<br />the option of the Trustee, in the event of a disagreement as aforesaid, said trust may be terminated.
<br />In an and and all events, said trust shall terminate ten years after my death.
<br />4 The said Trustee shall pay the net income of my estate during the duration of this trust
<br />to the same persons and in the same proportions as the corpus would be distributed, in the event
<br />the corpus were to be distributed at the time of the payment of the net income.
<br />5. Upon the termination of this trust, the Trustee shall have full power and authority to sell
<br />at public or private sale, as to him seems best, all assets of the trust, both real and personal,
<br />and divide the proceeds thereof as follows: one -half part thereof to my daughter, Juanita Redfern,
<br />and one - fourth part thereof to my grandson, Paul W. Ruple, and one — fourth part thereof to my grand-
<br />daughter, Phyllis Ruple; subject, however, to the conditions and limitations hereinafter set forth:
<br />(a.) In the event my daughter, Juanita Redfern, shall die either before I do or after my death,
<br />prior to the termination of the trust, then her interest in my estate shall not lapse, but shall pass
<br />and descend to such persons as would inherit her estate in the event she died intestate, unless she
<br />shall make a last will and testament, in which event her interest in my estate shall pass and
<br />descend to the persons who would be entitled thereto under the terms of said last will and testament,
<br />In the event she were the owner thereof in fee simple absolute at the time of her death.
<br />(b), In the event either of my two grandchildren, Paul W. Ruple or Phyllis Ruple, shall die
<br />either before I do or after my death prior to the termination of the trust, leaving issue, then the
<br />interest of said person so dying shall not lapse, but shall pass to said issue by right of
<br />representation. But in the event either of them shall die either before I do or prior to the
<br />termination of the trust, without issue, then the interest of said person so dying in my estate
<br />shall pass to the other surviving of my two said grandchildren.
<br />(c) In the event both of my said granchildren shall die before I do or prior to the termination
<br />of the trust, without issue, then the interest of both of said grandchildren in my estate shall
<br />lapse and shall then pass and descend to my daughter, Juanita Redfern, and to her heirs forever and
<br />the trust shall thereupon terminate.
<br />(d) On the termination of the trust, the persons entitled to the corpus thereof shall have
<br />a prior option to buy any of the real estate of which I may die Possessed at the same price as is
<br />elsewhere obtainable.
<br />FIFTH
<br />In the event prior to the termination of the trust, the said trustee shall die or resign or for
<br />any reason be d4squa.lified to act, then my daughter, Juanita Redfern, and the then County Judge of
<br />Hall County, Nebraska., shall have full power and authority to name a successor trustee, who shall
<br />have the same powers as herein granted to the said Edward Huwaldt.
<br />The said trustee shall furnish bond only to the extent of the reasonable rental value of the
<br />estate for the period of one year. In the event he shall under the powers granted in this will
<br />conclude to sell any of the real estate, he shall first give notice to the County Judge of Hall
<br />County, Nebraska, who shall thereupon fix an additional bond.
<br />SIXTH
<br />I hereby nominate, constitute and appoint Edward Huwaldt to be the Executor of my last Will
<br />and Testament. My said Executor shall have full power and authority to sell, convey, mortgage or
<br />otherwise lien so much of the real estate of which I may die possessed a.s shall be necessary to
<br />pay my just debts, funeral expenses and expenses of administering my estate, and to that end shall
<br />have full power and authority to make, execute and deliver such deeds of conveyances, mortgages or
<br />other papers as shall be necessary to carry out this power.

<br />I, Charles Bossert, Judge, of the County Court, in and for said County, do hereby certify that
<br />on the 5th day of Ai)ril 1946, the instrument purporting to be the last will and testament of Hans
<br />P. Hansen deceased, was filed for probate in this Court. That on the lst day of May 1946, said
<br />instrument to which this certificate is attached was duly proved, probated and allowed as the
<br />last will and testament of the real and personal estate of said Hans P. Hansen deceased, and the
<br />same was ordered to be recorded in the records of the Court aforesaid.
