<br />human life, do now make and publish this my LAST WILL AND TESTAMENT: That is to

<br />and Real Estate property, Bonds Stocks and whatever property I may have at my
<br />death.

<br />presence of each of us, and declared at the same time, in our presence and hearing

<br />Attached is certificate of probate by the County Judge of Lancaster County,
<br />Nebraska, dated August 19, 1946, under Seal.
<br />February 15, 1945, filed the verified petition of Harry McConnell showing to the court that he is
<br />owner in fee of Lot 34 of Frank P. Bark's Subdivision No 3, Grand Island, Nebraska;
<br />that Frank Mills, a resident of Landaster County, Nebraska, died testate therein
<br />July 18, 1938, leaving a last will and testament, dated February 22, 1921, filed
<br />in this court August 4, 1938; at the time of his death said Frank Mills was
<br />seized of an undivided one -half of the above described real estate; that no
<br />application to probate said will has been filed in Nebraska; that the sole devisee
<br />1 under said will, Maude L. Mills, has conveyed all her interest acquired under
<br />said will, and said interest is now vested in petitioner, and no proceedings to
<br />admit said will to probate have been instituted by anyone.
<br />Prays the court to admit said will to probate pursuant to and in accord with
<br />Section 30 -1705 to Section 30 -1707 inclusive, Compiled Statutes of Nebraska of
<br />1929 as amended.
<br />February 15, 1945, Court orders that said petition be heard March 12, 1945 at 10 o'clock A. M.,
<br />and notice thereof be published once each week three successive weeks prior to
<br />said hearing, in the Veterans' Weekly of Lincoln, Nebraska.
<br />March 9, 1945, filed the affidavit of Ray E. Cronan, that he is editor and manager of the Lincoln
<br />Veterans' Weekly, a legal, weekly newspaper printed, published and of general
<br />circulation in Lancaster County, Nebraska, and that the attached printed notice
<br />was published in said newspaper once each week three successive weeks prior to
<br />said date of hearing, the first insertion having been on February 23, 1945, and
<br />that said newspaper is a legal newspaper under the Statutes of Nebraska, and the
<br />above facts are within his personal knowledge.
<br />Attached is a printed copy of a notice by the County Judge entitled as this
<br />estate 1s entitle "In the County Court of Lancaster County, Nebraska, addressed
<br />to all persons interested in said estate or the last will and testament of said
<br />deceased, creditors, heirs, legatees and devisees, that Harry McConnell who is
<br />owner of Lot 34 of Frank P. Bark's Subdivision No 3 Grand Island, Nebraska, filed
<br />his petition herein alleging that Frank Mills died testate on or about July 18,
<br />1935, a resident and inhabitant of Lancaster County, Nebraska; that no application
<br />for probate of said will has been made, and the will of said deceased has not
<br />been probated in the State of Nebraska, and more than two years have elapsed since
<br />the death of said deceased; that the dourt enter a decree admitting said will to
<br />probate as the last will and testament of said deceased; and further prays that the
<br />Court decree that the property which said Frank Mills owned at the time of his
<br />death shall descend to the persons named in said will, in accordance with the terms,
<br />thereof, free and clear of all debts. Whibh matter has been set for hearing March
<br />12, 1945, at 10 o'clock A. M.
<br />March 12, 1945, hearing continued to August 19, 1946.
<br />August 19, 1946, hearing had on petition, and Frank Roehl sworn and testified.
<br />August 30, 1946, Decree, On August 19, 1946, this matter came on for hearing on the pleadings and
<br />2 evidence, ant- was sumitted by the court, and the court finds due and legal notice
<br />of hearing was given as provided by law and as ordered; court finds Frank Mills
<br />died July 1$, 1935, a resident of Lincoln, Nebraska, leavuing a last will which
