<br />28081 —The Augustine Co., Grand Island, Nebr.
<br />administration,have been paid in full;that the further presentation of claims against said estate
<br />has been forever barred by the former order of this court;that there is no inheritance tax due
<br />the State of lebraska, and no federal estate tax due the United States of America.
<br />4. That the final report of the administratr.ix =filed herein is in all things true and correct,and
<br />should be approved and allowed as her final report;that there remains no money or personal property
<br />in her hands for distribution ;that the said Fred Poehler died seized and possessed of the Northeast
<br />Quarter of Section 29 in Township 12,North of Range 11,West of the 6th p,M.,in Hall County,Nebraska,
<br />occupied by the decedent and his family as their home at the time of his death ;that said real estate
<br />descended by law and should be assigned to his heire,equally,share and share alike,subject to the
<br />homestead rights of the widow,as provided by law.
<br />IT IS THEREFORE COPSSIDERED,ORDERED,ADJUDGED AND DECREED BY THE COURT:
<br />1.
<br />That the report of Emma A.Poehler,administratrix,filed herein,be and the same is hereby in all
<br />things approved and allowed,as and for hkw final account,and in full settlement of her trust;that
<br />she be discharged as administratrix and she and her sureties released from all further liability
<br />as their official bond.
<br />11.
<br />That Fred Poehler died intestate on March 17,1945,a resident of Hall County,Nebraska ;that he left
<br />surviving him,a widow,Emma A.Poehler,a daughter,Elvera E.Poehler,and a son,Ray M,Poehler ;that he
<br />left no other living ehildren,or the living issue of any deceased children,and that said widow
<br />and children are the sole and only heirs of his estate.

<br />That the real estate hereinbefore described,be and the same is hereby assigned to the said Emma
<br />A.Poehler,as a homestead for her use and benefit during her lifetime.
<br />iv.
<br />That said real estate hereinbefore described descended by law and is hereby assigned to the said
<br />Emma A.Poehler,Elvera E.Poehler,and Ray M.Poehler,,equally,share and share alike,subject to the
<br />homestead rights of the said Emma A.Poehler.

<br />This matter came on for hearing the 26th day of Ootober,1946,upon the petition of Howard P.Eivers
<br />and Pearl Eva Elvers,as joint tenants,and was submitted to the Court.
<br />The Court,after being fully advised in the premises,and after due and careful oonsideration,finds
<br />that legal notice of this proceeding has been given to all persons interested,both creditors and
<br />heirs,as required by law ;that the allegations of said petition are true ;that said Edward E.Rund-
<br />lett died,intestate,on December 27,1903,a resident of Ellis County,Kansas;that said decedent died
<br />more than two years previous to the filing of the petition herein,and was,at the date of his
<br />death,seized of ownership in fee to an interest in real property situated in the state of Nebraska,,
<br />to -wit:
<br />An undivided one -third interest in Lot Five (5) in Block One Hundred Forty -three (143) in
<br />Union Pacific Railway Company's Second Addition to the city of Grand lsland,in Hall County,state
<br />of Nebraska.
<br />That no administrator of the estate of said deceased has been appointed in the state of Nebraska,
<br />and that no decree of heirship has heretofore been entered in a probate of his said estate in
<br />Nebraska ;that said deceased left surviving him,as his sole and only heirs at law,the following;
<br />Sadie A. Chapman, daughter,
<br />Everett R.Rundlett,also known as Everett Rundlett,a son,
<br />That such deceased further left him surviving his widow,Jennie Rundlett,who was n6t the mother
