<br />WILL AND DECREE RECORD
<br />26081 —The Augustine Co., Grand Island, Nebr.
<br />BE IT REMFMBTRED, that on the 11th day of April, 1947, Ida Springsguth, Executrix of the
<br />Estate of Hans Jacob Ruge, filed in this Court her final account as such Executrix and a petition
<br />nra.ying that said account be allowed, for a decree of heirship, an order of distribution, a
<br />final settlement thereon and discharge.
<br />For these purposes, the 8th day of May, 1947, at 10 o'clock A.M. at the County Court Room in
<br />said County was assigned as the time and place for hearing said petition, examining and. allowing
<br />said account; and. it was ordered that notice of the pendency of said petition be given to all
<br />persons interested in said estate by publishing; such notice in the Grand Island Independent, a
<br />legal newspaper )rinted in said County, for three Meeks prior to said day of hearing; and it
<br />appears by proof on file that said notice was given as ordered by Court and that no objections to
<br />said final_ account have been made or filed.
<br />Upon examination of the record and the evidence in this matter and being duly advised in the
<br />premises, the Court finds as follows:
<br />FIRST
<br />That Hans Jacob Ruge, departed this life on the 19th day of October, 1946, at his home in
<br />Grand Island, Hall County, Nebraska, testate, and at the time of his death he was a resident of
<br />Hall County, Nebraska..
<br />SECOND
<br />That on the 25th day of October, 1946, Ida Springsguth filed in this Court an instrument
<br />purporting to be the Last Will and Testament of said Hans Jacob Ruge, deceased, *�rherein said
<br />petitioner was named Fxecutrix, and a petition offering said 'Mull for probate, alleging that said
<br />Hans Jacob Ruge departed this life on October 19, 1946, in Hall County, Nebraska., and on the 25th
<br />da of October, 194-6, an order of this Court r,ras made therein assigning the 20th day of November,
<br />19+6, at 10 o'clock A.M. in the County Court Room in said County as the time and'nlace for hear -
<br />ing said petition, proving said. Will and admitting the same to probate and. ordering that notice of
<br />the pendency of said petition and hearing thereon be given to all persons interested in said
<br />matter by publishing said notice in the Grand Island Independent, a legal newspaper printed in
<br />said County, for three successive weeks prior to said day of hearing, and it appears by proof on
<br />file that notice of said order was so given.

<br />The Court farther finds that on the 20th day of November, 1946, said instrument rags proven,
<br />allowed. ::end. 9,dmitted to nrob,ate as the Last Will and Testament of said Hans Jacob Ruge, deceased,
<br />which Last Ti1ill and Testament is in T,,rords as follows:
<br />LAST WILL AND TESTAMENT
<br />I, Hans Jacob Ruge, of Grand. Island, Nebraska being of sound mind and disposing memory, do
<br />hereby make, publish and declare this my Last Will and Testament, hereby revoking all former
<br />?dills by me made, in words as follows:
<br />1.
<br />I hereby ;apT)oint my niece Ida. Springsguth, Executrix of this Will and direct that she pay
<br />out of my estate, rill my just debts, including the expenses of my last illness and burial, and
<br />I.he cost of erection at my grave, of a marker duly inscribed.
<br />2.
<br />To my brother Johan Ruge, from whom I have not heard in many years, I give nothing, nor do
<br />I give anthing to my niece Anna Hansjosten of Chapman, Nebraska.

<br />I hereby bequeath the sum of Five Hundred Dollars ($500.00) to my niece Eliza Kuhll Boersen
<br />who lives on Route 4, Grand Island, Nebraska, on condition that she file or make no claim against
<br />my estate of any nature whatsoever, and. further on condition that she make no attempt to contest
<br />this Will; I have made settlement with her at the time of my leaving her home for all things that
<br />she had done for me un to that time. In the event that she file any claim whatsoever a.gdinst my
<br />estate or attempt to assert any claim or in any way attempt to contest this Will, in that event,
<br />I bequeath said Eliza Kuhll Boersen nothing; whatsoever.
<br />4.
<br />Ali the rest residue and. remainder of my estate, both real and personal, wheresoever
<br />situated, I hereby devise and. bequeath unto my niece Ida. Springsguth, to her and to her heirs
<br />forever.
<br />Dated at Grand Island, Nebraska, this 20th day of April, 1946.

<br />We whose names are hereunto subscribed, do hereby certify that Hans Jacob Ruge, the Testator, he
<br />then being of sound mind and under no compulsion, subscribed his name to the foregoing instrument
<br />In our presence and in the presence of each of us, and. at the Same time and in our presence and
<br />hearing, declared the same to be his Last Will and Testament, and we at his special instance and
<br />request and, in his presence and in the presence of each other, have hereunto subscribed our
<br />names as attesting witnesses.

<br />on the 25th day of October, 1946, the instrument purporting to be the Last Will and Testament of
<br />Hans Jacob Ruge, deceased, T,,Ta.s filed, for probate in this Court. That on the 20th day of November,
<br />1946, said instrument to which this certificate is attached was duly proved, probated and allowed as
<br />the last will and testament of the real and personal estate of said Hans Jacob Ruge, deceased, and
<br />the same was ordered to be recorded in the records of the Court aforesaid.
