<br />and to George Baasch, I give, devise, and bequeath 15 contiguous acres of the said premises and
<br />the balance of the said premises, I give, devise, and bequeath unto Rudolph Baasch; it being my
<br />intention that my son, George Baasch, is to receive 15 acres of contiguous property and the
<br />balance is to go to Rudolph Baasch.

<br />I give, devise, and bequeath all my personal property that I may die possessed of to my
<br />son, Daniel Baasch, and my wife, Bertha Baasch, and any personal property that should remain in
<br />their hands should my wife preceed Daniel Baasch -in death shall be and become the property of
<br />Daniel Baasch; it being my intention that my personal property should be and become the sole
<br />property of Daniel Baasch u,-;on the death of my wife, Bertha Baasch.
<br />The rest, residue and remainder, I give, devise, and bequeath unto my son, Daniel Baasch.
<br />I hereby nominate and appoint Daniel Baasch, executor of this, my last will and testament,
<br />and request that he serve without bond.

<br />I, Charles Bossert, Judge of the County Court, in and for said County, do hereby certify that
<br />on the 17th day of December 1945, the instrument purporting to be the last will and testament of
<br />Ernest Baasch deceased, was filed for probate in this Court. That on the 10th day of January,
<br />1946, said instrument to which this certificate is attached was duly proved, probated and allowed
<br />as the last will and testament of the real and personal estate of said Ernest Baasch deceased,
<br />and the same was ordered to be recorded in the records of the Court aforesaid.

<br />OF ER 'ST BAASCH, DEC ASED.
<br />Now on this 20th day of August, 1946, this matter came on to be heard on the final account
<br />and petition for discharge of Daniel Baasch, executor, of the estate of Ernst Baasch, deceased,
<br />and for the distribution of the personal property of said estate, the assignment of the real
<br />estate of said estate, and the evidence, and was submitted to the court on consideration whereof
<br />the e`ourt finds that due and legal notice of the time and place of hearing on said final account
<br />and Detition for discharge has been given to all persons interested in said estate, as provided
<br />by law, and that said hearing was continued from the 1st day of August, 1946. Thereupon the
<br />court being fully advised in the premises finds as follows:

<br />That the said amended final account of the said Daniel Baasch, executor of the estate of
<br />Ernst Baasch, deceased, is in all respects, just, true, and correct; that due notice to creditors
<br />has been given; tht,t all claims allowed against said estate have been duly paid and satisfied,
<br />and that said estate is now solvent; that there is no federal or state inheritance tax due
<br />against said estate.

<br />The court further finds that the following heirs are the only heirs at law of Ernst Baasch,
<br />deceased; namely, Bertha Baasch, widow, George Baasch, son, Elmer Baasch, son, Rudolph Baasch, son,
<br />and Daniel Baasch, son.

<br />The Court further finds that the deceased was the fee owner at the time of his death of the
<br />following described real estate, to -wit:
<br />South One -half (S 1/2) of the Southeast Quarter (SE 1/4) of Section 13, Township 11, North,
<br />Range 9, West of the 6th P.M., Hall County, Nebraska;
