<br /> LAST T+rTILL AND TESTAnatE�1T OF ARTHALIE BEN;dINGHOVEN
<br /> I, Arthalie Benninghoven, of Grand Island, Ha11 County, Nebraska, being of sound mind and
<br /> disposing rnemory, do m�,ke and publiah this, my last wi11 and testament, by it revoking all former
<br /> wills by me made. '
<br /> FIRST -
<br /> I direct that my Executor, hereinafter named, pa.y aIl of my ,just debts, i,ncluding the
<br /> ex?�enses of my la.st sickness and death, a,nd the costs and expenses of admitting this will to
<br /> probate and administering my estate, from such personal property as I may have o� hand at the
<br /> time of my death. If that be insufficient I authorize my said Executor to sell so much of my real
<br /> estate as may be necessary for that purUoae, the within being his full and complete authority to '
<br /> make necessary deeds of transfer �aithout order from any court whatsoever.
<br /> SECOND
<br /> I direct that my Executor place on the grave in our cemetery lot at the Grand Island cemetery,
<br /> a suitable headstone at my grave. It is my wish that this headstc�ne correspond with those that
<br /> are now on said lot. �
<br /> I further direct that my Executor nay to tt�e city of Grand Island an amount sufficient to
<br /> provide for permanent care of said lot, in the event I have not, done so prior to my death.
<br /> THIRD
<br /> All the rest, residue, and remainder of my property, both real and peraonal, of whatsoever
<br /> kind and description and wherever situated, I give, devise and bequeath to my brother, Leo Stuhr,
<br /> absolutely.
<br /> FOURTH
<br /> I name, nominate, and appoint my brother, Leo Stuhr, F�ecutor of this, my last will and
<br /> testarnent.

<br /> No�a on this 19th day of November, 1g47, this cause came on for hearing upon the final report
<br /> of Leo Stuhr, executor, and upon his application for a settlement oP said estate and his discharge
<br /> and was submittec� to the Court.
<br /> The Cour'�, having examined said final report and the records and files a.nd being duly
<br /> advised in the premises, finds that due and legal notice has been given to all persons interested
<br /> in said estate of the time and place fixed for hearing upon said f inal report, as ordered by the
<br /> Court, and no one appearing to ob,ject triereto, � the Court examined the same, to�ether �aith the
<br /> receipts on file and the testimony in support thereof, and aPter being fully advised in the
<br /> premises, finds that said report is true and correct in all things and ought to be allowed and
<br /> approved as and fo-r the final re�ort of the executor.
<br /> The Court finds that Arthalie Henninghoven departed this life on June 23, 1946, and at the
<br /> time of her death was a resident and inhabitant of Hall County, Nebraska.
<br /> That on July 15, z9�+6, Leo Stuhr filed his duly verified petition herein, praying for the
<br /> allowance and probate of an instrument purporting to be the last will and testament of Arthalie
<br /> Benninghoven, deceased, the Court thereupon fixed the �th day of August, Zg46, as the date for
<br /> hearing thereon a.nd making proof of said last will and testament, due notice of the filing of said
<br /> petition and of the time and place fixed for hearing thereon was given by the Court in the manner
<br /> provided by law, and on said date, August �, 19�+6, said instrurnent was duly proven, allowed a.nd
<br /> a.dmitted to �robate as and for the last will and testament of said Arthalie Benninghoven, deceased 2.
<br /> and letters teatamentary were duly issued thereon to Leo Stuhr, executor as naxned in said will, and
<br /> he thereupon qualified as such executor.
