<br />WILL AND DECREE
<br />Ex #1 LAST WILL AND TESTAMENT OF MOSES WILLIAMSON.

<br />I, Moses Williamson, of Grand Island, Hall County, Nebraska, being of sound mind and disposing
<br />memory, do make and publish this, my last will and testament, by it revoking all former wills by
<br />me made.
<br />FIRST.
<br />I direct my Executor, hereinafter named, to pay all my just debts, including the expenses of my
<br />last sickness and death and costs and expenses of admitting this will to probate and administering
<br />my estate, from such personal peoperty as I may have on hand at the time of my death. If that be
<br />insufficient, I authorize my executor to sell so much of the real estate as may be necessary for
<br />that purpose, this being his full and complete authority to make the necessary deeds of transfer
<br />without order of any court whatsoever.
<br />SECOND.
<br />All.of the rest, residue, and remainder of my property, both real and personal, of which I die
<br />possessed, I give, devise, and bequeath unto my executor and trustee, George Williamson, and to his
<br />successor or successors in trust, upon the uses and trusts and for the purposes following: '
<br />a) To receive andcollect all rents, issues, and profits therefrom,
<br />b) To pay any and all costs and expenses property chargeable against the same,
<br />c) To sell and convey real and personal property of said trust ex-tate when, in the Judgment of said
<br />trustee or his successor or successors in trust, it is for the best interest of said estate that
<br />real oersonal property, or both, be sold, and the proceeds be re- invested in personal property or
<br />other tal estate, subject to no restrictions whatsoever on the part of said Trustee, or his
<br />successor or successors in trust, in making of necessary assignments or deeds of transfer, other
<br />than that such transfers shall be approved by the court having jurisdiction of said trust estate.
<br />d) To pay from the income of said trust estate, or ,. if that be insufficient from the inaame and so
<br />much of the principal as may be necessary, the sum of Three hundred dollars ($300.00) each year
<br />during their natural lives to each of the following:
<br />My son, George Williamson,
<br />My daughter, Katie Williams,
<br />My son, James Williamson,
<br />My son, John Williamson, and
<br />My sister, Mary McNeil,
<br />said payments to be made in semi - annual instalments of one hundred fifty dollars ($150.00) each;
<br />e) In the event the income of said trust estate, after the payment of all expenses and charges,
<br />shall exceed in any one year the amount paid out by my executor or trustee under paragraph d).
<br />above, then it is my wish that the payments of each of my said children, and my sister, be increased
<br />proportionately, so that the payments made under paragraph d) above shall equal the income from
<br />said trust estate, said payments, however, in no event and re ardless of the amount of income of
<br />said trust, to exceed the sum of six hundred dollars ($600.00 in any one year to any one of the
<br />above.
<br />f) Upon the death of the last surviving of the above mentioned George Williamson, Katie Williams,
<br />James Williamson, John Williamson, and Mary McNeil, to pay to each of the following of grand-
<br />children, if living at the time of the death of the last survivor of those herein mentioned, the
<br />sum of One Dollar ($1.00);
<br />Katie Dahl, Mary O'Rourke, James Webb, Jr., and Jessie Williamson, being the children of my
<br />deceased daughter, Mary Williamson Webb,
<br />Steve Stanley, being the son of my daughter, Annie Williamson Stanley,
<br />Katie Williamson Laster, Jessie Williamson Laster, Mary Williamson, Tildie Williamson, Jennie
<br />Williamson, Jamesina Williamson, children of my son, John Williamson,
<br />Bridget O'Rourke, Jessie Normile, Alice Hamilton, William Williamson, and Kathryn O'Rourke,
<br />ohildren..of my deceased son, William Williamson.
<br />g). To pay and deliver to each of my grandchildren living on the date of the death of the last
<br />survivor of George Williamson, Katie Williams, James Williamson, John Williamson, and Mary McNeil,
<br />above mentioned, except those grandchildren hereinbefore in paragraph f) specifically bequeathed
<br />the sum of One Dollar each, all the rest, residue, and remainder of my estate, share and share a-
<br />like, per capita and not per stirpes, to be their absolutely.
<br />h) It is my intention in this will that each of my ea:�,d children, and my sister, if they survive
<br />me, shall receive from my said estate an income of riot less than three hundred dollars ($300.00)
<br />nor more than six hundred dollars ($600:00) a year, so long as they shall live, their said interests
<br />in my estate to terminate upon their death, and that, upon the death of the last survivor of my
<br />said children, and my sister, that my estate remaining at that time shall 4* absolutely, share and
<br />share alike, to those of my grandchildren living on the date of the death of the last survivor of
<br />my said children, George Williamson, Katie Williams, James Williamson, and John Williamson, and my
<br />sister, Mary McNeil, who are not herein specifically bequeathed the sum of one dollar each.
<br />i) It is not my intention in this will to include in the term "grandchildren" any great- grand-
<br />children or children of any great- grandchildren.
