275 .3 <br />NO. 9 HALL COUNTY <br />h <br />Now on this 6th day of August, 1947, this cause came on for hearing upon the Final Report of <br />Henry Lohmann and Fred Loescher, executors of the estate of Wilhelm Lohmann, deceased, and upon <br />petition of said executors for the allowance and approval of said Report, settlement of said estate, <br />and their discharge herein, and the court having examined the records and files herein and being <br />fully advised in the premises, finds that due and legal notice has been given to all persons of <br />the time and place fixed by the court for the hearing upon said Report, and further finds that <br />said Report is true and correct in all things and that the same ought to be approved and allowed as <br />and for the Final Report of said executors, said estate settled and closed, and the executors <br />discharged. <br />The court further finds that all funeral expenses of said deceased have been paid and that all <br />debts against the estate and cost of these proceedings have been paid, and that there is no <br />personal property to be distributed and that nothing further remains in the hands of the executors <br />belonging to said estate. <br />The court further finds that the estate is not subject to an inheritance tax under the laws of <br />the State of Nebraska or to a federal estate tax under the laws of the United States. <br />The court further finds that at the time of his death the said Wilhelm Lohmann was the owner <br />of real estate described as Lot Six (6), Block Four (4), of H. G. Clark's Addition to the City of <br />Grand Island, Hall County, Nebraska, and of the South Half of the Northwest Quarter (S -gNW4), less <br />railroad right -of -way, and part of the Northwest Quarter of the Southwest Quarter (NASA) and part <br />of the Northeast Quarter of the Southwest Quarter (NE�SWU all in Section Six (6), Township Eleven <br />(11), North, Range Eight (8), west of the 6th P.M., Merrick County, Nebraska, containing 96.21 <br />acres more or less; that under the provisions of said Will of Wilhelm Lohmann, deceased, his wife, <br />Maria Lohmann is granted the right to sell and convey the real estate described as Lot Six (6), <br />Block Four (4�, of H. G. Clark's Addition to the City of Grand Island, Hall County, Nebraska, on <br />such terms as she sees fit and to use the proceeds of such sale for her support and maintenance, <br />she to be the sole judge as to the necessity for such sale; that until such sale the said Maria <br />Lohmann is given and devised a life interest in all of the real estate hereinabove- described, and <br />upon the termination of her life estate all of the real estate hereinabove- described, including <br />such as she has a right to sell, if the same has not been sold during her lifetime, shall be sold <br />by Henry Lohmann and Fred Loescher, executors, within two years after the death of Maria Lohmann <br />and reduce the same to cash on such terms and conditions as they may deem best without obtaining <br />an order or license from any court or judge, and to divide the net cash proceeds into four equal <br />parts and dividing the same amoung the four children in equal shares. <br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the Final Report of Henry <br />Lohmann and Fred Loescher, executors of the estate of Wilhelm Lohmann, deceased, be, and the same <br />hereby is, in all things approved and allowed as and for the Final Report of said executors, and <br />said estate is hereby settled and closed and the executors discharged, subject, however, to their <br />compliance with the terms and provisions of the Last Will and Testament of Wilhelm Lohmann relative <br />to the sale of real estate upon the termination of the life estatq created and division of the <br />proceeds among the heirs entitled thereto under the terms and conditions of the Last Will and <br />Testament of Wilhelm Lohmann, deceased. <br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that all persons having claims against <br />said estate, if any such there be, are forever barred, enjoined and excluded from setting up or <br />asserting any such claim against said estate. <br />IT IS FURTHER OR DERED, ADJUDGED AND DECREED BY THE COURT that all of the real estate owned <br />by the deceased at the time of his death be, and the same hereby is, transferred pursuant to the <br />terms and conditions and provisions of the Last Will and Testament of Wilhelm Lohmann, deceased. <br />STATE OF NEBRASKA) <br />ss. <br />HALL COUNTY ) <br />MATTER OF THE ESTATE OF <br />in said Court, that the <br />record; that said Court <br />said Court has no Clerk <br />custodian of said Seal <br />due form of law. <br />Charles Bossert <br />County Judge. <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA ' <br />CERTIFICATE <br />I, Charles Bossert County Judge of Hall County, Nebraska, do hereby <br />certify that I have compared the foregoing copy of Last Will and <br />Testament, Certificate of Probate of Will and Final Decree -IN THE <br />WILHELM LOHMANN, DECEASED, with the original record thereof, now remaining <br />same is a correct transcript thereof, and of the whole of such original <br />Is a Court of Record having a seal., which seal is hereto attached; that <br />authorized to sign certificates in his own name, and that I am the legal <br />3.nd of the Records of said Court, and that the foregoing attestation is in <br />IN TESTIMONY WHEREOF I have hereunto set my hand and affixed the seal of the County Court, at <br />Grand Island, this 6th day of August, 1947- <br />Charles Bossert <br />(SEAL) County Jud <br />Filed for record the 7 day of August, 1947 at 10 o'clock A.M. D <br />Register of Deeds. <br />ti <br />The <br />court further finds that the said Wilhelm Lohmann departed this life on December 21, 1944, <br />and that <br />at the time of his death he was a resident and inhabitant of Hall County, Nebraska; that <br />he left <br />surviving him as his heirs -at -law and only heirs -at -law his wife, Maria Lohmann, and four <br />children, <br />they being Nettie Gross Strahan, Henry Lohmann, Olga Loescher, and Hala Guenther; that <br />he left <br />a Last Will and Testament, which was by the consideration of this court duly proven, <br />allowed <br />and admitted to probate on March 5, 1947, and Letters Testamentary were duly issued by <br />this court <br />to the said Henry Lohmann and Fred Loescher on the estate of Wilhelm Lohmann, deceased. <br />The <br />place fixed <br />court further finds that due and legal notice has been given to all persons of the time and <br />by the court for filing claims against said estate and that the time 0.0 fixed has fully <br />expired, <br />and that all persons having claims against said estate and not filed within the time <br />limited <br />by the court are forever barred and excluded from setting up or asserting any such claim <br />against <br />said estate. <br />The court further finds that all funeral expenses of said deceased have been paid and that all <br />debts against the estate and cost of these proceedings have been paid, and that there is no <br />personal property to be distributed and that nothing further remains in the hands of the executors <br />belonging to said estate. <br />The court further finds that the estate is not subject to an inheritance tax under the laws of <br />the State of Nebraska or to a federal estate tax under the laws of the United States. <br />The court further finds that at the time of his death the said Wilhelm Lohmann was the owner <br />of real estate described as Lot Six (6), Block Four (4), of H.
