WILL AND DECREE RECORD
<br />28081 —The Augustine Co., Grand Island, Nebr.
<br />and place fixed by the Court for filing claims against said estate; that all persons having
<br />claims against said estate not filed within the time fixed by the Court, if any such there be,
<br />are forever barred and precluded.
<br />The Court further finds that said Michael Fanning left surviving him as his heirs -at -law and
<br />only heirs -at -law the following named persons, to -wit: Margaret Fanning, a sister; Kate Fanning,
<br />a sister; and Alta Mae Steele, a niece; the sole surviving child and heir -at -law of Mary Fanning
<br />Steele, a deceased sister of Michael Fanning, deceased.
<br />The Court further finds that the said Michael Fanning was never married; that his father and
<br />mother preceeded him in death; that he left no other heirs -at -law except the above —nA"d persons.
<br />The Court further finds that the deceased died the owner of personal property and real estate
<br />described as follows:
<br />The North Half of the Southwest Quarter (NJ SWJ) of Section Twenty -Two (22),
<br />Township Eight (8), North, Range Ten (10), West of the 6th P. M-in Adams
<br />County, Nebraska..
<br />The South Half of the Northwest Quarter (Si NWJ) and the East Half of the
<br />Southwest Quarter (E* SW4) of Section Fifteen (15); the North-West Quarter
<br />(NWJ) of Section Thirty -three (33), all in Township Nine (9), Range Ten (10),
<br />West of the 6th P. M. in Hall County, Nebraska, and
<br />Lots One (1) and Two (2) in B1ock.One (1) in Burger's Addition to the Village
<br />of Doniphan, Hall County, Nebraska,
<br />and that said real estate did pass and descend by reason of the Statutes of descent of the State
<br />of Nebraska to Margaret Fanning, Kate Fanning, and Alta Mae Steele in equal sharesto each.
<br />The Court further finds that the administrator has collected all of the assets of said estate
<br />and has paid all claims filed against said estate; that said estate was duly appraised for
<br />inheritance tax under the laws of the State of Nebraska; that the inheritance tax assessed against
<br />said estate in the sum of $324.85 has been paid; that the administrator has on hand the sum of
<br />$4029.83; that the said sum should be distributed equally between Margaret Fanning; Kate Fanning,
<br />and Alta Mae Steele, after deducting from the respective shares the amount of the inheritance tax
<br />as assessed against the respective shares as shown by the report of the appraiser filed herein.
<br />The Court further finds that said estate is not liable for inheritance tax under the laws of
<br />the United States.
<br />The Court further finds that notice of the filing of the Final Report of said administrator
<br />was given to all persons interested in said estate as provided by law; that no objection is filed
<br />to the allowance of said report; that the Court,. having examined said report, finds that the same
<br />is correct and should be approved and allowed.
<br />The Court further finds.that the funeral expenses and the expenses of the last illness and
<br />other . debts of said deceased have been paid; that the Court costs herein have been paid.
<br />IT IS THEREFORE ORDERED, ADJUDGED, AND DECREED BY THE COURT that all persons having claims
<br />against said estate, if not filed, are barred and precluded.
<br />IT IS FURTHER ORDERED, ADJUDGED, AND DECREED BY THE COURT that the real estate above described,
<br />to -wit:
<br />The North Half of the Southwest Quarter (Na SWJ) of Section Twenty -Two (22),
<br />Township Ei fit (8), North, Range Ten (10) , West of the 6th P. M. in Adams
<br />County, Nebraska.
<br />The South Half of the Northwest Quarter ( S* NWT-) and the East Half of the
<br />Southwest Quarter (EJ SWJ) of Section Fifteen t15); the North West Quarter
<br />(NWT) of Section Thirty -three (33), all in Township Nine (9), Range Ten (10),
<br />West of the 6th P. M. in Hall County, Nebraska, and
<br />Lots One (1) and Two (2) in Block One (1) in Burger's Addition to the Village
<br />of Doniphan, Hall County, Nebraskat
<br />did pass and descend at the death of Michael Fanning, to his sisters, Margaret Fanning and Kate
<br />Fanning, and to his niece, Alta Mae Steele in equal shares to each.
<br />IT IS FURTHER ORDERED, ADJUDGED, AND DECREED BY THE COURT that the final Report of B. J.
<br />Cunningham, administrator,.be and the same hereby is, approved and allowed as and for his Final
<br />Report and thatsaid estate is hereby settled and closed, and said admistrator dischared, and his
<br />bond released.
