Favinger, Substitute and Acting County Judge, in and for said County, do hereby certify that on this 16th day of December, A.D. 1943, the instrument purporting to be the last will and testament of the said Chester J. In the matter of the estate ) of )ss. ESTATE N0. 3784 Ruth M. Chew, Deceased. ) FINAL DECREE. This matter came on for hearing this 27th day of June, 1947, upon the final report and petition o Ellen M. Jacoby, administratrix, for settlement and distribution of the estate of Ruth M. Chew, 1t�es, and the evidence. The Court finds that; such decedent died December 3 -1 1946; due and legal notice of the time and place of hearing on such final report and petition has been given to all persons interested in such estate as provided by law; due notice has been given to creditors; all claims allowed against such estate have been paid and satisfied; the final report and accounting of such Administratrix is, in all respects, just, true, and correct; there remains for distribution the sum of $236.33 and the personal property which the heirs at law have elected to take in kind, and the real property here- inafter described; such estate and the respective interests of the heirs at law of such decedent are not subject to inheritance tax by the state of Nebraska. The Court further finds that such decedent died intestate and left surviving her as her sole and only heirs at law; no husband; Marie M. Burtle, and Ellen M. Jacoby, her daughters, who are respectively more than 21 years of age. IT IS, THEREFORE, CONSIDERED, ORDERED AND ADJUDGED that; such estate and the respective in- terests of the heirs at law of such decedent are not subject to inheritance tax by the state of Nebraska; such Ruth M. Chew died intestate leaving surviving as her sole and only heirs at law her daughters Marie M. Burtle and Ellen M. Jacoby; the real property of which such deceased died seized, namely: Fractional Lot Four (4) in Fractional Block Fifty -three (53) in Packer & Barris Second Addition, and, Fractional Lot Four (4) in Fractional. Block Twelve (12) in Baker's Addition, both additions to the city of Grand Island, all in Hall County and state of Nebraska, subject to encumbrance to The Equitable Building and Loan Association for approximately $3000.00. is assigned to the above determined heirs at law in equal shares; the balance of monies belong- ing to such estate and the personal property are assigned to such heirs -at -law in equal shares h and in kind; the final account of suc administratrix is approved, confirmed and allowed; and upon such administratrix filing in this court receipts for payment of claims and expenses and for distribution of such balance of monies and personal property to such heirs at law in equal shares, such Admi,nistratrix shall be discharged from her trust as administratrix of such estate, and the sureties on her official bond released.
