<br />WILL AND DECREE RECORD
<br />Thirty -eight (38) in Russel Wheeler's Addition to the city of Grand Island, in Hall County, state
<br />of Nebraska, and not the entire fee as described in the inventory.
<br />The Court further finds that said Margaret Sagesser left surviving her the following heirs at
<br />law:
<br />Bertha Phelps, daughter,
<br />Ella Sagesser, daughter,
<br />Edward Sagesser, son,
<br />Henry Sagesser, son,
<br />Mabel Patterson, daughter,
<br />Albert Sagesser and Frederick Sagesser, grandsons, and Ellen Sagesser Shoe-
<br />maker, granddaughter, sons and daughter of Herman Sagesser, a deceased son,
<br />That the Court finds that the aforesaid are the sole and only surviving heirs at law of Margaret
<br />4:45 o'clock P.M. �"X�
<br />Sagesser, deceade,d, and that they are all of legal age.
<br />The Court further finds that said estate was not subject to inheritance tax under the laws
<br />of the state of Nebraska.

<br />The Court further finds that all claims filed against the estate have been paid, that all the
<br />costs and expenses of administration have been paid. including attorney's fees; that due and legal

<br />notice has been given to all persons of the time and place fixed for filing claims against said
<br />estate, and that such time has fully expired, and that all persons having claims against the estate
<br />of Margaret Sagesser, deceased, if any such there be, and not filed herein, are forever barred and
<br />excluded from setting up or asserting any such claims against said estate.
<br />The Court finds that said administratiix has accounted for all receipts and disbursements,
<br />that she has made distribution of all personal property to the said heirs at law under the laws
<br />of descent of the state of Nebraska, and the receipts of such heirs at law are herein filed, and
<br />that there remains no personal property in the hands of the administratrix.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED THAT the final report of Ella Sagesser, ad-
<br />ministratrix of the estate of Margaret Sagesser, deceased, be, and the same is hereby approved and
<br />allowed as and for her final report, and said estate is hereby settled and closed.
<br />The Court further finds that the real estate hereinbefore described passed and descended,
<br />under the laws of descent of the state of Nebraska, upon the death of said Margaret Sagesser, to
<br />Bertha Phelps, Ella Sagesser, Edward Sagesser, Henry Sagesser, and Mabel Patterson, sons and
<br />daughters, an undivided one -sixth interest to each; and to Albert Sagesser, Frederick Sagesser,
<br />and Ellen Sagesser Shoemaker, an undivided 1 /18th interest to each.
<br />IT IS, THEREFORE, ADJUDGED AND DECREED that the real estate described as follows:
<br />An undivided one -third interest in and to Lot Nine (9) in Block Thirty -eight (38) in
<br />Russel Wheeler's Addition to the city of Grand Island, in Hall County, state of Nebraska,
<br />passed and descended, under the laws of descent of the state of Nebraska, upon the death of said
<br />Margaret Sagesser, deceased, to Bertha Phelps, Ella Sagesser, Edward Sagesser, Henry Sagesser,
<br />and Mabel Patterson, an undivided one -sixth interest to each; and to Albert Sagesser, Frederick
<br />Sagesser and Ellen Sagesser Shoemaker an undivided 1 /18th interest to each.
<br />IT IS FURTHER ORDERED AND DECREED that the time for filing claims against said estate has
<br />fully expired, and that all persons, if any such there be, having claims against said estate, and
<br />not filed herein, are forever barred and excluded from setting up or asserting any such claims
<br />against said estate.

<br />Now on this 9th day of July, 1947, this cause came on for hearing upon the Final Report of
<br />John Bushmann, Administrator of the Estate of the said Helena Fuss, deceased, and upon hearing said
<br />application for the approval and allowance of said report, settlement of said estate, and his
