<br />This matter came on for hearing the 17th day of October, 1946, upon the petition of Arthur D.
<br />Birk, and was submitted to the Court.
<br />The Court, after being fully advised in the premises, and, after due and careful consideration,
<br />finds that legal notice of this proceeding has been given to all persons interested, both creditors
<br />and heirs, as required by law; that the allegations of said petition are true; that the said
<br />Christian P. Birk died intestate, on December 9, 1941, a reisdent of Grand Island, in °,.Hall County,
<br />Nebraska; that said decedent died more than two years previous to the filing of the petition here-
<br />in, and was, at the date of his death, seized as owner in fee of an undivided one -third interest in
<br />Fractional Lot Four (4) in Block Seven (7) of Voitle's Addition and its complement, Fractional
<br />Lot Four (4) in Block One Hundred Thirty -one (131), Union Pacific Railway Companyts Second Addition,
<br />both additions to the city of Grand Island, in Hall County, state of Nebraska.
<br />That no administrator of the estate of said deceased has been appointed in the state of
<br />Nebraska, and that no decree of heirship has heretofore been entered in a probate of his said
<br />estate in Nebraska; that said deceased left surviving him, as his sole and only heirs at law, the
<br />following:
<br />Ruth E. Vaughan, daughter,
<br />Arthur D. Birk, son,
<br />Agnes B. Leslie, daughter,
<br />Darice V. Klinge, daughter,
<br />Alice Barnhardt, daughter,
<br />Sadie Hampton, daughter,
<br />Cecelia Clayton, daughter,
<br />Wilmer H. Birk, son,
<br />Jesse J. Birk, son, and
<br />Mary K. Kriz (formerly Mary J. Birk) and
<br />Barbara A. Geissinger (formerly Barbara A. Birk),
<br />grand - daughters, being daughters of Peder R. Birk, a deceased son.
<br />` That the interest of said deceased in and to said real estate descended to the above named
<br />r persons, in the proportion of an undivided one -tenth of such interest to each of the following:
<br />Ruth E. Vaughan, Arthur D. Birk, Agnes B. Leslie, Darice V. Klinge, Alice Barnhardt, Sadie Hampton,
<br />Cecelia Clayton , Wilmer H. Birk, and Jesse J. Birk, children of said deceased; and an undivided
<br />one - twentieth of such interest of each of the following: Mary J. Kriz (formerly Mary J. Birk) and
<br />Barbara A. Geissinger (formerly Barbara A. Birk), grand- daughters of said deceased.
<br />IT IS, THEREFORE, CONSIDERED, DETERMINED AND DECREED that the interest of the deceased in the
<br />real estate hereinbefore described, descended: to Ruth E. Vaughan, Arthur D. Birk, Agnes B. Leslie,
<br />Darice V. Klinge, Alice Barnhardt, Sadie Hampton, Cecelia Clayton, Wilmer H. Birk and Jesse J. Birk,
<br />an undivided one -tenth each; and to Mary J. Kriz (formerly Mary J. Birk) and Barbara A. Geissinger
<br />(formerly Barbara A. Birk) an undivided one - twentieth each.
<br />IT IS FURTHER CONSIDERED AND ADJUDGED that all claims or demands against the estate of Christian
<br />P. Birk, deceased, whether due or to become due, whether absolute or contingent, shall be the
<br />and
<br />same hereby are forever barred.
