of )
Charles C. Johnson, deceased. ) D E C R E E
This matter came on for hearing the 14th day of October, 1946, upon the petition of Lillian L.
Ferguson, and was submitted to the Court.
The Court, after being fully advised in the premises, and after due and careful consideration,
finds that legal notice has been given to all persons interested, both creditors and heirs, as re-
quired by law; that the allegations of such petition are true; that said Charles C. Johnson died,
Intestate, on November 12th, 1930, a resident of Grand Island, in Hall County, Nebraska; that such
decedent died more than two years previous to the filing of the petition herein, and was, at the
date of his death, siezed in fee, of an undivided one-half interest in Lot Thirteen (13), of Frank
P. Barks' Subdivision 1:e,ing part of the east half ( E) of the northeast quarter ( NE} ) of Section
Ten (10), in Township Eleven (11) North, Range Nine (9), West of the Sixth P. M., in the County of
Hall and State of Nebraska.
The court further finds that no administrator of the estate of such deceased has been appointed
In the State of Nebraska, and that no decree of heirship has heretofore been entered in the probate
of his estate in the State of Nebraska; that said deceased left surviving, as his only and sole
heirs at law, the following:
Marie Johnson, surviving spouse, and
Tillie Payne, a married daughter;
Herman Johnson, a 'son, born December 10, 1919;
Mary Jane Johnson, a daughter, born April 9, 1927;
and Marjorie Ann Johnson, a daughter, born November 5, 1930;
all of whom are the children of Marie Johnson, surviving spouse,
The court further finds that the real property above described descended to the above named
persons in the proportion of a one -third interest to Marie Johnson; and an undivided one -ninth to
each of the children above named.
IT IS, THEREFORE, CONSIDERED, DETERMINED AND DECREED that the real estate hereinbefore described,
descended; to Marie Johnson, an undivided one- third; to Tillie Payne, Herman Johnson, Richard S.
Johnson, Marvin C. Johnson, Mary Jane Johnson, and Marjorie Ann Johnson, an undivided one -ninth
interest each.
