<br />BE IT REP.21, BERED, ti.at on this 27th day of July, A. D., 1946, it being the day fixed for
<br />approving the final account of the executor and hearing on his petition for final settlement and
<br />determination of heirship, and 'it appearing from proof on file that due notice was given by
<br />publication of the time heretofore fixed for said hearing, and there being no objections on file,,
<br />and the court being; fully advised in the premises, finds:
<br />1. That Henry Duennermann, Sr. died testate on January 29, 1946, a resident of Hall County,
<br />Nebraska, and left surviving him, as his next of kin and hems -at -law, the following named
<br />persons, to -t"it:
<br />Mrs. Peary Riss, Grand Island, Nebraska, daughter
<br />Henry Duennermann, Jr., Grand Island, Nebraska, son
<br />Mrs. Anna Mueller, Chapman, Nebraska, daughter
<br />William Duennermann, Grand Island, Nebraska, son
<br />Leo Duennermann, C ±- apman, Nebraska, son
<br />Rudolph Soeth, Chapman, Nebraska, grandson
<br />Harry Soethh, Grand Island, Nebraska, grand son
<br />sons of !Irs. Minnie Soet lh, a deceased daughter of said Henry Duennermann, Sr., deceased; that
<br />he left no 1ridow, other living; children, or other issue of any deceased children, and that said
<br />children and grandsons are the sole and only heirs of his estate.
<br />2 . That on February 27, 1946, the last will and testament of the said Henry Duennermann, Sr.,
<br />deceased, and the two codicils thereto, were duly proved, allowed and admitted to probate; that
<br />on said day, Henry Duennermann, Jr., was appointed executor, qualified as such and has been
<br />acting in said capacity ever since.
<br />3. That due notice was given to creditors of the time limited in which to file claims against
<br />said estate; that such time has duly expired, and all claims against said estate, includin-W tole
<br />expenses of his last illness and funeral, and the costs and expenses of administration have been
<br />paid in full; that the further presentation of claims against said estate has been barred by the
<br />former order of this court; ttihat there is no inheritance tax due the State of Nebraska, and no
<br />federal estate tax due the Undited States of America.
<br />4. That the report of the executor filed herein is in all things true and correct and should
<br />be approved and allowed as his final report; that there is a balance of $3,867.62 in the hands of tt-e
<br />executor for distribution; that since said report was filed herein the executor was charged an
<br />additional sum of 77� service charges on his bank account, which red = °uced said balance to $3,866.85.
<br />5. That the said Henry Duennermann, Sr., died seized,and osssessed of the following described
<br />real estate, to -wit: Lot 1 on the South Bank of the North �n an el of the Platte River in Section 12
<br />t:,Townshi 11 North of Range 9 West of the 6th P.M. in Hal Uounty Nebraska cont4kining about 3.6 acres, .and
<br />The North Half of the Northeast Quarter of the Southeast quarter, and the South Half of the
<br />Northeast Quarter of Section 18, in Township 11, North of Range 9, West of the 6th P. m., in
<br />Merrick. County, Nebraska, contAin ng 100 acres a little more or less.
<br />6. That Henry Duennermann, Jr. has paid the sum of $500.00 and William Duennermann the sum of
<br />$1000.00 to the executor in full settlement and satisfaction of their indebtedness to the said
<br />Henry Duennermann, Sr., deceased, secured by real estate mortgages, as provided by said will and
<br />codicils; that said executor should be authorized and directed to cancel and surrender to them
<br />their notes evidencing said indebtedness, and release of record the real estate mortgages securing
<br />the same, as provided by said will and codicils.
<br />7. That by the terms and provisions of the second paragraph of the last will and testament of
<br />the said Henry Duennermann, Sr., deceased, there was bequeathed to the said Mrs. Mary Ries and
<br />Eire. Anna Mueller to each the sum of $500.00 and to the said Rudolph Soeth and Harry Soeth to
<br />each the sum of 1250.00, which bequests were overlooked and not mentioned in the petition for
<br />final settlement of the executor filed herein, and by the terms and provisions of the sixth
<br />paragraph of said will as amended and modified by the two codicils tiiereto, the residue of the
<br />said estate was bequeathed and devised to Leo Duennermann, during his natural life, with authority
<br />to use a part of the principal, if necessary, for his care and maintenance, and ,the remainder was
<br />bequeathed and devised to the said PvIrs. Peary Riss, Henry Duennermann, Jr., Mrs. Ann.a'Mueller, and
<br />William Duennermann, to each an undivided one -fifth thereof, and to the said Rudolph Soeth and
<br />Harry Soeth, to each, an undivided one -tenth thereof.
<br />8. That William Duennermann has been appointed and qualified as guardian for the said Leh
<br />Duennermann, as suggested in said Will and codicils, and that any amounts due the said Leo
<br />Duennermann should be paid to his said guardian.
<br />IT IS THEREFORE CONSIDERED, ORDERED, ADJUDGED AND DECREED by the Court:
<br />1.
<br />That the report of Henry Duennermann, Jr., executor, filed herein, be and the same is hereby
<br />in all things approved and allowed as and for his final account and in full settlemk4ot his
<br />trust; that he be, and hereby is authorized and directed to cancel and deliver to Henry Duennermann,
<br />Jr. and William Duennermann their notes evidencing their indebtedness to the said Henry Duennermann,
<br />Sr., deceased, and release of record the real estate mortgages securing the same, as provided by
<br />said will and codicils; that the executor be and hereby is authorized and directed to pay to the
<br />said Pars. Mary Riss and Mrs. Anna Itlueller to each the sum Of $500.00 and to the said Rudolph Soeth
