<br />rea es ate herein set out descended, at the time of the death of Marie B. Overturf, deceased,
<br />to her father, Allen L. Overturf:
<br />S. This estate is not subject to the payment of either federal or state inheritance taxes.
<br />9. The said Marie B. Overturf, deceased was also known as B. Marie Overturf, and whenever
<br />it appears that way it refers to one and the same individual, notwithstanding the discrepancy
<br />in names.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the aforesaid final report,
<br />filed herein by Allen L. Overturf, administrator of the estate of Marie B. Overturf, deceased,
<br />be and the same is hereby in all things approved, confirmed and allowed as and for the said
<br />administrator's final report, the said estate is settled and closed, the administrator is discharged
<br />and the surety on his official bond is released from any further liability in said matter.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that no claims have been filed
<br />against this estate; that all expenses for the last illness and funeral of the said Marie B.
<br />Overturf, deceased, have been paid in full; that all other expenses of said estate, including
<br />court costs, publicaticn fees ane attorneys fees of Paine& Pamine, Attorneys, have been paid in
<br />full; that all persons having claims against said estate, not filed within the time fixed by
<br />the Court, if any such there be, are forever barred, excluded and enjoined from setting up or
<br />asserting any claths whatsoever against said. estate.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that Marie B. Overturf passed away
<br />on the 21st day of August, 1946, intestate, being at that time a citizen and a resident of Hall
<br />County, Nebraska; that she left surviving her as her heirs -at -law, and sole and only heirs -at-
<br />law, the following, who are all more than twenty -one years of age, namely:
<br />Allen L. Overturf, father, of Grand Island, Nebraska.; Wayne H. Overturf. a brother, of Omaha,
<br />Nebraska; Wendell A. Overturf, a brother, of Los Angeles, California; C. Nadine Overturf, a
<br />sister, of Grand Island, Nebraska; Denice Overturf Geddes, a sister of Grand Island, Nebraska;
<br />that the said Marie B. Overturf, deceased. was a single woman at the time of her decease, she
<br />was never married, she did not leave surviving her any husband or children, and her mother,
<br />Jennie L. Overturf, predeceased her in death on the 9th day of July, 1939.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that all of the real estate owned
<br />by the said Marie B. Overturf, deceased, at the time of her death, of which the deceased died
<br />seized and possessed,to -wit:
<br />Lot Five (5) in Block One Hundred Twenty -seven (127) in Union Pacific Railway Company's Second
<br />Addition to the City of Grand Island, Hall County, Nebraska;
<br />did descend at the time of her death, and passed by fee simple title absolute, under and by
<br />virtue of the Statutes of Descent of the State of Nebraska, in full force and effect at the
<br />time of the death of Marie B. Overturf, deceased, to her father, Allen L. Overturf, and distribut-
<br />ion thereof is hereby accordingly made.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that the said Marie B. Overturf,
<br />deceased, was also known as B. Marie Overturf, and that the said Marie B. Overturf and the said
<br />E. Marie Overturf ig one and the same person, notwithstanding the discrepancy in names.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that this estate is not subjuct to
<br />the payment of either federal or state inheritance taxes.
