<br />WILL AND DECREE RECORD
<br />26081—The Augustine Co., Grand Island, Nebr.
<br />report, as ordered by the Court, and no one appearing to object to said final report, the Court
<br />examined the same, together with the vouchers on file and the testimony in support thereof, and
<br />supplement thereto, and being duly advised in the premises, finds that said reports are true and
<br />correct in all things and ought to be allowed and approved as and for the final report of the
<br />executors.
<br />The
<br />Court finds that all of the devisees and legatees having an interest in said estate have
<br />executed
<br />approval of said report and supplenfent to the final report, all of which are filed here-
<br />with.
<br />The
<br />Court finds that Claus Rohweder died on the lst day of May, 1936, and at the time of his
<br />death was
<br />a, resident and Inhabitant of Hall County, Nebraska.
<br />The
<br />Court finds that Albert N. Rohweder and Arthur Henne Filed herein their duly verified
<br />petition,
<br />praying for the allowance and probate of instruments purporting to be the last will
<br />and testament
<br />& codicil thereto of Cla.us Rohweder, deceased; that the Court thereupon fixed the
<br />26th day
<br />of May, 1936, as the date for making proof of said. last will and testament & codicil
<br />thereto,
<br />and due notice of the filing of said petition and of the time and place fixed for hearing
<br />thereon was given by the Court in the manner provided by law, and on said date, May 26, 1936, said
<br />Instruments
<br />were duly proven, allowed and admitted to nrobate as and for the last will and
<br />testament
<br />& codicil of said Claus Rohweder, deceased, and letters testamentary were duly Issued
<br />thereon to
<br />Arthur Henne and Adolph Seier, executors as named in said codicil and they thereupon
<br />qualified as such.
<br />The
<br />Court finds that due and legal notice has been given as by law provided to all persons of
<br />the time
<br />and place fixed by the Court for the filing of claims against said estate and that the time
<br />so fixed
<br />has 'fully expired.
<br />IT IS. THEREFORE, ORDERED BY THE COURT that all nQrsons having claims against said estate,
<br />and not filed herein, if any such there be, are forever barred and 'excluded from setting up or
<br />asserting any such claims against said estate.
<br />The Curt finds that all claims filed herein have been paid or settled, that the personal
<br />property has been distributed as by law and order of this Court provided. That there was no
<br />inheritance tax to be naid.
<br />The Court finds that Alma Rohweder, named as one of the devisees and legatees In the last
<br />will and testament of said Claus Rohweder, deceased, departed this life during the year 1919,
<br />leaving no issue surviving her.

<br />The Court finds that the property of said Claus Rohweder, deceased, was bequeathed and devised,
<br />subject to certain legacies, to his twelve children as a class, and that the Interest of Alma
<br />Rohweder, as T)rov Ided In said last will and testament, passed under said last will and testament,
<br />to the remaining eleven children, share and share alike.
<br />The Court finds that said Claus Rohweder at the time of his death was seized as the owner
<br />in fee simple of the following described real estate:
<br />Lot One (1) in Block Ninety-three (93) in the original Town, now City, of Grand Island, In Hall
<br />County, Nebraska,
<br />Lot Three (3) in Block One Hundred Three (103) in Koenig & Wiebe's Addition to the City of
<br />Grand Island, in Hall County, state of Nebraska,
<br />The Northwest quarter and the south half o the northeast quarte%a?dthe.northwest quarter f the

<br />and that said real'ostate was devised under the last will and teatafti.•ont of gaid CUuo Rohweder,
<br />deceased, to Albert N. Rohweder, Claus August Rohweder, sons, and Emma Seier, Dora Boettcher,
<br />Adelia Otto, Catherine 3chirkofsky, Maggie Thesenvitz, Lillie Rohweder Henne, Tony Roh,,,reder
<br />Lockenvitz, Frieda Rohweder Gossman, and Olga Rohweder Paustian, daughters, share and share allke,�'
<br />The Court further finds that there remains in the hands of the executors a certificate of
<br />title No. 1780-307, Loan No- 711, issued by the Grand Island Trust Company, which certificate
<br />shows that the Claus Rohweder estate is the owner of a part of the real estate involved, to-wit,,
<br />a. 40 /135th interest, said real estate being described as follows:
<br />The northwest auarter of Section 13, Township 18 North, Range 13 West 6th P.M., in Sherman
<br />County, Nebraska, and west half of northeast quarter and northwest quarter of Section 16, Town-
<br />ship 15 North of Range 12 West, in Howard County, Nebraska;
<br />that the certificate of title represents a. first mortgage loan in the amount of $13,500-00
<br />executed by Peter Johansen and wife, and that the Claus Rohweder Estate participates to the
<br />extent of $4000.00. That the executors have been unable to liquidate the participation certificate
<br />for a reasonable SUM.
<br />IT IS, THEREFORE, ORDERED BY THE COURT that Lloyd W. Kelly be, and he is hereby appointed
<br />trustee, upon furnishing a bond in the amount of $4000.0o, to hold said certificate and to
<br />liquidate the same, and that when said trustee has qualified, the executors shall assign the
<br />aforesaid certificate to said trustee, and he, the said Trustee, upon liquidation of said
<br />certificate, will.. make report to the court for an order of distribution.
<br />IT IS, THEREFORE, ORDERED AND DECREED BY THE CURT that the final report and supplement
<br />thereto of Arthur Henne and Adolph Seier, executors, be, and the same is hereby, approved and
<br />allowed as and. for their final report, said estate is hereby settled and closed and said executors
<br />discharged, and their bond is hereby released.
