<br />WILL AND DECREE RECORD
<br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA
<br />IN THE MATTER OF THE ESTATE
<br />OF
<br />ALBERT A. WERTS, DECEASED,
<br />INAL DECREE
<br />Now on this 10th day of July, 1946 this cause came on for hearing upon the application of
<br />Sarah Garrett, executrix of the estate and Last Will and Testament of Albert A. Werts, deceased,
<br />for approval of her final report filed herein, and it appearing to the Court that due notice was
<br />given of the filing of said report by publication of the Notice thereof for three - suceessive weeks
<br />in accordance with the order of this Court, and it further appearing to the Court that n ne appeared
<br />to object to the allowance of said report, the Court finds that said report should be al owed as
<br />and for the final report of the said Sarah Garrett.
<br />And this cause coming on further to be heard by the Court, and the Court being duly advised
<br />in the premises finds that Albert A. Werts, deceased, departed this life on December 27, 1945;
<br />that he was a resident and inhabitant of Hall County, Nebraska; that he left a Last Will and
<br />Testament in which Sarah Garrett was named executrix, and that after due notice was given by
<br />publication of the application for the probate of said will, the same was duly allowed and admitted
<br />to probate, and the said Sarah Garret executed her bond as such executrix, and thatshe has fully
<br />accounted for the property coming into her hands as executrix of said estate.
<br />And it further appearing to the Court that due notice to creditors of deceased was duly given
<br />as provided by law, and that the time for filin-g claims has expired; that all claims filed against
<br />said estate have been paid, and settled, and that if any claims exist not having been filed within
<br />the time provided by law, the same are forever barred and precluded. .
<br />It further appearing to the Court that the legacies provided by the terms of the will have
<br />been paid; that the bequests made to George Werts, Ida Wright, and Martha Fritz in the sum of One
<br />Dollar:; each have been paid into this Court for the respective legatees.
<br />The Court further finds that the deceased died siezed of the following described real estate,
<br />to -wit: Lot Seven (7), Block Eight (8) in Kernahan and Decker's Addition to Grand Island Hall
<br />County, Nebraska, and the North Sixty (60) feet of Lot Five (5) in Block Seventy -Five (?s3 in the
<br />original town, now City of Grand Island, Nebraska.
<br />And the Court further finds that said real estate,.together with all of the personal property
<br />re:..maining in the hands of the executrix was devised and bequeathed to Sarah Finerty, Norah Houlton,
<br />Sarah Garrett, Kathryn Connors, Margaret Finerty, and Charlotte Garrison in equal shares to each.
<br />The Court further finds that the expense of the last illness, the funeral expenses, and the
<br />costs herein have been paid; that inheritance tax was assessed against the heirs above named in
<br />the sum of $218.18, each, making a total inheritance tax of $130 .08; that the said inheritance
<br />tax has been paid and receipt therefor has been filed with this
<br />The Court further finds that said estate is not taxable under the laws of the United States
<br />for inheritance tax.
<br />IT IS THEREFORE ORDERED, ADJUDGED, AND DECREED BY THE COURT that all claims filed agO.inst said
<br />estate have been paid; that if there are any claims outstanding, the same are forever barred and
<br />precluded.
<br />IT IS FURTHER ORDERED, ADJUDGED, AND DECREED BY THE COURT that the Final Report of Sarah
<br />Garrett, as executrix of said estate, is in all respects correct, and is hereby approved and allowed.
<br />IT IS FURTHER ORDERED, ADJUDGED, AND DECREED BY THE COURT that the expenses of the last
<br />illness, funeral expenses, the court costs, and inheritance tax existing against said estate have
<br />been paid, and receipts therefor have been filed by this Court.
<br />IT IS FURTHER ORDERED, ADJUDGED, AND DECREED BY THE COURT that the personal property remaining
<br />in the hands of the executrix, and the real estate described above, to -wit: Lot Seven (7), Block
<br />Eight (8) in Kernahan and Decker's Addition to Grand Island, Hall County, Nebraska, and the North
<br />Sixty (60) feet of Lot Five (5) in Block Seventy -Five (75) in the original town, now City of Grand
<br />Island did pass and descend to Sarah Finerty, Norah Houlton, Sarah Garrett, Kathryn Connors, Margaret
<br />Finerty, and Charlotte Garrison in equal shares to each, and the same is hereby awarded to -them.
<br />IT IS FURTHER ORDERED, ADJUDGED, AND DECREED BY THE COURT that said estate is settled and
<br />closed; that upon the executrix filing the receipts for the distribution of the personal property
<br />in said estate, said Oxedutrix shall be dis "charged add her bond released.

<br />WERTS, DECEASED, with the original record thereof, now remaining in said Court, that the same is
<br />a correct transcript thereof, and of the whole of such original record; that said Court is a
<br />Court of Record having a seal, which seal is hereto attached; that said Court has no Clerk authorized
<br />to sign certificates in his own name, and that I am the legal custodian of said Seal and of the
<br />Records of said Court, and that the foregoing attestation is in due form of law.
