<br />I, Katie Fass, Grand Island, Hall County, "ebreaka, make, publish, and declare this as and
<br />for my last will and testament, and I hereby revoke any and all former wills by me executed.
<br />1.
<br />I hereby appoint Matthea,T Fass, my son of Grand Island, Nebraska, as executor of this my last
<br />will and testament.
<br />2.
<br />I direct my executor to pay all of my just debts and expenses, including expenses of my last
<br />sickness and death, all the expense incidental to the probate of this will as soon after my death
<br />as is reasonably covenient.

<br />I direct that my executor sell all of my real estate as soon after my death as is convenient
<br />and from the proceeds p,,.y all of the expenses incident to my last sickness and death.

<br />I further direct that my executor pa.y to my grand son, George Fass, one hundred dollars.

<br />I further direct that my executor pay to the trustees of Saint Mary's Cathedral one hundred
<br />dollars.

<br />Allof the rest of the -oroceeds from the sale of my real estate to be paid in equal shares.
<br />Share and share alike to my sons and daughters, as follows; John Fass, Mary Fass Burnett,
<br />Valentine Fass, Margaret Fass Adams, ?athryn Fass, <.nd 1 atthew Fass.

<br />I, Paul N. Kirk, Judge of the County Court, in and for said County, do hereby certifty that
<br />on the 22nd day of June 1942, the instrument purporting to be the last 1,' till and testament of
<br />Katie Fass deceased, was filed for probate in this Court. That on the 18th day of July 1942, said
<br />instrument to which this certificate is attached was duly proved, probated and allowed as the last
<br />will and testament of the real and personal estate of said Katie Fass deceased, and the same was
<br />ordered to be recorded in the records of the Court aforesaid.

<br />I?ow on this 9th day of November, 1945, this cause care on for hearing upon the final report
<br />filed 'herein by John F. McCarthy, Administrator of the Estate of Katie Fass, with -rill annexed,
<br />a.nd TT-att Fass, Executor, and upon their petition for the approval and allowance of said report,
<br />settlement of said estate, determination of the heirs and. their discharge therein, and the court
<br />h=aving examined the records and files and being fully advised in the premises finds:
<br />That John F. 1,•1cC,7.x'thy filed his petition for Administrator with will annexed on the 14th day
<br />of September, 1944, alle. -ing among:; other things that Matt Fass was duly appointed executor of the
<br />estate of Katie Fass on the 21st ray of July, 1942, and that he entered the Armed Forces of the
<br />United States and that on or about the 1st day of February, 1924 -41 left for foreign service. That
<br />MattFas:. had filed a petition for nr.oba.te in the County Court of Hall County, Nebraska, on June
<br />22, 1042, offering for probate the -last will and testament of Katie Fass, deceased; said will was
<br />accepted for probate on the 18th day of July, 1942, and that Matt Fass Teas issued Letters
<br />Testamentary.
<br />That a hearing ,ra.s held as heretofore ordered by the court as by 1pw provided for the a,p-
<br />rnointment of John F. icCarthy, as Ac.ministrator t•rit,. will annexed, of the estate of Katie Fass,
<br />deceased, upon the filinc. of his bond in this court as recuired by law.
