
<br /> feea of the �.ttorneya for the administrator taxed at �220.00 leavin� a balance for distribution
<br /> of ��656. 63 �nd that tne real estate and the person�.l pro�ert;� of which sa.id decedent died seiZed
<br /> descended on her death one-third thereof to her surviving husband, Herman J. Kosch, and one-ninth
<br /> thereof to each of her said surviving children, and that the personal estate should be distributed
<br /> accordingly.
<br /> (6) The court further finds that said estate descends free of a f ederal estate tax a.nd a
<br /> state inheritance tax.
<br /> trJHEREFORE, it is ordered, ad,judged and decreed that the account of the administrator rendered -
<br /> to this court be and tne sa�me is hereby approved and confirmed, and the said administrator is
<br /> directed from tne funds in his han ds, amounting to the sum of �9136.73, to pay the cost� of
<br /> ad.ministration accruing in tn.is court in the sum of �b�.75, the fees of the administrator taxed
<br /> herein at �191. 35, and the fees of the attorneys for the estate taxed herein at �220.00, and that
<br /> the remainder be distributed �2��5. �4 to �erman J. Kosch and �961. �4 to each oP the children of
<br /> said deceased. That the administrator sh�.11 take receipts for all of the disbursements ordered by
<br /> the terms of' t�iis decree and file the same herein, but that receipts need not be filed for the
<br /> administrator's fees or for the costs accrued in the County Court.
<br /> It is further ordered, �,d,�udged and decreed tha,t the real estate of which said decedent died
<br /> seized �.escended on her dea.th one-third thereof to her husband, Herman J. Kosch, and one-ninth
<br /> thereof to eaciz of her said surviving children. �
<br />� It is f�arther ordered that upon the filing of the receipts for the distribution of trze personal
<br /> est�te in the hands of th e administrator, the �dministrator shall be dischaxged �nd he and his
<br /> suretiES shall be relieved from further obligation on their bond.
