<br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA
<br />IN TIHE MATTER OF THE ESTATE

<br />Now on this 21st day of June, 1947 this cause came on for hearing upon the petition of Thomas
<br />F. O'Ka.ne praying for a settlement of the estate of said deceased, for a determination of the
<br />heirs, and the right of descent of her real estate, and the degree of kinship of her heirs at law,
<br />and for a decree settling her estate.
<br />And it appearing to the Court from the TDroof on file that legal notice had been given by
<br />publication for three successive weeks as provided by law and the order of this Court to all of the
<br />heirs and other hers ^ns interested in said estate of the filing of said Petition and of the time
<br />and -place fixed for hearing thereon, and there being no objections thereto, this cause was duly
<br />submitted to the Court upon the Petition and the evidence in support thereof, and the Court being
<br />fully advised finds that the allegations in said Petition are true; that Thomas F. O'Kane, the
<br />petitioner, is one of the bresent owners of the real estate described herein, and is a competent
<br />person to prosecute t'._11is proceeding; that the said Anna M. O'Kane departed this life at Huston,
<br />Texas on September 9, 1943, and at the time of her death she was a resident of Huston, Texas, and
<br />that she wqs the owner in fee simple title of ttie following described prop..erty, to -wit:
<br />Lot Three (3) and the West Eleven (11) feet of Lot Two (2) in Block Seventeen (17) in the Town of
<br />Mood River, Hall County, Nebraska.,
<br />end that more than two years have elapsed since her death; that no application has ever been made
<br />in the State of Nebraska. for the appointment of an administrator, and no Petition has been filed
<br />for that purpose, and no administration has been had upon the estate of Anna M. O'Kane, deceased.
<br />The Court further finds that the said Anna M. O'Kane left surviving her as her heirs -at -law and
<br />only heirs -at -law the following -named persons, to -wit:
<br />Daniel O'Kane, her husband, residing at Houston, Texas
<br />Thelma B. Stockton, a daughter, residing at Houston Texas
<br />Thomas F. O'Kane, a son, the petitioner herein, residing at Fort Worth, Texas,
<br />and the following -named children.' being the sole heirs of Josephine F. Doherty, deceased daughter
<br />of Anna M. O'kane, who died November 9, 1923, the mother of the following children, to -wit:
<br />Irma L. Welsh, a daughter
<br />Helen A. Brown, a daughter
<br />Dorothy F. Hellbusch, a daughter
<br />Kathleen A. Christensen, a daughter
<br />John D. Doherty, a son
<br />Jack F. Doherty, a son.
<br />The Court further finds that under the law of the State of Nebraska in force at the time of
<br />the death of Anna M. O'Kane, the real estate herein described did pass and descend by absolute
<br />title as follows:
<br />Daniel O'Kane, surviving husband, an undivided 1/3 thereof;
<br />Thelma. B. Stockton, a, daughter, an undivided 2/9 thereof;
<br />Thomas F. O'Kane, a, son, an undivided 2/9 thereof;
<br />Irma L. Welsh, a grandaughter, an undivided 1/27 thereof;
<br />Helen A. Brown, a. granddaughter, an undivided 1/27 thereof;
<br />Dorothy F. Hellbusch, a granddaughter, an undivided 1/27 thereof;
<br />Kathleen A. Christensen, a granddaughter, an undivided 1/27 thereof;
<br />John D. Doherty, a grandson, an undivided 1/27 thereof;
<br />Jack F. Doherty, a grandson, an undivided 1/27 thereof.
<br />The Court further finds that the funeral expenses of the deceased have been fully paid; that
<br />all debts of the deceased and of her estate if any such existed are forever barred and precluded,
<br />and that the costs of this proceeding has been paid.
<br />It is therefore ordered, adjudged, and decreed by the Court that Anna M. O'Kane died instestate
<br />at Houston, Texas on the 9th day of September, 1943; that more than two years have el apsed since
<br />her death; that no application for administration has ever been had in the State of Nebraska, and
<br />that said deceased was the owner of
<br />Lot Three (3) and the West Eleven (11) feet of Lot Two (2)'in Block Seventeeen (17) in the Town
<br />of Wood River, Hall County, Nebraska; that the petitioner herein is a competent person to prosecute
