<br />Now on this 24th day of July, 1946, this matter came on for hearing upon.the final report of
<br />Harold G. Strasser, administrator de bonis non of the estate of Frank Strasser,.deceased, and up-
<br />on the petition of said administrator for the allowance and approval of said report, settlement
<br />of said estate, and his discharge herein, and the court being fully advised in the premises finds
<br />that due and legal notice has been given to all persons of the time and place fixed by the court
<br />for the hearing upon said final report, and there being no objections to the report and the court
<br />having examined the same, together with the vdphers on file, finds that said report is true and
<br />that the same ought to be approved.and allowed as and for the final report of said administrator,
<br />said estate settled and closed, and the administrator discharged upon filing with the court a
<br />suitable bond approved by the court to assure the payment of any claim for attorney fees`on the
<br />part of William Suhr, should any claim be made.
<br />The court further finds that the said Frank Strasser departed this life on the 9th day of
<br />March, 1940, and that at the time of his death he was a resident and inhabitant of Hall County,
<br />Nebraska; that the said Frank Strasser died intestate; that a petition for letters of administra-
<br />tion was filed on March 14, 1940, asking that said estate be admitted to probate and the letters
<br />of administration be granted to the petitioner, Matilda M. .Strasser, widow of the deceased, upon
<br />the goods, real estate, rights and credits of said Frank Strasser, deceased, and upon hearing
<br />held upon said petition after notice was duly given to-all persons interested in said estate, said
<br />estate was admitted to probate on the 10th day of April, 1940, and letters of administration were
<br />duly issued by the court to the said Matilda M. Strasser of the estate of Frank Strasser, deceased.
<br />Subsequently, said Matilda M. Strasser died, and on January 7, 1943, Harold G. Strasser was duly
<br />appointed administrator of all and singular the goods, chattels, rights, credits and estate of the
<br />said Frank Strasser, deceased, not already administered.
<br />The court further finds that due and legal notice has been given to all persons of the time and
<br />place fixed by the court for filing claims against the estate of the deceased and that the time
<br />so fixed has fully expired, and that all persons having claims against said estate and not filed
<br />within the time limited by the court are forever barred and excluded from setting up or asserting
<br />any such claim against said estate; the court further finds the administrator and administrator de
<br />bonis non have paid the funeral expenses and all debts filed and allowed as claims against said
<br />estate and the costs of these proceedings, and that the inheritance tax levied under the laws of
<br />the State of Nebraska and the federal estate tax due under the laws of the United States.have been
<br />paid; that William Suhr was at one time employed as attorney by the administratrix and rendered
<br />services in behalf of the estate, for which he presented a claim for fees which the administrator
<br />de bonis non believed excessive, and it has been impossible to amicably adjust the claim and the
<br />said William Suhr has refused and failed to file the claim in this court in order that the matter
<br />might be adjudicated; that the administrator has offered to file a, bond in an amount to be fixed
<br />by the court with sureties approved by the court, guaranteeing the payment of any amount found due
<br />him in the event claim is made in this court within the time provided for by the Statutes of Limit-
<br />ation, and upon the filing and approval of such bond in the sum of $3,000.00, the estate be completely
<br />closed and the administrator discharged. The court further finds that the said Frank Strasser was
<br />possessed of the following described real estate at the time of his death,_to -wit:
<br />Item 1 West Forty -four (44) feet of Lot Eight (S), Block Fifty -five (55), Original Town, now
<br />City of Grand Island, Hall County, Nebraska; .
<br />Item 2 Center One -third of Lot Eight (8), Block Fifty -four (54), Original Town, now City of
<br />Grand Island, Hall County, Nebraska;
<br />Item 3 South Sixty -six (66) feet of Lots Three (3) and Four (4), and the East Fifty -seven
<br />(57) feet of the North Sixty -six (66) feet of Lot Three (3), Block Sixty -two (62),
<br />Original Town, now City of Grand Island, Hall County, Nebraska;
<br />Item 4 South Twenty -two (22) feet of Lot Four (4), Block Forty (40), Original Town, now City
<br />of Grand Island, Hall County, Nebraska;
<br />Item 5 Lot Three (3) and part of Lot Two (2) in Block Twenty -Three (23) Nagy's Addition to
<br />the City of Grand Island, Hall County, Nebraska; said Lot Two (2) being described as
<br />beginning at the southwesterly corner of Lot 2, thence easterly along the south line
<br />of Lot 2 a distance of 32.19 ft.; thence northwesterly in a line which makes an angle
<br />of 580 55' with the first line a distance of 31.24 ft.; thence to the right in a curved
<br />line with a radius of 125 ft. a distance of 65.9 ft. to a point in the westerly line
<br />of said Lot 2, 40.9 ft. southerly from the northwesterly corner of said Lot 2; thence
<br />southerly in the westerly line of said Lot 2 a distance of 91.1 feet to point of
<br />beginning;
<br />Item 6 Lot Four (4), Block One Hundred Twenty-seven (127), Koenig & Wiebe's Addition to the
<br />City of Grand Island, Hall County, Nebraska;
<br />Item 7 Lots One (1) and Two (2), Block One Hundred Eight-(108)p Railroad Addition to the
<br />City of Grand Island, Hall County, Nebraska;
<br />Item $ That part of the Northeast Quarter of the Northeast Quarter(NEJ NEJ) of Section Twenty -
<br />one (21), Township Eleven (11), North, Range Nine (9), West of the 6th P. M., in Hall
<br />County, Nebraska, described as follows: Starting at the corner of Sections 15, 161
<br />21, and 22, T.11, R. 9, West of the 6th P. M., thence 890 321 west along the section
<br />line between Sections 16 and 21 a distance of 291.6 feet to its intersection with the
<br />north line of Anna Street, thence south 610 39' west along said north line extended of
<br />Anna Street a distance of 366 . 4 feet as a place of beginning; thence south 61
<br />west along said line extended of Anna Street a distance of 532.6 Peet to its inter-
<br />section with the east line of Clark Street, thence south 280 211 east along the east
<br />line of Clark Street a distance of 220 feet to its,interseetion with the south line
<br />extended of Block 17, Windolph's Addition; thence north 610 391 east alongthe south
<br />line extended of Block 17, a distance of 532.6 feet; thence north 280 21, west a dist-
