<br />In witness whereof, I have hereunto set my hand and affixed the seal of the County Court, this

<br />That on the 4th day of December, 1946,; said Fred Hongsermeier filed with this Court his
<br />declination to his appointment as Executor under said Will, and requested the Court to appoint
<br />William E. Hongsermeier Administrator with Will Annexed in this estate; that thereupon said William
<br />E. Hongsermeier was appointed Administrator with said Will Annexed of this estate upon his furnishing
<br />bond in the sum of $7500.00 as ordered by this Court, which bond was furnished and approved; the
<br />Court further finds that said Anna Marie Hongsermeier, at the time of her death, was a widow and that
<br />she left the following heirs -at --law and only heirs -at -law, to -wit: Fred Hongsermeier, Alber#A.
<br />Hongsermeier, Henry W. Hongsermeier, Charles Hongsermeier and William E. Hongsermeier, her sons, and
<br />Lena Turley, ''#ugftpta Horst and Marie Spiehs, her daughters; also Harold Ahrens, a grandson, he
<br />being the only child of Emma Ahrens, a predeceased daughter of said testatrix.
<br />FOURTH
<br />The Court further finds that on the 4th day of December, 1946, an order of this Court was
<br />made allowing creditors three months from and after the second day of January 1947, in which to
<br />file their claims against said estate and said Administrator one year in which to settle $aid- estate
<br />and further ordering that notice to creditors be published in the Grand Island Independent, a legal
<br />newspaper published and circulating in Hall County, Nebraska, for three successive weeks prior to
<br />the second day of January, 1947, and that a hearing on claims filed against said estate would be held at
<br />the office of the County Judge of Hall County, Nebraska, on the 4th day of April, 1947, at 9 o'clock
<br />A.M., and it appears by proof on file that notice of said order was published as ordered by this Court.
<br />FIFTH
<br />The Court further finds that on the 17th day of December, 1946, said William E. Hongsermeier,
<br />as Administrator with Will Annexed, filed in this Court his inventory of the property of said estate,
<br />and that according to said inventory, the deceased died seized and possessed of the following
<br />described property, to -wit: page 5
<br />Lots Two (2), Three (3) and Four (4) and the Southeast Quarter of the Southwest Quarter (SEjSWj),
<br />all in Section Twelve (12), Township Ten (10) North, Range Nine (9), in Hall County, and
<br />North Half of the Northeast Quarter (N*NEJ) of Section Thirteen (13) in Township Ten (10) North,
<br />Range Nine (9), in Hall County, Nebraska
<br />Also chattel property of the approximate value of $6100.00.
<br />The Court further finds that according to the terms, conditions and provisions of said Last
<br />Will and Testament of said deceased, said property was devised and bequeathed as follows: Unto
<br />Harold Ahrens, grandson of said testatrix, the sum of Two Hundred Dollars ($200.00), the balance of
<br />said estate, share and share alike, unto, Augusta Horst named in said Will as Auguste Horst, Lena
<br />Turley, Marie Spiehs named in said Will as Marie Hongsermeier, Fred Hongsermeier, Albert A.
<br />Hongsermeier named in said Will as Albert Hongsermeier, Henry W. Hongsermeier named in said Will
<br />as Henry Hongsermeier Charles Hongsermeier and William E. Hongsermeier named in said Will as
<br />William Hongsermeier, said eight residuary devisees and legatees all being children of said
<br />testatrix and they as well as said Harold Ahrens, being over the age of 21 years.
<br />SIXTH
<br />The Court further finds that on the 4th day of April, 1947, an order of this Couert was made„
<br />allowing the claim of Marie Spiehs in the sum of $1500.00, and barring the filing of any and all
<br />other claims against said estate and excluding the holders thereof from setting up or asserting
<br />any such alaims against said estate.
<br />SEVENTH
<br />The Court further finds that all claims against said estate, including the costs of adminis-
<br />tration hereof, have been fully paid by said administrator; that the value of the real estate be-
<br />longing to said testatrix at the time of her death, was.of the sum of $14,750.00 and that the final
<br />report is correct in all respects and should be approved and allowed; that there remained in the
<br />hands of said Administrator the sum of $3,607.42 for distribution according to the terms and prov-
<br />isions of said Last Will and Testament and that distribution thereof has so been made by said
<br />Administrator since the filing of said report with this Court, receipts showing such distribution
<br />being on file with this Court, and that said disposition of said estate accordingly has been
<br />completed and that there is due and payable to the County Treasurer of Hall County, Nebraska, no
<br />inheritance tax herein whatsoever. page 6
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of William E.
<br />Hongsermeier, Administrator With Will Annexed herein be and the same is hereby approved and allowed
<br />as such; that Anna Marie Hongsermeier was in truth and in fact the testatrix who signed, sealed,
<br />published and declared her Last Will and Testament in the name of Marie Hongsermeier, a copy whereof
<br />is hereto included in this decree; that Albert A. Hongsermeier is the real and true name of Albert
<br />Hongsermeier named in said Will; that Henry W. Hongsermeier is the real and true name of the Henry
<br />Hongsermeier named in said Will; lihat Marie Spiehs is one and the same person as the Marie Hongser-
<br />meier named in said Will; that Augusta Horst is the real and true name of Auguste Horst named in said
<br />Will; that William E. Hongsermeier is the real and true name of the William Hongsermeier named in
<br />said Will; that the property described in paragraph Fifth thereof was devised and bequeathed according
<br />to the terms and conditions of said Last Will and Testament unto the persons named in said paragraph
<br />Fifth hereof; that there remains no assets of said estate in the hands of said Administrator, he
<br />having made full distribution thereof and filed receipts showing such distribution with this Court,
<br />and that he therefore hereby is discharged, his bond released and said estate fully administerred,,.
<br />settled and closed.
