<br />The court further finds that it was the true intent of the testator that subject to

<br />The court further finds that it was the true intent of the testator that subject to the life
<br />estate of Bertha Baasch, he give, devise, and bequeath unto my beloved sons, Rudolph Baasch and
<br />George Baasch, 23 acres more or less described hereinafter:
<br />A strip of land off the Jest side of the Southwest Quarter of the Northeast Quarter and Lot 2 on
<br />Island in said section running from south to north through said premises with parallel sides, 27
<br />rods wide containing about 23 acres; subject however, to the right of way over a strip of said
<br />land one rod wide at the South end of said premises reserved in these grantors, their heirs, and
<br />assigns for the purpose of passing over said land to the premises lying adjacent thereto and East
<br />thereof.
<br />and to Geo-nge Baasch, I give, devise, and bequeath 15 contiguous acres of the said premises and
<br />the balance of the said ?remises and the balance of the said premises I give, devise, and be-
<br />queath unto Rudolph Baasch; it being my intention that my son, George Baasch, is to receive 15
<br />acres of contiguous property and the balance is to go to Rudolph Baasch.
<br />IT IS THEREFORE CONSIDERED, ADJUDGED AND DECREED BY THE COURT that the true intent and meaning
<br />of the last will and testament of Ernst Baasch, deceased, is as follows, to -brit:
<br />LAST WILL AND TESTAMENT.
<br />I. Ernst Baasch, of Hall County of the State of Nebraska, do hereby make, declare, and publish
<br />this, my last will and testament, and hereby revoking all former wills by me made.
<br />1.
<br />I order and authorize my executor to pay all the just debts of my last sickness and burial.
<br />11. .
<br />To my beloved wife, Bertha Baasch, I give, and bequeath a life interest in all real estate
<br />that I may die seized of.
<br />III.
<br />Subject to the life estate of my wife, Bertha Baasch, I give, devise and bequeath unto my
<br />son, Daniel Baasch, the East Half of the South Half of the Southeast Quarter of Section 13,
<br />Township 11, North,Range 9, West of the 6th P.M.; that being the portion with the buildings upon
<br />it. 1V.
<br />Subject to the life estate of my wife, Bertha Baasch, I give, devise, and bequeath unto my son,
<br />Elmer Baasch, the West portion of the South Half of the Southeast Quarter of Section 13, Township
<br />11, North,Range 9, 'Nest of the 6th P.M., containing 39 acres more or less.
<br />V.
<br />Subject to the life estate of my wife, Bertha Baasch, I give, devise, and bequeath unto my
<br />beloved sons, Rudolph Baasch and George Baasch, 23 acres more or less described hereinafter;
<br />A strip of land off the West side of the Southwest Quarter of the Northeast Quarter and
<br />Lot 2 on Island, in said section, running from South -to North through said premises with
<br />parallel sides, 27 rods wide containing about 23 acres; subject, however, to the right of
<br />way over a strip of said land one rod wide at the South end of said premises reserved in
<br />these grantors, their heirs, and assigns for the purpose of passing over said land to the
<br />premises lying adjacent thereto and East thereof.

<br />I,give, devise, and bequeath all my personal property that I may die possessed of to my son,
<br />Daniel Baasch, and my wife, Bertha Baasch, and any personal property that should remain in their
<br />hands should my wife preceed Daniel Baasch in death shall be and become the property of Daniel
<br />Baasch; it being my intention that my personal property should be and become the sole property
<br />of Daniel Baasch upon the death of my wife, Bertha Baasch.
<br />The rest residue and remainder, I give, devise, and bequeath unto my son, Daniel Baasch.
<br />I hereby nominate and appoint Daniel Baasch, executor of this, my last will and testament,
<br />and request th;�..t he serve without bond.
<br />IT IS FURTHER CONSIDERED, ADJUDGED AND DECREED BY THE COURT that a clear description of the
<br />bequest to George Baasch and Rudolph Baasch, is as follows:
<br />Subject to the life estate of my wife, Bertha Baasch, I give, devise and bequeath unto my
<br />beloved sons, Rudolph Baasch and George Baasch, 23 acres more or less described hereinafter:
<br />A strip of land off the nest aside of the Southwest Quarter of the Northeast Quarter and Lot 2
<br />on Island in said section running from south to North.through said premises with parallel sides,
<br />27 rods wide containing about 23 acres. An additional description of this property is as follows:
<br />A strip of lane;. 27 rods wide off of the West end of the Southwest Quarter of the Northeast Quarter
<br />and a strip of land off of the West portion of Lot 2, 27 rods wide, the same being a 'part of the
<br />Northwest �.iarter of the Northeast Quarter of Section 13, Township 11, Range 9, both parcels con-
<br />taining 23 acres more or less; subject, however, to the right of way over a strip of said land
<br />one rod wide at the South end of said premises reserved in these grantors, their heirs, and assigns
<br />for the purpose of passing over said land to the premises lying adjacent thereto and East thereof.
