<br />ROBERT L. FRAKER, DECEASED
<br />Now on this 29th day of August, 1946, this matter came on to be heard upon the pleadings
<br />and the evidence and was submitted to the court, on consideration whereof the court finds that
<br />due and legal notice of these proceedings has been given to all persons interested in said
<br />matter, both creditors and heirs, as required by law. That all of the statements and allegations
<br />set forth in said petition are true; that the said Robert L. Fraker died intestate in Sacramento,
<br />California, in June of 1943, seized and possessed at the time of his death of an undivided one -
<br />fourth interest in all that part of the Northwest Quarter of the Southeast Quarter (NWJ SE*)
<br />of Section Six (6), Township Ten (10), North, Range Ten (10), west of the 6th P.M., Hall County,
<br />Nebraska, lying north of the center of the track of the main line of the Union Pacific Rail-
<br />road, containing 28.83 acres according to survey, subject to the right -of -way of said railroad.
<br />That no application has been made in the State of Nebraska for the appointment of an administra-
<br />tor of the estate of said deceased. That the said Robert L. Fraker was unmarried at the time of
<br />his death and left no children surviving him, and that his sole and only heirs -at -law are Bertha
<br />Fraker Ellis and Hazel Fraker, sisters, and Carol MacKay Wells and Robert J. MacKay, Jr.,
<br />children of Mabel MacKay, a sister of Robert L. Fraker who preceded him in death, and the court
<br />hereby finds and determines that they are the sole and only heirs -at -law of the said Robert L.
<br />Fraker, deceased, and that his interest in said real estate descended to Bertha Fraker Ellis
<br />and Hazel Fraker, each an undivided one -third therein, and to Carol MacKay Wells and Robert J.
<br />MacKay, Jr., each an undivided one -sixth therein.
<br />IT IS THERFOFRE, CONSIDERED AND ADJUDGED BY THE COURT that the undivided one - fourth
<br />interest in the real estate above- decribed be, and the same hereby is, assigned to the said
<br />Bertha Fraker Ellis and Hazel Fraker, each an undivided one -third interest therein, and to
<br />Carol MacKay Wells and Robert J. MacKay, Jr., each and undivided one -sixth interest therein.
<br />It is further considered and adjudged by the court that all claims and demands against the
<br />estate of deceased, whether due or to become due, whether absolute or contingent, be, and the
<br />same hereby are, forever barred.
