<br />STATE OF NEBRASKA) At a session of the County Court held in and for said County of Hall in
<br />SS the State of Nebraska, this 11th day of June, 1947, Present:Charles Bossert,
<br />COUNTY OF HALL ) County Judge. BE IT REMEMBERED: that on the 19th day of May, 1947, Anita
<br />Stoltenberg, Administratrix With Will Annexed of the Estate of Fred Thomssen
<br />deceased, filed in this Court her final account as such Administratrix and a petition praying that
<br />said account be allowed, for a decree of heirship, an order of distrubiton, a final settlement
<br />thereon and discharge.
<br />For these purposes, the 11th day of June, 1947, at 10 o'clock A.M. at the County.Court
<br />Room in said County was assigned as the time and place for hearing said petition, examining and
<br />allowing said account, and it was ordered that notice of the pendency of said petition be given to
<br />all persons interested in said estate by publishing such notice in the Grand Island Independent, a
<br />legal newspaper printed in said County, for three weeks prior to said day of hearing, and it
<br />appears by proof on file that said notice was given as ordered by Court and that no objections to
<br />said final account have been made or filed.
<br />Upon examination of the record and the evidence in this matter, and being duly advised in
<br />the premises, the Court finds as follows:
<br />FIRST
<br />That Fred Thomssen departed this life on the 22nd day of May, 1946, in Hall County, Nebraska
<br />testate, and at the time of his death he was a resident of Hall County, Nebraska.
<br />SECOND
<br />That on the 29th day of June, 1946, Anita Stoltenberg filed in this Court an instrument
<br />purporting to be the Last Will and Testament of said Fred Thomssen, deceased, wherein Bertha
<br />Thomssen was named Executrix, and a petition offering said Will for probate, alleging that said
<br />Fred Thomssen departed this life on May 22, 1946, and that said Bertha Thomssen wife of said page 2
<br />Fred Thomssen, deceased, preceded him in death, and on the 29th day of June, 1946, an order of this
<br />Court was made therein assigning the 24th day of July, 1946, at 10 o'clock A.M. in the County Court
<br />Room in said County as the time and place for hearing said petition, approving said Will and
<br />admitting the same to nrobate, and ordering that notice of the pendency of said petition and hearing
<br />thereon be given to all persons interested in said matter by publishing said notice in the Grand
<br />Island Independent, a legal newspaper printed in said County, for three successive weeks prior to
<br />said day of hearing, and it.appears by proof on file that notice of said order was so given.
<br />THIRD
<br />The Court further finds that on the 24th day of July, 1946, said instrument was proven,
<br />allowed and admitted to probate as the Last Will and Testament of said Fred Thomssen, deceased,
<br />which last Will and Testament is in words as follows, to -wit:
<br />THE LAST WILL OF FRED THOMSSEN
<br />I, Fred Thomssen, of Hall County, Nebraska, make this my Last Will hereby revoking all
<br />former `rills.
<br />I hereby appoint my wife Bertha Thomssen executrix of this Will without bond.
<br />To my said wife Bertha Thomssen, I give and devise all my property, real estate and personal
<br />property for and during the term of her natural life. I also grant unto her the right and the power
<br />to sell or exchange or convey by deed or otherwise any and all of the property which I leave her
<br />and shw shall not account to any person, Court of Judge for the proceeds of such sale, exchange or
<br />transfer and she shall have the right to use such proceeds in any way she may see fit.
<br />All rights and power granted to my wife shall be exercised by her without interference on
<br />the part of any person, Court or Judge and at no time shall she be required to ask leave or
<br />license to make such sale, conveyance or transfer.
<br />In the event that she does not fully exercise said power on all my real estate then the
<br />rest and residue of my real estate not transferred by her, I give and devise to my daughter Anita
<br />Stoltenberg and to her heirs forever.

<br />The foregoing was at the date thereof signed, sealed published and declared by said testator as and
<br />for his Last Will in our presence and we in his presence and at his request and in the presence of
<br />each other have signed our names as witnesses hereof.

<br />In the Matter of the Estate of Fred Thomssen, deceased, I Charles Bossert, Judge of the County
<br />Court, in and for said County, do hereby certify that on the 29th day of June, 1946, the instrument
<br />purporting to the last will and testament of Fred Thomssen, deceased, was filed for probate in this
<br />Court. That on the 24th day of July, 1946, said instrument to which this certificate is attached
<br />was duly proved, probated and allowed as the last will and testament of the real and personal
<br />estate of said Fred Thomssen, deceased, and the same was ordered to be recorded in the records of the
<br />Court aforesaid.
<br />In witness whereof, I have hereunto set my hand and affixed the seal of the County Court,
<br />this 24th day of July, 1946.

<br />and said Anita Stoltenberg was appointed Administratrix with said Will Annexed upon her furnishing
<br />bond in the sum of $1,000.00 as ordered by this Court which bond was furnished and approved; the
<br />Court further finds that said Fred Thomssen at the time of his death, was a widower, his wife
<br />Bertha Thomssen, having preceeded him in death, and that he left the following heir -at -law and only page 4
<br />heir -at -law, to -wit: Anita Stoltenberg, his daughter, who was over the age of 21 years.
