<br />I.
<br />That the report of William A. Fisetier, Administrator with Will Annexed, filed herein, be
<br />and the same is Hereby in all things approved and allowed as aid for his final account and in
<br />full settlement of his trust; that lie be discharged and tie and his surety released from all
<br />further liabilit -,r on his official bond.
<br />II.
<br />That the said August Fischer died testate on April 1, 1944, a resident of Hall County,
<br />Nebraska; that he left surviving him as his next of kin and heirs at law, a widow, Mary Fischer,
<br />and a son, William A. Fischer, both of legal age; that he left no other living children or the
<br />living issue of any deceased childrexi - -and that said widow and son are the sole and only heirs
<br />of his estate.
<br />III.
<br />That the real estate hereinbef'ore described, of which the aaid August Fischer died seized
<br />and possessed, be and the same hereby is assigned to the said Mary Fisclier in accordance with
<br />the terms and provisions of the last will and testament of the said August Fischer, deceased.

<br />LAST WILL A''D TESTAME TT OF LARY FISCHER.
<br />I, Mary Fischer, of Grand Island, Hall County, Nebraska, biking of sand mind and disposing
<br />memory, do make, publish, and declare this, qty last will and testament.
<br />FIRST.
<br />I direct that all of my just debts and the expenses of my last sickness and burial be first
<br />paid out of my estate.
<br />SECOND.
<br />I give and bequeath to my son, William A. Fischer, the sum of Fifty Dollars, to be paid to
<br />him in the due course of the administration of my estate.
<br />He is the only child I have, and feeling that my husband, Warned as residuary legatee and
<br />devisee in this will, will, at his death, make ample provision for him, I make•no other or
<br />further provision than as herein stated, for my said son.
<br />THIRD.
<br />All bf the rest, residue, and remainder of my estate, real, personal, and mixed, and where-
<br />soever situate, I give, devise, and bequeath unto my beloved husband, August Fischer.
<br />FOURTH.
<br />I name, nominate, and appoint my said husband, August Fischer, Executor of this will, here-
<br />by revoking all former wills by me made.
<br />IN, TESTIIONY WILEREOF, I have Hereunto signed my name to this instrument, consisting of one
<br />page of typewritten matter, on this 15th da17 of August, A. D., 1921.

<br />of any deceased children, and that said widow and son are the sole and only heirs of his estate.
<br />2. That on January 31, 1946, the last will and testament of the said August Fisclier,
<br />deceased, was duly proved, allowed and admitted to probate and on said date William A. Fischer
<br />was appointed Administrator will 777111 Annexed, qualified as such and has been actingin said
<br />capacity ever since.
<br />3. That due notice as given to creditors of the time limited in which to file claims
<br />against said estate; that such time has duly expired and all claims against said estate, including
<br />the expenses, of his last illness and funeral, and the costs and expenses of administration have
<br />been paid in full; that the further presentation of claims against said estate has been forever
<br />barred by the former order of this court; that there is no inheritance tax due the State of
<br />Nebraska, and no federal estate tax due the United States of America.
<br />4. That the report of the Administrator with,Will Annexed, filed herein, is in all things
<br />true and correct and should be approved and allowed as his final report; that there is no
<br />personal property or money in the hands of said Administrator with Will Annexed for distribution.
<br />5. That the said August Fischer died seized and possessed of Lot 6, in Block 77, in the
<br />Original Town, now City of Grand Island, Hall County Nebraska; that by the terms and provisions
<br />of his will, said real estate was devised to his widow, the said Mary Fischer.
<br />IT IS THEREFORE CONSIDEF'1 ED, 0- D-ERED, ADJUDGED AND DECREED by the court:
