<br />IN THE MATTER OF THE ESTATE OF FINAL DECREE.
<br />ERNEST SCHULTZ, DECEASED. )
<br />Now on this 3rd day of October, 1946, this cause came on for hearing upon the Final Report filed
<br />herein by Rudolph Schultz, the duly appointed, qualified, and acting administrator of the Estate of
<br />Ernest Schultz, deceased, and the Court having examined the files and records of said Estate, in-
<br />cluding the said Final Report, and being fully advised in the premises, finds as follows:
<br />That on the 24th day of January, 1946, Rudolph Schultz, filed in this Court a petition alleging
<br />among other things that the said Ernest Schultz departed this life intestate, a resident and in-
<br />habitant of Hall County, Nebraska, on the 14th day of January, 1946, leaving as his heirs at law,
<br />and only heirs at law, Rudolph Schultz, a son, Grand Island, Nebraska; Albert Schultz, a son, Grand
<br />Island, Nebraska; and Amelia Colby, a daughter, residing in California, all over 21 years of age.
<br />The Court further finds that a hearing was had on said petition after due notice as'provded by
<br />law, and, Rudolph Schultz was issued Letters of Administration by said Court on the 20th day of
<br />February, 1946, to administer the assets of said estate.
<br />The Court further finds that due notice was given to the creditors of said estate as provided
<br />by law, and the time for filing claims against said estate fully elapsed and determined on the 22nd
<br />day of June, 1946, and that all persons having claims, if any such there be, not filed within the
<br />time provided by the order of the Court should be forever barred and excluded from setting up or
<br />asserting any such claims.
<br />The Court further finds that said estate is not subject to the payment of any inheritance tax,
<br />either to the County of Hall or to the United States of America, and that all of the assets of said
<br />estate, both real and personal, after payment of court costa, administrator fees, and debts against
<br />said estate, descend to the heirs at law, above names, free and clear and exempt from payment of
<br />inheritance tax either to the State of Nebraska or the United States of America.
<br />The Court further finds that the said Ernest Schultz departed this life the owner of real estate
<br />described as follows, to -wit:
<br />Lot Four (4), Block Eight (8), Wiebe's Addition in the City of Grand Island, Hall County,
<br />Nebraska, also described as 519 West John Street in said City.
<br />All of which real estate, hereinbefore described, did pass and descend by operation of law to
<br />'Rudolph Schultz, Albert Schultz, and Amelia Colby, each an undivided one -third (1 /3rd) interest
<br />therein in fee simple title.
<br />The Court further finds that said Final Report filed herein by said administrator is true and
<br />correct in all things, and should be approved and allowed as and for his Final Report, said Estate
<br />settled and closed, and said administrator discharged and his official bond released from any further
<br />liability in said Estate.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED, AND DECREED by the Court that all persons having claims
<br />against said Estate not filed within the time provided by the order of this Court, if any such
<br />therebe, be and the same are hereby forever barred from setting up or asserting any such claims
<br />against said Estate.
<br />IT IS FURTHER ORDERED, ADJUDGED, AND DECREED by the Court that the Final Report of said admin-
<br />istrator be allowed as and for his Final Report in said Estate, said Estate settled and closed, and
<br />said administrator discharged, and his official bond released from any further liability in said
<br />Estate and that the real estate hereinbefore described did pass and descend by operation of law to
<br />the said Rudolph Schultz, Albert Schultz, and Amelia Colby, each an undivided one -third (1 /3rd.)
<br />interest therein, as hereinbefore found by the Court, free and clear, and exempt from any inheritance
<br />tax, either to the State of Nebraska or the United States of America as hereinbefore found by the
<br />Court.

<br />remaining in said Court, that the same is a correct tranzaript thereof, and of the whole of such
<br />original record; that said Court is a Court of Record having a seal, which seal is hereto attached;
<br />that said Court has no Clerk authorized to sign certificates in his own name, and that I am the legal
<br />custodian of skid Seal and of the Records of said Court, and that the foregoing attestation is in due
<br />form of law.
