NO. 9 HALL COUNTY <br />Lot One (1) in Block Sixteen (16) of H. G. Clark's Addition to Grand Island in Hall County, Nebraska, <br />and chattel property of the approximate value of $7500.00. <br />The Court further finds that according to the terms, conditions and provisions of the Last <br />',Till and Testament of said deceased, the sum of $100.00 was bequeathed to the City of Grand Island <br />for the perpetual upkeep of the cemetery lot of said testatrix, which legacy has been paid by <br />said Executrix as shown by receipt of said legatee on file with this Court; that the sum of <br />$500.00 was bequeathed unto the grandchildren and great grandchildren of said testatrix living at <br />the time of her death, to be divided equally among them, and the remainder of said estate was <br />devised and bequeathed share and share alike unto Chris Haack, Amanda Barker, Minnie Voss, Ernest <br />Haack, John Haack and William Haack, in fee simple absolute, they being the heirs --at -law of said <br />testatrix. <br />SIXTH <br />The Court further finds that on the 18th day of July, 1947, an order of this Court was made <br />allowing the claim of Citizens Mutual Fire Assessment Insurance Association of Grand Island, <br />Nebraska, in the sum of $6.29 against t«is estate and barring the filing of any other claims <br />against this estate and excluding the holders thereof from setting up or asserting any such claims <br />against said estate. <br />SEVENTH <br />The Court further finds that at the time of the death of said testatrix, there were 24 <br />grandchildren and great grandchildren of said testatrix in esse, they being the following named <br />persons: <br />Ralph Haack a grandson James Mitchell a great granddon <br />Myrtle Middaugh a granddaughter Louisa Wise a great granddaughter <br />Frances Ensley a granddaughter Susan Wise a great granddaughter <br />Esther Haack la granddaughter Thomas Wise a great grandson <br />Frank Haack a great grandson Eleanor Gimple a granddaughter <br />Robert Haack a great grandson Mabel Haack a granddaughter <br />Charlotte Ensley a great granddaughter William Haack, Jr. a grandson <br />Milton Barker a grandson Donald Haack a grandson <br />Glen Barker a grandson Dolores Paulson a granddaughter <br />Gordon Haack a grandson Gloria Mae Paulson a great granddaughter <br />Roma Mitchell a granddaughter Lorraine Trace a granddaughter <br />Annetta Mae Mitchell a great granddaughter Roberta Trace a great granddaughter <br />of whom the following are minors; <br />Esther Haack Susan Wise <br />Robert Haack Thomas Wise <br />Charlotte Ensley Donald Haack <br />Annetta Mae Mitchell Gloria Mae Paulson <br />James Mitchell Roberta Trace <br />all of the others being over the age of 21 years; that Chris Haack and Maud Haack are the parents <br />of said Esther Haack, a miner; that Doris Haack Schaumann is the sole surviving parent of said <br />Robert Haack, a minor; that Frances Ensley and Glover C. Ensley are the parents of said Charlotte <br />Ensley, a minor; that Roma Mitchell and James M. Mitchell are the parents of said Annetta Mae <br />Mitchell and James Mitchell, minors; that Louisa Wise and Donald E. Wise are the parents of said <br />Susan Wise and Thomas Wise, minors; that William Haack is the sole surviving parents of said <br />Donald Haack, a minor; that Dolores Paulson and Harland Paulson are the parents of said Gloria Mae <br />Paulson, a minor; that Lorraine Trace and Robert Trace are the parents of said Roberta Trace, a <br />minor; and that pursuant to the provisions contained in Section 35 -122 of the Revised Statutes of <br />Nebraska, 1943, the bequests to said minors are payable by said Executrix to said respective <br />parents of and for said minors. <br />EIGHTH <br />The Court further finds that all claims against said estate, including costs of administration <br />hereof and expenses of the last illness and burial of said testatrix have been fully paid by said <br />Executrix and that the final report is correct in all respects and should be approved and allowed; <br />that since the filing of said report, said Executrix has made full and complete distribution of <br />said estate according to the terms and provisions of said Last Will and Testament and has filed <br />with this Court receipts showing such distribution in full, and that she has made full and complete <br />settlement of said estate; that the value of the real estate belonging to said decedent at the <br />time of her death was $4415.00 and that said estate and said legatees and devisees thereof <br />accordingly are subject to the payment of no inheritance tax herein whatsoever to the Treasurer of <br />Hall County, Nebraska, under the laws of this State. <br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of Minnie <br />Voss, Executrix, be and the same is hereby approved and allowed as such; that the property <br />described in paragraph Fifth hereof, was devised and bequeathed according to the terms and <br />H <br />and the said Minnie Voss named in said Will, was appointed Executrix thereof upon her furnishing <br />bond in the sum of $94000.00 as ordered by this Court, which bond was furnished and approved; <br />the Court further finds that said Antje Iyiagdalena Haack, at the time of her death, was a widow, <br />and that she left the following heirs -at -law and only heirs -.at -law, to -wit: Chris Haack, William <br />Haack, Ernest Haack and John Haack, her sons, and Minnie Voss and Amanda Barker, her daughters, <br />there being no predeceased children of said testatrix nor children of any predeceased children <br />her surviving, all of said heirs being over the ago of 21 years. <br />FOURTH <br />The Court further finds that on the 20th day of March, 1947, an order of this Court was made <br />allowing creditors 3 months from and after the 16th day of April, 1947, in which to file their <br />claims against said estate and said Executrix one year in which to settle said estate, and <br />further ordering that notice to creditors be published in the Grand Island Independent, a legal <br />newspaper published and circulating in Hall County, Nebraska, published and circulating in Hall <br />County, Nebraska, for three successive weeks prior to the 16th day of April, 1947, and that a' <br />hearing on claims filed against said estate, would be held at the office of the County Judge of <br />Hall County, Nebraska, on the 19th day of July, 1947, at 9 o'clock A.M. , and it appears by proof <br />on file that notice of said order was so Uublished as ordered by this Court. <br />FIFTH <br />The Court further finds that on the 22nd day of March, 1947, said Minnie Voss, Executrix of <br />said estate, filed in this Court her inventory of said estate, and that according to said <br />inventory, the deceased died seized and possessed of the following described property, to -wit: <br />Lot One (1) in Block Sixteen (16) of H.
