<br />IN THE MATTER OF THE ESTATE :
<br />OF ERNST BAASCH, DECEASED. D E C R E E
<br />This matter coming on to be heard on the 6th day of July, 1946, the.petitioner being present
<br />in court with his attorney, John F.McCarthy, and the court finds that service of summons was had
<br />upon Bertha Baasch, widow, George Baasch, son, and Elmer Baasch, son, all of Grand Island, Hall
<br />County, Nebraska, and Rudolph Baasch, who is a resident of Columbus, Platte County, Nebraska, son:
<br />that all of said parties are in default for answer or other pleading and defaultis entered against
<br />them.
<br />The court further finds that a petition for the probate of said Last Will and Testament of
<br />Ernst Baasch was filed in the County Court of Hall County, Nebraska, and that Daniel Baasch is
<br />the duly appointed and acting executor of the estate of Ernst Baasch, deceased.
<br />The court further find's that the original will -is in the following words and figures to -wit:
<br />LAST WILL AND TESTAMENT.
<br />I, Ernst Baasch, of Hall County of the State of Nebraska, do hereby make, declare, and publish
<br />this my last will and testament, and hereby revoking all former wills by me made.
<br />1.
<br />I order and authorize my executor to pay all the just debts of my lost sickness and burial.
<br />11.
<br />To my beloved wife, Bertha Baasch, I give and bequeath a life interest in all real estate
<br />that I may die seized of,
<br />111.
<br />Subject to the life estate of my wife, Bertha Baasch, I give, devise, and bequeath unto my
<br />son, Daniel Baasch, the East Half of the South Half of the Southeast Quarter of Section 13,
<br />Township 11, North,Range 9, West of the 6th P.M.; that being the portion with the buildings upon
<br />it. iv.
<br />Subject to the life estate of my wife, Bertha Baasch, I give, devise, and bequeath unto my
<br />son, Elmer Baasch, the East portion of the South Half of the Southeast Quarter of Section 13,
<br />Township 11, North,Range 9, West of the 6th P.M., containing 39 acres more or less.
<br />V.
<br />To my beloved sons, Rudolph Baasch and George Baasch, I give, devise, and bequeath 23 acres
<br />more or less described hereinafter:
<br />A.strip of land off the West side of the Southwest Quarter of the Northeast Quarter and
<br />Lot 2 on Island in said section running from South to North through said premises with
<br />parallel sides, 27 rods TEA de containing about 23 acres; subject, however, to the right
<br />of way over a -strip of said land one rod wide at the South end of said premises reserved
<br />in these grantors, their heirs, and assigns for the purpose of passing over said land to
<br />the premises lying adjacent thereto and East thereof.
<br />and to George Baasch, I give, devise, and bequeath 15 contiguous acres of the said premises and
<br />the balance of the said premises, I give, devise, and bequeath unto Rudolph Baasch; it being my
<br />intention that my son, George Baasch, is to receive 15 acres of contiguous; property and the
<br />balance is to go to Rudolph Baasch.

<br />I give, devise, and bequeath all my personal property.that I may die, possessed of to my son,
<br />Daniel Baasch, and my wife, Bertha Baasch, and any personal property that should remain in their
<br />hands should my wife preceed Daniel Baasch in death shall be and become the property of Daniel
<br />.Baasch; it being my intention that my personal property should be and become the sole property of
<br />Daniel Baasch upon the death of my wife, Bertha Baasch.
<br />The rest residue and remainder, I give, devise, and bequeath unto my son, Daniel Baasch.
<br />I hereby nominate and appoint Daniel Baasch, executor of this, my last will and testament,
<br />and request that he serve without bond.
