<br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA.
<br />In the matter of the estate ) ESTATE N0. 3812

<br />Arthur L. Barnebey, Deceased. ) D E C R E E
<br />This matter came on for hearing the 5th day of March, 1947, upon the petition of
<br />Frances Ann Barnebey, and was submitted to the Court.
<br />The Court, after being fully advised in the premises, and, after due and careful
<br />consideration; finds that: legal notice of this proceeding has been given to all persons inter-
<br />ested, both creditors and heirs, as required by law; the allegations of such petition are true;
<br />such Arthur L. Barnebey died :intestate on June 16, 1941, a resident of Hall County. Nebraska;
<br />such decedent died more than two years previous to the filing of the petition herein; and was,
<br />at the time of his death, seized as owner in fee of a right, title, and interest in the following
<br />described real property situated in Hall County and the State of Nebraska, to -wit:
<br />Lots One (1), Two (2), Three (3), Four (4), and Five (5) in Block fix (6).. Third Addition to
<br />Cairo; Lot Four (4) in Block Ten (10), Original. Town of Cairo; Lots Five (5), Six (6), Seven (7),
<br />and Eight (9) in Block Seven (7), Original Town of Cairo.
<br />`.' The Court further finds that; no administrator has been appointed in Nebraska for the
<br />estate of such decedent; no decree of heirship ha.s been entered in the estate of such decedent;
<br />such deceased left him surviving, as his sole and only heirs at law, the following named-person3;
<br />Frances Ann Barnebey, his widow; Ruby Barnebey, Leonard Barnebey, Lela. McAllister, Ethel Barnebey,
<br />Hoyt Barnebey, Zella Rickard, Pauline Grossman, and, Walker Barnebey, the daughters and sons of
<br />such deceased and Frances Ann Barnebey, his wife, all of whom are more than 21 years of age.
<br />The Court further finds that the right, title and interest of such deceased in the
<br />real property hereinbefore described descended in proportions as follows: to the widow an
<br />undivided one- third; to the children above named an undivided one- twelfth each.
<br />IT IS, THEREFORE, CONSIDERED, DETERMINED AND ADJUDGED that the right, title, and
<br />interest of such decedent in the real property hereinbefore described, descended as follows:
<br />to Frances Ann Barnebey and undivided one- third; to Ruby Barnebey, Leonard Barnebey, Lela
<br />McAllister, Ethel Ba.rnebey, Hoyt Barnebey, Zella Rickard, Pauline Grossman, and Walker Barnebey,
<br />an undivided one- twelfth each.
<br />IT IS FURTHER CONSIDERED AND ADJUDGED that all claims or demands against the estate
<br />of Arthur L. Barnebey, deceased, whether due or to become due, whether absolute or contingent,
<br />shall be and the same hereby are forever barred.
