<br />IN THE MATTER OF THE ESTATE

<br />EMILIE MENCK, DECEASED
<br />Now on this 13th day of November, 1946, this matter came on to be heard upon the pleadings
<br />and the evidence and was submitted to the Court, on consideration whereof the Court finds that due
<br />and legal notice of this proceeding has been given to all persons interested in said matter, both
<br />creditors and heirs, as required by law, That all of the statements and allegations set forth in
<br />said Petition are true; that said Emilie Menck, formerly Emma Boehm, died intestate in Hall County,
<br />,Nebraska, on June 10, 1901, seized and possessed at the time of her death of an interest in the
<br />following; described real estate, with other real estate, to -wit: The easterly fifty -seven (57)
<br />,feet of Lot Three (3) in Block "B ", "Boehm's Subdivision" of Lot .Sixteen (16) of the County Sub -
<br />division of the South Half of the SoutheastQuarter (S-2 SE-41) of Section Sixteen (16), in Township '" -.,,{
<br />Eleven (11) North, Range Nine (9), west of the 6th P. M., and part of the North Half of the North -
<br />east Quarter (Ni NE4) of Section Twenty -one (21), Township Eleven (11), North, Range Nine (9),
<br />west of the 6th P. M., in the City of Grand Island, Nebraska. That no application has been made
<br />In the State of Nebraska for the appointment of an administrator of the estate of said deceased.
<br />That the said Emilie Menck was survived by her husband, Carl H. Menck, and two children, Harold C.
<br />Menck and Lydia C. Menck, who were and are her only heirs -at -law, and the Court hereby finds and
<br />determines that her interest in the real estate hereinabove described passed and descended at the
<br />time of her death to her children, share and share alike, subject to the life interest of Carl H.
<br />Menck, her husband, therein.
<br />IT IS THEREFORE CONSIDERED AND ADJUDGED
<br />described of the said Emilie Menck be, and
<br />Lydia C. Menck, each an undivided one -half
<br />H. 1,1enck. It is further considered and ad
<br />the estate of the deceased, whether due or
<br />the same hereby are, forever barred.
<br />BY THE COURT that the interest in real estate Above -
<br />the same hereby is, assigned to Harold C. Menck and
<br />interest therein, subject to the life interest of Carl
<br />judged by the Court that all claims and demands against
<br />to become due, whether absolute or contingent, be, and
