<br />FINAL DECREE
<br />BY IT REiEI4BERED on this 24th day of June, 1947, this matter carte on to be heard upon the
<br />special application of the executors herein and approval of the report and motion to enter final
<br />decree as to the special property hereinafter described; the court being fully advised in the
<br />premises finds that the complete final decree involving all of the ;prop =rty is not ready at this
<br />time due to the necessity of creating a. trust created by the will and tila.t the property hereinafter
<br />described was willed and bequeathed to C. Loyd Lienhart and is the only property situated in Hall
<br />County, Nebraska. This decree is solely for the purpose of making assignment of the said property to
<br />C. Loyd Lienhart in accordance with the terms of the last will and testament so that the title
<br />on the said property may be cleared without any delay to the said C. Loyd Lienhart irregardless of
<br />the delay on the trust -provisions in completing this estate.
<br />The court finds that Chester J. Lienhart departed this life on November 11, 1943 and at the
<br />Cite was a resident of Hastings, Adams County, Nebraska; that his last will and testament, a copy
<br />of which is attached hereto, is made a mart hereof was duly admitted to probate all in accordance
<br />with the laws of the state of Nebraska; that the same is the last will and testament of the said
<br />deceased.
<br />That the said Chester J. Lienhart died seized of the Southwest Quarter of Section 35, Township
<br />11, Range 12, Hall County, Nebraska, together with other property in Nebraska; that all the expense
<br />of administration has been raid; that all claims, debts of every kind, nature and description have
<br />been paid; that the Federal Estate Tax on the said estate has been paid; that the Nebraska Inheritance
<br />Tax has been paid by the said C. Loyd Lienhart and that the mortgage on the laced above described 2.
<br />has been paid by the Estate of Chester J. Lienhart, all in accordance with the order of this court
<br />previously entered. That there is no lien of any kind, nature or description against the land
<br />above described as relating to the Estate of Chester J. Lienhart.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that the Southwest Quarter of Section 35, Town-
<br />ship 11, Range 12, Hall County, Nebraska be and the same is hereby assigned to C. Loyd Lienhart,
<br />P-11 in accordance with the terms of the last will and testament of Chester J. Lienhart; that all
<br />claims of t'ile estate have been paid; that all Federal and Nebraska Estate and Inheritance Taxes
<br />have been paid; that the mortgage on the said land has been ;.paid by the Estate of Chester J. Lien-
<br />hart in accordance with the previous order of this court; that no lien or claim of any kind on be-
<br />half of the Estate of Chester J. Lienhart exists against the above described real estate; that
<br />the final decree as to the other real estate and personal property of the estate be entered at such
<br />tiite as the trust created in said estate is commenced.
