<br />28081 —The Augustine Co., Grand Island, Nebr.
<br />That said Ernest Leland Kiteh, deceased, died the owner of the estate situated in Hall County,
<br />Nebraska, consisting of real property and personal property; that said real property being des-
<br />cribed as follows:
<br />Lots seventeen (17), eighteen (18), and nineteen (19) in Sunnyside Subdivision Addition of Frank
<br />P. Barks Third Subdivision Addition to the City of Grand Island, Nebraska. Being a subdivision
<br />of Lots 50, 51, 52, and 53 and 4 of Frank P. Bark's subdivision #3 of part of the East one -half
<br />(En) of the Northeast Quarter (NEJ) of Section Ten (10), Township eleven (11), North of Range
<br />nine (9). West of the 6th P.M. in Hall County, Nebraska.
<br />Lots number Thirteen (13) and Fourteen (14) in Block number seventy -eight (78) in the town of
<br />Security, Montgomery, County of Montgomery, State of Texas according to the duly recorded map or
<br />plat or said town recorded in the Deed Record of Montgomery County, Texas. The same appears of
<br />record in volume sixty (60) on Pages 438 and 439 Deed Records of Montgomery County, Texas. Also
<br />a tract of land out of Section One (1)9 of the East Wrentmore survey of the Security subdivision
<br />situated in Montgomery County Texas, as the same appears of record in volume Sixty -six (66) page
<br />336, Deed Records Montgomery County, Texas. Also four tracts of land number thirty -seven (37) and
<br />thirty -eight (38) containing Ten (10) acres, out of section One (1) of the E. Wrentmore Survey of
<br />the Security subdivision, situated in Montgomery County, Texas as the same appears of record in
<br />volume sixty -six (66) page 404 Deed Records, Montgomery County, Texas.
<br />That the deceased died, being possessed of the following personal property consisting to -wit:
<br />Postal Savings Certificates - - - - - - - - - - - - - - - - $1,030.00
<br />23 Shares Owenwood Pool #3 - - - - - - - - - - - - - - - - 92.00
<br />Car, 1935 Chevrolet Coupe - - - - - - - - - - - - - - - - - 300.00
<br />That due and legal notice has been given to all persons of the time and place fixed by the
<br />Court for a hearing on said Final Report by publication of said notice for three (3) successive
<br />weeks in the Grand Island Daily Independent, as by law required, and no one appearing to object
<br />to said report, and the Court having examined the same, finds that said report is true and correct
<br />in all things and should be approved and allowed as and for said executrix and said estate settled,
<br />closed and said executrix discharged; the Court further finds that all expenses and claims against
<br />said estate have been paid by said executrix;
<br />That said estate is not subject to the payment of any inheritance tax under the laws of the State
<br />of Nebraska, or the United States of America.
<br />IT IS THEREFORE ORDERED, ADJUDGED, AND DECREED by the Court that all persons having claims
<br />against said estate not filed and allowed by the time fixed by the Court, if any such there be,
<br />are forever barred, excluded and enjoined from setting up or asserting any such claims of said
<br />estate;
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED by the Court that title to the following described
<br />real property, as in the will decreed, passes to Marie C. Kitch, the real property, described
<br />as follows to -wit:
<br />Lots seventeen (17), eighteen (18)0 and nineteen (19), in Sunnyside Subdivision Addition of
<br />Frank P. Barks' Third Subdivision Addition to the City of Grand Island, Nebraska# Being a sub-
<br />division of Lots 50, 51, 52, and 53 and 54 of Frank P. Bark's subdivision #3 of part of the
<br />East one -half (E2) of the Northeast Quarter (NEJ) of Section Ten (10), Township eleven (11),
<br />North of Range nine (9), West of the 6th P.M. in Hall County, Nebraska.
<br />Lots number Thirteen (13) and Fourteen (14) in block number Seventy -eight (78) in the town of
<br />Security, Montgomery, County of Montgomery, State of Texas according to the duly recorded map or
<br />plat or said town recorded in the Deed Record of Montgomery County, Texas. Also a tract of land
<br />number Seventy -six (76) containing Five (5) acres out of Section One (1) of the East Wrentmore
<br />survey of the Security subdivision situated in Montgomery County, Texas, as the same appears of
<br />record in volume Sixty -six (66) page 336, Deed Records Montgomery County, Texas. Also four tracts
<br />of land number thirty -seven (37) and thirty -eight (38) containing Ten (10) acres, out of section
<br />One (1) of the E. Wrentmore Survey of the Security subdivision, situated in Montgomery County,
<br />Texas as the same appears of record in volume sixty -six (66) page 404 Deed Records, Montgomery
<br />County, Texas.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED by the Court that the title to the following des-
<br />cribed personal property passes to Marie C. Kitch, as by the will decreed, the personal property
<br />being described as follows, to -wit:

<br />by Marie C. Kitch, executrix, of the same, is hereby in all things approved and,a.11owed as and
<br />for said executrixes Final Report; that said estate is settled and closed and said executrix
<br />is hereby discharged from her trust as executrix of said estate and sureties on her official
<br />bond are released.
