106 <br />WILL AND DECREE RECORD <br />26081—The Augustine Co., Grand Island, Nebr. <br />DECREE <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA. <br />IN THE 14.A.TTER OF THE ESTATE. <br />OF DECREE DETERMINING HEIRSHIP. <br />FRED J. HORTON, DECEASED, ) <br />Now on this 5th. day of October, 1946, this matter came on for hearing on the petition of <br />Raymond D. Horton, for the determination of heirship of thece4tate of Fred J.Horton, deceased, and <br />was submitted to the court, Raymond D. Horton appeared in person and by S. J Shada, his attorney <br />It appearing from the record and files in said matter that notice of the time and place fixed for <br />the hearing on said petition has been given by publication thereof as by order of said court hereto- <br />fore made and entered, whereupon Raymond D. Horton was sworn and testified. <br />On consideration of the evidence the court finds that said Fred J. Horton, departed this life <br />intestate on the 19 th. day of March 139; that said Fred J. Horton was at the time of his death a <br />resident and inhabitant of the said bounty of Hall and State of Nebraska, and died seized of an <br />estate of inheritance in the following described real estate, to -wit: Lot Seven (7) Block Nine (9), <br />in Brett and Johnson's Addition to Wood River, Hall County, Nebraska; that more than two years have <br />elapsed since the death of the said Frd J. Horton, and no application for the appointment of an <br />administrator of his estate has been -Male in this state by any heirs or persons claiming to be <br />creditors of said deceased; that said decedent was the owner of said premises; that Rose Horton, was <br />the widow of said deceased, and Raymond D. Horton, was a son and only child of said deceased; that <br />said widow and son are of legal age. <br />IT IS THEREFORE COVIDERED AND ADJUDGED, that the appointment of an administrator for said <br />estate be dispensed with; that all claims be forever barred; that said estate be assigned as follows: <br />to Rose Horton, widow, one -half, to Raymond D. Horton, of legal age. <br />IT IS THEREFORE CONSIDERED AND ADJUDGED, that the appointment of an administrator for said <br />estate be dispensed with; that all claims tie forever barred; that said estate be assigned as follows: <br />to Raymond D.
