Schultz, deceased. ) FINDING HEIRSHIP AND <br />ORDERING DISTRIBUTION <br />Now on this 14th day of January, 1947, this cause came on for hearing on final *report of the <br />executor and his petition for discharge and decree of heirship. <br />ON CONSIDERATION WHEREOF, the court doth find that due and legal notice of the hearing of said <br />petition and hearing on said final account has been given as provided by law and order of this <br />court. <br />On examination of the final report, the court loth find that -the same is in due form and is <br />correct and the same should be and is hereby approved and allowed as final report of the executor. <br />This cause coming on further to be heard on the petition for decree of heirship and order of <br />distribution, the court doth find that Mary V. Schultz died testate, a resident, citizen and <br />inhabitant of Scotts Bluff County, Nebraska; that all her property under her Last Will and Testa- <br />ment goes and descends to her only son, Lester G. Schultz. The court further finds that said Mary <br />V. Schultz left surviving her no widower and left surviving one son, Lester G. Schultz and left <br />surviving no other children or issue of deceased children; that said Lester G. Schultz is the <br />sole and only heir at law and next of kin of said Mary V. Schultz, deceased. - <br />The court further finds that the estate of said Mary V. Schultz is of such value that there <br />will be no tax payable to the State of Nebraska under the State Inheritance Tax law or the State <br />Estate tax law and that there will be no taxes of any kind on said estate under the estate tax <br />laws of the State of Nebraska and that said estate is not of sufficient value to be subject to <br />any Federal estate or inheritance tax. <br />The court further finds that all claims against the estate have been paid, having been paid <br />by the executor from his own personal funds and the executor personally waives any lien on the <br />real estate by reason of said bills. <br />IT IS HEREBY ORDERED AND.DECREED that any and all claims not filed and allowed by the court <br />be and the same are hereby forever barred. <br />The court further finds that all personal property of the deceased, including one Ford car, <br />goes and descends to Lester G. Schultz and said Lester G. Schultz as executor, is hereby ordered <br />and directed to make proper and necessary assignments of the title of said car to himself as an <br />individual. The court further finds that all the real estate of which the deceased died seized, <br />by and under the terms of the will of the deceased, goes and descends to said Lester G. Schultz <br />said real estate including an undivided one -third interest in and to the southwest Quarter (SWU <br />of Section Six (6), Township Ten (10) Range Eight (8), Hamilton County 3 Nebraska, and an undivided <br />one -third interest in and to Lot One M. on Main land in Section One tl), Township Ten (10) North, <br />Ran a Nine (9),Hall County, Nebraska and all of the Southeast Quarter of the Southwest Quarter <br />(SESW4) and the Southwest Quarter of the Southeast Quarter (SW4SE4) of Section Four (4), Township <br />Twenty -three (23) North,Range Fifty -seven (57),West of the 6th P.M, in Scotts Bluff County,Nebraska, <br />and any and all other real estate of which the deceased died seized or in which he had an interest. <br />The court further finds that all costs of administration save and except attorney fees have been <br />paid in full to the court. <br />IT IS THEREFORE ORDERED AND DECREED; that the final account of the executor be and. the same is <br />hereby approved and allowed, <br />IT IS FURTHER DECREED that Mary V. Schultz died testate, leaving as her sole and only heir at <br />law and next of kin, her son, Lester G. Schultz. <br />IT IS FURTHER DECREED that all personal property of every kind, nature and description goes and <br />descends to said Lester G. Schultz, including the Ford car and that all real estate, being the <br />real estate hereinbefore described, together with any and all other rea2 estate, goes and descends <br />by and under the terms of the will of said Mary V. Schultz to said Lester G. Schultz. <br />Ted R. Feidler <br />(SEAL) County Judge <br />LAST WILL AND TESTAMENT OF MARY V. SCHULTZ <br />I, Mary V. Schultz, of Morrill, Scotts Bluff County, Nebraska, do hereby make, publish and <br />declare this to be my last will and testament, that is to say. <br />1. I direct my executor hereinafter named to pay all my just debts including the expenses of <br />my last sickness and funeral. <br />2. It is my wish and desire that I be buried by the side of my late husband, Ludwig H. Schultz <br />in the cemetery known as Forest Lawn Cemetery near the village of Morrill, Nebraska, and I direct <br />that my executor as soon as conveniently possible erect at my grave a memorial similar in kind, <br />quality and appearance as the memorial now erected at my late husband's grave. <br />3. If, at the time of my death I have not already paid to the Cemetery Association or Board <br />having control of said maintenance of the cemetery lot on which my late husband is buried and in <br />which I desire to be buried, then I direct my executor hereinafter named from the funds of the <br />estate to pay sufficient to insure perpetual upkeep and maintenance of said lot and graves located <br />thereon. <br />4. All the rest and residue of my property of every kind, nature and description, whether now <br />
